Resolution Requesting the
Jeffersonville City Council Intervene

Whereas, the City of Jeffersonville, Indiana agreed to
terminate its lease with Clark County, Indiana and vacate the
City County Building on January 1, 2004.
Whereas, in exchange for relinquishing its lease, the City
also agreed to relinquish any ownership which the City accrued in
the City County Building.
Whereas, the County Commissioners, County Council and
Building Authority agreed to release the City from its obligation
and as a result the City of Jeffersonville was paid One Million
Six Hundred Thousand Dollars ($1,600,000) for its interest in the
City County Building.
Whereas, the proceeds from the sale were not deposited in
the C~ty's General Fund.
Whereas, the City Council questioned the whereabouts of
those funds.
Whereas, the City Council was informed by the Executive that
the proceeds from the sale were being utilized to purchase The
Quartermaster Depot property which would be sold to a private
developer.
Whereas, the City Council was assured by the Executive that
the proceeds from the sale of the Quartermaster Depot Property
would result in a profit to the City.
Whereas, the City Council passed a resolution on the __
of , 2002 wherein it demanded the repayment of those
funds not later than December 31, 2002.

Whereas, the time for repayment has passed.
Whereas, The City Council has been informed that the
proceeds from the sale would not be repaid to the City.
Whereas, Indiana Code provides that the City Council, the
Council President and/or other specifically named parties may
request the Clark Circuit Court enter an order determining the
propriety of actions of the Executive and/or other branches of
government.
Whereas, the City Council is desirous of resolving this
issue in an expedient fashion.
Whereas, it is resolved that the Jeffersonville City
Council, the Council President and/or any other party vested with
the lawful rights to do so shall seek all legal remedies
available to determine the propriety of the Executive's actions
and/or the remedies available to the council.
