TENTH STREET REHABILITATION AND BEAUTIFICATION PROJECT FROM NORTH OF ALLISON LANE TO SOUTH OF SR265 ADMINISTRATION/ INSPECTION SERVICES JEFFERSONVILLE REDEVELOPMENT COMMISSION JEFFERSONVILLE, INDIANA This Supplemental Agreement made and entered into this 31st day of January,2018,by and between the City of Jeffersonville, IN, acting by and through its duly appointed Redevelopment Commission (OWNER), and Jacobi,Toombs and Lanz, Inc., Consulting Engineers, 1829 E. Spring Street, Suite 201,New Albany, Indiana 47150 (CONSULTANT), WITNESSETH WHEREAS, the OWNER and the CONSULTANT did, on June 1, 2016, enter into an agreement providing necessary Professional Engineering Services required in connection with the Survey and Design of the East Tenth Street Rehabilitation and Beautification Project, and, WHEREAS,following the required public bidding process,Construction Bids were received on March 30,2017, WHEREAS, the June 1, 2016 agreement under Attachment B: Fee Schedule, contains a provision to add the Construction Administration and Inspection fees once construction bids had been received,and,the construction of the project was extended due to weather conditions and the addition of Herb Lewis Road improvements, And WHEREAS, Supplemental Agreement No. 1 was added on April 5, 2017 to cover Construction Administration and Inspection, And WHEREAS, it has become necessary to increase the total not-to-exceed budget of four hundred and eight thousand dollars ($408,000.00) established in Supplemental Agreement No. 1. NOW THEREFORE,it is agreed by and between the parties hereto to the following additions or changes in the agreement: ATTACHMENT 'B': FEE SCHEDULE Construction Administration& Inspection Services Payment to the CONSULTANT for Construction Administration and Inspection Services shall be on a Time and Materials basis,in accordance with the Hourly Billing Rates shown in Attachment 'C',with a total amount not to exceed five hundred thousand dollars and no cents ($500,000.00). Exceeding Estimated Fees: The estimated total fees shown herein are based on the description of work described in this agreement. The CONSULTANT reserves the right to request an adjustment to the estimated total fees if necessary as a result of scope changes or schedule adjustments that are outside the CONSULTANT'S control. j:\projects\I 604)-East i oth Street Rehabilitation\Contracts\5upplemental Agreement No.2 for CE.doc ATTACHMENT'C': HOURLY BILLING RATES The Hourly Billing Rates for 2018 is hereby included and incorporated as Attachment'C' and replaces the attachment C in the original Agreement. EXCEPT as herein modified,charged and supplemented,all items of the original agreement dated June 1, 2016, shall continue in full force and effect.
