Home My WebLink About2017-OR-56 ORDINANCE NO. 2017-OR- AN ORDINANCE VACATING A PUBLIC WAY AN ORDINANCE FOR THE VACATION OF THE PUBLIC WAY PURSUANT TO A PETITION FILED BY CAMPHIRE PROPERTIES, LLC BE IT ORDAINED by the Common Council of the City of Jeffersonville, Indiana, pursuant to I.C. 36-7-3-12, that: SECTION 1. The application filed by CAMPHIRE PROPERTIES,LLC,by and through its duly authorized member,Joseph Papalia,is requesting the vacation of a portion of the public way commonly known as Fairview Avenue located in Jeffersonville, Clark County Indiana, and described as follows,to-wit: Being a forty (40') foot wide public right-of-way at the southwesterly corner of Lot No. Thirty-Two (32) of Beech Fairview Subdivision,Block No. Two (2),Plat Book 4,Page 107 and running thence in a northwesterly direction to its termination the eastern corner of Lot No. Thirty-Five (35) of Beech Fairview Subdivision. And also that Ten (10) foot unnamed alley on the northwestern side of Lot No. Thirty-Five (35) running from Fairview Street in a northeasterly direction the complete depth of Lot No. Thirty-Five (35). SECTION 2. That the vacation shall not affect governmental rights to those areas designated as flood ways, flood plains, and/or flood ponding areas, or public utilities. SECTON 3. This Ordinance vacating the above-described property in Jeffersonville, Clark County, Indiana shall be in the fall force and effect from and after its passage by the Common Council of the City of Jeffersonville, Indiana, this.2L—day of August, 2017, subject to verification of the legal description and location of any public utility easements. NOW, THEREFORE, IT IS HEREBY ORDAINED,pursuant to the provisions of I.C. 36-7-3-12, that the public way described in Exhibit"A"attached hereto and incorporated herein by the reference are hereby vacated and the Attorney representing the petitioner is hereby instructed to record a copy of this Ordinance in the office of the Clark County Recorder and deliver a copy of this Ordinance to the Clark County Auditor.
