("Koetter"), have filed a petition for the vacation of a portion of(i) a public way known as Bridgeport Drive, and (ii) a certain utility easement adjacent to Bridgeport Drive pursuant to the provisions of IC 36-7-3-12 and 36-7-3-16; and, WHEREAS, Koetter has caused a notice of public hearing on such petition before this Council-to be properly published in accordance with Indiana law; and, WHEREAS, this Council having held such public hearing at the date and time as stated in such published notification; and, WHEREAS, no there are no adjoining property owners to the portion of the public way or portion of the utility easement proposed to be vacated, except for Koetter. NOW, THERFORE, BE IT ORDAINED BY THE COMMON COUNCIL FOR THE CITY OF JEFFERSONVILLE, INDIANA, as follows: 1. The Common Council for the City of Jeffersonville, hereby finds all of the following: a. No other person or entity owns any real property that is adjacent to or served by the portion of the public way or portion of the utility easement. b. The proposed vacation will not hinder the growth or orderly development of the City of Jeffersonville, Indiana. b. The proposed vacation will not make access to the lands of any aggrieved person by means of public way difficult or inconvenient. c. The proposed vacation will not hinder the public's access to a church, school, or other public building or place. d. Vacating the Easements will not hinder any utility company's 7 X18- OR-aI ability to provide utility services to the residents in the surrounding area. 2. Koetter's petition for vacation of a portion of the public way known as Bridgeport Drive is hereby granted, and that portion the public way known as Bridgeport Drive lying within Jeffersonville's municipal boundaries, as depicted on attached Exhibit "B" and described in Exhibit "C" is hereby vacated. [Exhibit A is intentionally omitted] 3. Koetter's petition for vacation of a portion of the utility easement adjacent to Bridgeport Drive is likewise granted, and that portion the utility easement lying within Jeffersonville's municipal boundaries, as depicted on attached Exhibit "B" and described in Exhibit"C" is hereby vacated. 4. Koetter shall cause a certified copy of this Ordinance to be recorded in the office of the Recorder of Clark County, Indiana, in accordance with the provisions of Ind. Code § 36-7- 3-12(e), and thereafter shall file a recorded copy with the office of the Clerk-Treasurer of the City of Jeffersonville, Indiana. 5. This Ordinance shall be in force and effect upon its adoption. Mike Moore, Mayor 9 STATE OF INDIANA BEFORE THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE IN RE THE PETITION TO VACATE A PORTION OF BRIDGEPORT DRIVE, A PUBLIC WAY, AND A CERTAIN UTILITY EASEMENT ADJACENT THERETO, IN THE CITY OF JEFFERSONVILLE, INDIANA, KOETTER DEVELOPMENT, INC, Petitioner. PETITION TO VACATE A PORTION OF BRIDGEPORT DRIVE, A PUBLIC WAY,AND A CERTAIN ADJACENT UTILITY EASEMENT Comes now petitioner, Koetter Development, Inc., and hereby petitions the City of Jeffersonville, Indiana (hereinafter referred to as the "City"), to vacate a portion of that certain dedicated roadway known as Bridgeport Drive and that certain utility easement adjacent thereto, and, in support hereof, would state as follows: 1. Petitioner, Koetter Development, Inc., (hereinafter "Koetter"), an Indiana corporation with its principal office located at 7393 Pete Andres Road, Floyds Knobs, Indiana 47119, is the sole owner of real property commonly known Bridgeport Business Centre, Lot 2A and Lot 2B, as depicted in minor plat recorded at Plat Book 17, Page 41 (hereinafter referred to as the "Minor Plat"), said Minor Plat being a minor plat of Bridgeport Business Centre, Lot 2 as shown on plat recorded at Plat Book 16, Page 47 in the Clark County Recorder's Office. A copy of said Minor Plat is attached as Exhibit"A"hereto. 2. Pursuant to the provisions of IND. CODE § 36-7-3-12, Koetter seeks to vacate a portion of Bridgeport Drive, a public way in the City of Jeffersonville, Indiana, as the public way proposed to be vacated no longer meets its original intended purpose and negatively effects the setback requirements of any building on the Property. The area of the public way proposed to be vacated ("Public Way Area") is more particularly shown in the plat drawing attached hereto and incorporated herein as Exhibit "B," and described by metes and bounds on Exhibit "C" attached hereto. 3. Pursuant to the provisions of IND. CODE § 36-7-3-16, Koetter seeks to vacate that portion of the utility easement adjacent to the Public Way Area. The area of that portion of the utility easement proposed to be vacated ("Easement Area") is likewise shown in Exhibit "B," and described by metes and bounds on Exhibit"C". 4. Koetter owns all of the property abutting the Public Way Area and Easement Area which are the subject of this petition. 5. Pursuant to the provisions of IND. CODE § 36-7-3-16(b), Koetter acknowledges that these vacation proceedings shall not deprive any public utility of the use of all or part of the area to be vacated, if, at the time the proceedings are instituted, the utility is occupying and using all or part of such area for the location and operation of its facilities. In the event this Petition is granted, Koetter intends to file a minor plat or easement which conveys to the utility companies providing service to the area a utility easement over the portion of the Public Way Area currently used by said utility companies. 6. In support of the proposed vacation, Koetter further affirmatively states its good faith belief that: a. The proposed vacation will not hinder the growth or orderly development of the City or the neighborhood in which it is located or to which it is contiguous as only a small portion of Bridgeport Drive will be vacated and the paved thoroughfare shall remain intact. b. The proposed vacation will not make access to the lands of any persons by means of public way difficult or inconvenient. 2 c. The proposed vacation will not hinder the public's access to a church, school, or other public building or place. d. The proposed vacation will not hinder the use of a public way by the neighborhood in which it is located or to which it is contiguous. 7. Koetter has further caused notice of the filing of this Petition and the scheduled hearing hereon to be published in The News and Tribune newspaper one (1) time at least ten (10) days before the scheduled date of such hearing as required by IND. CODE § 5-3-1-2(b). WHEREFORE, petitioner, Koetter Development, Inc., respectfully asks that the Common Council of the City of Jeffersonville, Indiana, conduct a public hearing on this Petition, and that following such hearing, enact and adopt an ordinance vacating the above-described portion of Bridgeport Drive, a public way, and that certain utility easement adjacent thereto, both as requested herein.
