Home My WebLink About2018-OR-31 AMENDING 2000-OR-61 SPECIAL EXCEPTIONS USES STATE OF INDIANA BEFORE THE JEFFERSONVILLE COMMON COUNCIL ORDINANCE 2018-OR- o3 1 AN ORDINANCE AMENDING THE CITY OF JEFFERSONVILLE ZONING ORDINANCE (2000-OR-61) TO UPDATE PERMITTED AND SPECIAL EXCEPTION USES AS RECOMMENDED BY THE PLAN COMMISSION Whereas,Jeffersonville Department of Planning and Zoning filed a petition before the Jeffersonville Plan Commission to amend the City of Jeffersonville Zoning Ordinance (2000- OR-61) as recommended in the staff report(a copy of which is attached as Exhibit "A"); and, Whereas, on May 14, 2018 the Jeffersonville Plan Commission has certified its favorable recommendation of the enactment of this proposed amendment to the Zoning Ordinance (2000-OR-61)by ordinance of this Common Council; and, Whereas,this matter is now before the Common Council at its regular meeting after certification of the proposed changes to the Zoning Ordinance pursuant to the provisions of I.C. 36-7-4-608(0(1); and, Whereas,this Common Council has timely posted notice of its intent to consider the proposed change of comprehensive plan at the regular meeting scheduled for May 21, 2018; and, Whereas, all interested persons having been given an opportunity to appear before this Common Council and be heard regarding this matter as required by law. Now, THEREFORE, BE IT ORDAINED by the Common Council of the City of Jeffersonville, Indiana, that the City of Jeffersonville Zoning Ordinance(2000-OR-61) is hereby amended to update the Permitted/Special Exception Uses as follows: 1. To amend the Permitted/Special Exception Uses for the NI(Neighborhood Industrial) Zoning District in Article 4, and 2. To amend the Permitted/Special Exception Uses for the I2 (Industrial Park/Heavy Industrial) Zoning District in Article 4 As recommended in the staff report(a copy of which is attached as Exhibit"A"). IT IS FURTHER ORDAINED that the City of Jeffersonville Zoning Ordinance(2000- OR-61) shall be amended to include such changes. The update includes: 1. To amend the Permitted/Special Exception Uses for the NI (Neighborhood Industrial) Zoning District in Article 4, and 2. To amend the Permitted/Special Exception Uses for the 12 (Industrial Park/Heavy Industrial) Zoning District in Article 4. NI Uses Update The Permitted and Special Exception Uses for the Neighborhood Industrial (NI) Zoning District are being updated to remove some undesireable uses from existing neighborhoods when and where existing parcels currently zoned NI may redevelop in the future. The plan also adds a number of new permitted uses that would be permissible if and when legacy industrial properties in these areas close up shop. Finally, the revisions serve to clear up a number of non-conforming uses within America Place. The full list of changes can be found in Exhibit A. 12 Use Update The Permitted and Special Exception Uses for the Industrial Park/Heavy Industrial (12) Zoning District are being updated to include a few industrial uses that are not listed elsewhere in the code.
