Except as otherwise provided, the words and phrases used in this traffic code shall have the definitions used in IC 9-21-1 et seq. ('77 Code, § Il-l) § 70.02 OBEDIENCE 'PO POLICE OA-'~'ACEP, S. No person shall willfully fail or refuse to comply with any lawful order or direction of any police officer invested by law with authority to direct, control, or regulate traffic. ('77 Code, § 11-2) Penalty, see § 70.99 § 70.03 APPLICATION OF TRAFFIC CODE TO PERSONS P,]DING AIT/MALS, DPIVING ANIMAL- DRAWN VEHICLES. Every person riding an animal or driving any animal drawing a vehicle upon a roadway shall be subject to the provisions of this traffic code applicable to the driver of a vehicle except those provisions of this chapter which by their nature can haVe no application. ('77 Code, § 11-5) 3 4 Je~emomdlle- ~ Code § ?0.04 APPLICATION OF TRAF~C CODE TO OWNERS OF P. EAL PROPERTY USED FOR VEHICULAR TRAF~C. Nothing in this traffic code shall be construed to prevent the owner of real property used by the public for purposes of vehicular travel by permission of the owner and not as a matter of right from prohibiting such use, or from requiring other or different or ~.dditional conditions than those specified in this chapter, or otherwise regulating such use as may seem best to such owner. ('77 Code, § 11-19) § ?0.05 PUBLIC OFFICEI~ AND EMPLOr ~-'~.S TO OBEY TRAFFIC CODE PROVISIONS; EXCEPTIONS. (A) The provisions of this traffic code applicable to the drivers of vehicles on a highway shall apply to the drivers of all vehicles owned or operated by the United States, this state, or any county, city, town, district or any other political subdivision of the state, subject to such specific exceptions as are set forth in this traffic code with reference to authorized emergency vehicles. (B) Unless specifically made applicable, the provisions of this traffic code shall not apply to persons, teams, motor vehicles, and other equipment while actually engaged in work on the surface of a highway but shall apply to such persons and vehicles when traveling to or from work. (C) The driver of any authorized emergency vehicle when responding to an emergency call or when in the pursuit of an actual or suspected violator of the law or when responding, but not upon returning from a fn'e alarm, may exercise the privileges set forth in this traffic code, but subject to the conditions herein stated. (D) The driver of an authorized emergency vehicle may: (1) Park or stand, irrespective of the provisions of this traffic code. (2) Proceed past a red or stop signal or stop sign, but only after slowing down as may be necessary for safe operation. (3) Exceed the maximum speed limits so long as he does not endanger life or property. (4) Disregard regulations governing direction of movement or turning in specified directions. (E) The exemptions herein granted to an authorized emergency vehicle shall apply only when such vehicle is making use of audible or visual signals meeting the requirements of law, except that an authorized emergency vehicle operated as a police vehicle need not be equipped with or display a red light visible from in front of the vehicle. (P) The foregoing pro'¥4sions shall not relieve the driver of an authorized emergency vehicle from the duty to drive with due regard for the safety of all persons, nor shall such provisions protect the driver from the consequences of his reckless disregard for the safety of others. The Street Commissioner is authorized to erect and maintain all traffic-control signs, signals, markings, and devices Which are necessary to enforce the provisions of this traffic code or of any other ordinance of the city, ('77 Code, § il-8) § 70.16 RA. rir-iC, ATION OF EXISTING DEVICES. All traffic-control signs, signals, devices, and markings which are in place on the effective date of this code are hereby ratified and the same shall be controlling as if a list of same were in this code. ('77 Code, § 11-7) § 70.99 G'EI~r. mAL PENALTY. (A) Payment of penalties. (1) Whenever this traffic code is violated, the person so charged for such violation, shall be cited to come before the Judge of the City Court. (2) The Judge of the City Court shall be authorized to establish a Traffic Violations Bureau to receive payment of penalties. (3) Payment of penalties shall be made to the City Court Clerk's office. (B) Penalty schedule. It shall be unlawful for any person to drive or operate any vehicle upon a sidewalk. ('77 Code, § 11-10) (Ord. 829, passed 8-1-21) Penalty, see § 71.99 § 71.02 DRIVING VEB~CLES WI-IICH DAMAG~ STREETS. No person shall operate or move a vehicle on any street when such surface is being visibly and materially damaged thereby. ('77 Code, § 11-16) (Ord. 1117, passed 7-11-39) Penalty, see § 71.99 § 71.03 SP~:u~ LIMITS. (A) A speeding violation shall be construed by the court as that which is in excess of the posted speed limit or that which is in excess of what is reasonable and prudent under the conditions and having regard to the actual and potential hazards there existing at the time of the alleged violation. (B) The driver of every vehicle shall drive at the appropriate reduced speed when approaching an intersection or crossing. (C) Except when special hazards exist which require lower speed for compliance with division (A) above, the limits specified by the city shall be the lawful ~um speed, and no persons shall drive a vehicle on a s~reet at a speed in excess of such maximum limits. The city is authorized to designate those pa~s of the streets where overtaking and passing would be hazardous and may, by appropriate signs or marks on the street, designate no passing zones which shall be obeyed by the driver of a vehicle. (Ord. 82-OR-8, passed 2-1-82) Penalty, see § 71.99 § 71.0~ ONE-WAY The driver of a vehicle shall not disobey a sign designating.one-way traffic. (Ord. 82-OR-8, passed 2-1-82) Penalty, see § 71.99 One-way streets, see Ch. ?4, $ched. I § 71.06 DISOBEDIENCE TO TRA~'r'lC-COlvl'aOL DEVICF_~. No driver of a vehicle shall disobey the instructions of any traffic-control device on or upon the streets of the city. (Ord. 82-OR-8, passed 2-1-82) Penalty, see § 71.99 § 71.07 w~GHY (A) It shall be a violation of this section for any vehicle having a gross weight in excess of five tons to travel upon or across any of the following streets, alleys, drives, or any portion thereof in Chapter 74, Schedule IV unless a permit is obtained pursuant to the provisions of this section. (B) The Board of Public Works and Safety is authorized to erect those signs as are necessary for the enforcement of this section. The Board of Public Works and Safety shall also determine any alternative routes as may be necessary to allow access to industr/al or business sites located in the city. (C) The Police Department is also empowered to grant perm/ts for travel upon the streets and alleys set forth in division (A) above, provided that the individual requesting the permit can demonstrate to the Police Department that access to a particular location cannot be made w/thout use of the restricted street or alley and that the individual provides the Department with a bond in an appropriate amount. (D) If any vehicle is driven in violation of this section and the owner of the vehicle or the person in whose name the vehicle is titled shall be some one other than the driver, then the person who is the owner or the person in whose name the vehicle is registered shall be held prima facie responsible for the violation. All railroad trains, railroad engines, and any and alt other vehicles traveling along railroad rails or tracks shall at the following locations in Chapter 74, Schedule II stop, and the conductor or trainman in charge of same shall cause a train crew member to flag the traffic traveling ever and along such right-of- way as listed in Chapter 74, Schedule ri, andto place on both sides of the railroad track in such right-of- way a lighted flare or fuse prior to the train, engine, or rail vehicle entering the limits of the street or right-of-way. After the train clears the public right-of-way the train crew member shall retrieve the lighted flares or fuse. (Ord. 81-OR-19, passed 5-4-81; Am. It shall be unlawful for any driver of a vehicle to make that turning movement commonly referred to as a U-turn. ('77 Code, § 11-9) Penalty, see § 71.99 § 71.99 PENALTY. (A) Whoever violates any provision of this chapter for which a penalty is not already otherwise provided, shall be subject to the penalty as set forth in § 70.99. (B) Any person receiving a citation as a result of a violation of any of the provisions of § 71.07, shall pay an assessment of $25 if paid within 72 hours to the Clerk-Treasurer. In the event that any person wh© is charged with a violation under § 71.07 who fails to pay as above provided, such person shall be charged in city court and upon conviction shall be fined not less than $25 nor more than $500. I § 72.01 APPLICATION OF REGULATIONS. The provisions of this subchapter prohibiting the standing or parking of a motor vehicle shall apply at all times or at those times herein specified or as indicated on official signs except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the directions of a police officer or official traffic-control device. (Ord. 80-OR-6, passed 5-5-80) § 7~..02 AUTHORITY OF CTIT ?O LIMIT PAP, KIN~; OBEDIENCI~ REQUIRED. The Common Council by ordinance and the Board of Public Works and Safety by resolution may limit parking at any time it is deemed in the public interest on any street, alley or thoroughfare or other public place and the limitation shall become effective upon posting of appropriate signs indicating the limitations. (Ord. 80-OR-6, passed 5-5-80) § 72.03 STOPPING, STANDING. OR PARKING PROHIBi'i'~u; NO SIGNS REQUIRED. No person shall stop, stand, or park a vehicle except when necessary to avoid conflict with other traffic or in compliance with law or the directions of a police officer or traffic-control device in any of the following places: (A) On a sidewalk. (B) In front of a public or private driveway. (C) Within an intersection. (D) Within 15 feet of a fire hydrant. (E) On a crosswalk. (F) Within 20 feet of a crosswalk. (G) Within 30 feet upon the approach to any flashing beacon, stop sign, or traffic-control signal located at the side of the roadway. (H) Within 50 feet of the nearest raft of a railroad crossing. (I) Within 20 feet of the driveway to any emergency vehicle garage or parking space, or on the opposite side of the street of the driveway or space for the same entrance. (J) Alongside or opposite any street excavation or obstruction when stepping, standing, or parking weuld obstnlct traffic. Stopping, Standing, and Park/rig 13 (K') On the roadway side of any vehicle stopped or parked at the edge of curb or a street. (Double parking) (L) Upon any bridge or other elevated structure upon a highway or within a highway tunnel. (M) At any place or location where official mgns prohibit stopping or parking. (N) In parking areas designated for handicapped persons unless the operator or a passenger is handicapped. (0) In those areas rsarked and desi~nated as fire lanes. (p) In any area designated as no parking by a yellow curb marking. (Q) Along any curb in a direction opposed to the proper and main flow of traffic on any street or alley. No person shall park a vehicle upon any roadway, street, or alley for the principal purpose of: (A) Displaying the vehicle for sale. (B) Repaming or lubricating the vehicle. ('77 Cede, § 11-13) (Ord. 80-OR-6, passed 5-5-80) Penalty, see § 72.99 For further provisions regarding parking motor vehicles for sale or repai~ on roadway, street or alley, see Ch, I01 § 72.0~ A~,E PAREING. Angle or diagonal parking is permitted only upon Court Ave., between Locust Street on the west and Meigs Avenue on the east, in those areas se designated. (Ord. 80-OR-6, passed 5-5-80) Penalty, see § 72.99 § 72.06 PARKING BE'l'wi~:at' LINES. In all locations where lines have been painted on the pavement designating parking places or spots. vehicles must be parked within those lines and it is hereby declared a parking violation to park across the lines when parallel parking or to straddle the lines for diagonal or straight-in parking. (Ord. 80-OR-6, passed 5-5-80; Am. Ord. 84-OR-45, passed 6-6-84) Penalty, see § 72.99 § 72.07 PARKING NF_AR SOHOOLS. (A) The Board of Public Works and Safety is hereby authorized to erect signs indicating "No Parking'' upon either or beth sides of any street adjacent to any school property when the parking would, in their opinion, interfere with traffic or create a hazardous situation. (B) When official signs are erected indicating "No Parking" upon either side of a street adjacent to any school property as authorized herein, no person shall park a vehicle in any designated piace. (Ord. 80-OR-6~ passed 5-5-80) Penalty, see § 72.99 14 Je~senvflle - Tr,,~- Code § 72.0~ PA~rNG NEAR HAZARDOUS OR CONGESTm.~ PLACES. (A) All vehicular Parking is prohibited according to the schedule in Chapter 75, Schedule I. (B) The Board of Public Works and Safety is hereby authorized to determine and designate by proper signs places not exceeding 100 feet in length in which stopping, standing, or parking of vehicles would create an especially hazardous condition or would cause delay in traffic. (C) When official signs are erected at hazardous or congested places as authorized herein no person shall stop, stand, or park a vehicle in any designated Place. (Ord. 80-OR-6, passed 5-5-80) Penalty, see § 72.99 § 72.09 PARKING SO AS NOT TO BLOCK DI~w:wAY. No person shall stop, stand, or park a vehicle within an alley in a manner as to block the driveway entrance to any abutting property. ('77 Code, § li-ll) (Ord. 1622, passed 11-2-64) Penalty, see § 72.99 § 72.10 PARKING SO AS NOT TO OBSTRUCT TRAFFIC. No person shall park a vehicle in a street or alley in a manner or under conditions as to leave available less than I0 feet of the width of the roadway for the free movement of vehicular traffic, and no person shall stop, stand, or park a vehicle in a street or alley in a position as to block the driveway entrance to any abutting property. ('77 Code, § 11-12) (Ord. 80-OR-6, passed 5-5-80) Penalty, see § 72.99 § 72.11 PARKING OF SEMI-TRAILER TRUCKS. (A) SemLtraflers, unhooked tractors, unhooked trailers, or buses shall not be parked on the public streets or alleys of the city except for the purpose of loading or unloading the cargo from such tracks or buses. (B) Serni-tractors shall not be left running except during periods of time when they are being loaded or unloaded. (Ord. 80-OR-6, passed 5-5-80; Am. Ord. 84-OR-45, passed 6-6-84; Am. Ord. 86-OR-15, passed 4-5-86) Penalty, see § 72.99 § 72.12 BUS STOPS, TAXI STANDS. The Board of Public Works and Safety is hereby authorized and required to establish bus stops, bus stands, taxicab stands, and stands for other passenger common-carrier motor vehicles on the public streets in the places and in the numbers as they shall determine to be of the greatest benefit and convenience to the public, and every bus stop, bus stand, taxicab stand, or other stand shall be designated by appropriate signs. (Ord. 80-OR-6, passed 5-5-80) Stopping, Staz~ling, and Perking 15 § 72'13 COMMERCIAL VEHICLES~ (A) No commercial vehicles which are of such a height or length to effectively block the line of sight of individuals entering or traversing city streets in areas zoned Single Family Residence, R-l, or Multi-Family Residence, R-2, shall be allowed to be parked in the front yards of residences. (B) For the purpose of this section, .FRONT Y. AP, D shall be defined as provided in § 156.03. (Ord. 86-OR-6, passed 2-15-86; Am. Ord. 86-OR-14, passed 4-7-86) Penalty, see § 72.99 § 72.14 PAI~KING IN CUL-DE-SACS. Individuals may park motor vehicles, provided the presence of said vehicles is not prohibited by the city code or any ordinance passed subsequent to the passage of the city code, by pulling perpendicular to the curb on any cul-de-sac within the city limits. (Ord. 86-OR-9, passed 3-15-86) § 72.18 RESIDENT Olay PARKING (A) The Board of Public Works shall establish an annual un/form fee which shall be required for each resident only parking space. This fee may be waived upon a majority vote of the Board of Public Works in cases of hardship. (B) Any resident only parking area which has previously been designated by the Board within the previous 12 months of the passage of this section shall, without additional fee, automatically be established as resident only parking area. All other resident only parking areas may be renewed only upon written or personal application to the Board and upon payment of the aforesaid fee. (C) A resident only parking area shall be 20 feet in length and shall be marked by a sign and paint marks on the curbing or street at each end of the resident only parking space placed by the city Street Department. (Ord. 92-OR~22, passed 3-16-92) Penalty, see § 72.99 P~EING 1Wh-~'r~ ZONES § 72.28 PAI~9'G M~'rJ~,K DIVISION. The Parking Meter Di-v'ision Personnel be and hereby is placed under the direct control of the Clerk- Treasurer of the city. (Ord. 83-OR-49, passed 12-5-83) § 72.26 AUTHORITY OF CITY TO INSTALL. (A) The Board of Public Works and Safety is hereby authorized to install or place parking meters in all parking meter zones and to provide for the rental, purchase, acquisition, installation, regulation, 16 Jef~emo~ - Tram~ Code operation, maintenance, repair, servicing, and replacement of all parking meters. The Board of Public Works and Safety is further authorized to designate the size of each parking meter zone, to determine in which parts of parking meter zones parking meters shall be insialled, to determine the type of meters to be installed, and the respective charges to be made by the meters in each zone. ('77 Code, § 11-33) (B) The Board of Public Works and Safety is hereby authorized to enter into written contracts as may be necessary to carry out the provisions of this subehapter and provide payment therefor, exclus/vely from the funds received and revenues obtained from the operation and use of parking meters, without in any way obligating the city to pay for the same from funds derived from any other source. ('77 Cede, § 11-35) (C) In purchasing parking meters, the Clerk-Treasurer shall advertise for bids as now provided by statute for ether purchases by the city, and the purchases shall be made from the lowest and best bidder. ('77 Code, § 11-36) (D) All parking meters erected pursuant to this subchapter shall be equipped with a timing device which, when activated by an appropriate coin of the United States, measures the amount of parking time allowed by the coin and indicates by a sign whether the time has expired. ('77 Code, § 11-43) (Ord. 1583, passed 8-6-62) Parkfng meter zones, see Ch. 75 $ch. II § 7~.~7 AUTHOKITY TO EXEh~T KESIDENTS FROM PARKING M~'£~ ZONES. The Board of Public Works and Safety is hereby authorized to issue windshield stickers to individuals who live in the areas in which parking meters are installed entitling them to park, free of charge, on either side of the street within the block in which they reside. ('77 Code, § 11-34) (Ord. 1583, passed 8-6-62) § ?~..~8 AUTHOPdTF TO SUSPEND ENFORGEMENT. The Board of Public Works and Safety is hereby authorized, in its discretion, to suspend the operation of any parking meter in order to further a general, planned business promotion. ('77 Code, § 1.1-38) (Ord. 1583, passed 8-6-62) § 72.29 PARKIN(~ METJ:~ RATES; SLUGS (A) When any vehicle is parked in any space alongside or next to which there is located a parking meter, as provided for in this section, the owner, operator, manager, or driver of the vehicle shall immediately deposit in the parking meter the appropriate coin of the United States and set in operation the parking meter for that parking zone. The parking meter zone may only then be lawfully occupied by the vehicle during the time paid for. ('77 Code, § 11-39) (B) h shall be unlawful to deposit or cause to be deposited in any parking meter a slug, device, or metallic substitute for a coin of the United States. ('77 Code, § 11-41) (Ord. 1583, passed 8-6-62) Stopp g, St nd , and P ing 17 (C) Parldng meters shall be set to make the following charges for designated periods of time: $.05 for 12 minutes; .10 for 24 minutes; .9.5 for 1 hour; Ltl'nit - 2 hour parking. (Ord. 80-OR-81, passed 11-3-80) § 7~.30 OVERTIME PARI~NG PROHIB~r.~. It shall be unlawful for any person to cause, allow, permit or suffer any vehicle of which he is the operator or the registered owner to be parked overtime in any parking meter zone. A vehicle shall be considered to be parked overtime when it has remained in a zone for longer than the time allowed by the appropriate parking meter and the meter displays a sign showing unlawful parking. ('77 Code, § 11-40) (Ord. 1583, passed 8-6-62) § 7~.$1 MAITh~;~ OF PAlinG IN SPACE. Any vehicle which is parked in any parking space in any parking meter zone established pursuant to this section shall be parked with the hood of the vehicle alongside of or next to the parking meter adjacent to the parking zone. In the event the parking meter zone is marked for diagonal parking, then the vehicle shall be directed toward the parking meter. Any vehicle parking with/n a parking meter space shall be parked completely within the lines indicating the boundaries of the space. ('77 Code, § 11-42) (Ord. 1583, passed 8-6-62) § 72.32 AUTHORITY OF POLICE TO ENFORCE; REMOVAL OF ILLEGALLY PARKED VEHICLE. (A) It shall be the duty of each traffic patrolman and all other police officers that are so directed by the Chief of Police to take the number of each vehicle which is parked in violation of this section and report them to the Police Department. ('77 Code, § 11-37) (B) Any violator who is found to have received five violations which are unpaid shall have his vehicle towed-in and shall pay the towing charge and flues for violations prior to redemption of vehicle. (Ord. 80-OR-51, passed 11-3-80) § ?~..33 COrreCTION, USE OF REVENUES. (A) The Clerk-Treasurer shall collect the money derived from the operation of all parking meters. He may deputize persons to perform these duties and if the persons are appointed, they shall take an oath to faithfully perform these duties as such deputy and they shall each give bond in the sum of $5,000, payable to the city to guarantee the faithful performance of their duties and give a full accounting of all monies they receive from the use of the parking meters. The bond or bonds shall be approved by the Clerk-Treasurer and f'l~ed in his office. The premium on each bond shall be paid out of the traffic fund. ('77 Code, § 11-45) 18 Je en w ie - Code (B) Subject to any valid contractual obligation or covenant entered into prior to January 1, 1966, all parking meter fees that are collected from the mechanical parking devices, shall be used for: (1) Payment of the purchase price, rental fees, and cost of installation of the mechanical parking devices. (2) Payment of the cost of maintenance, operation, repair, and all other incidental costs and expenses in the operation of the mechanical parking devices, including the cost of clerk and bookkeeping. (3) Payment of the cost of traffic-signal devices used in the city and also repair and maintenance of any of the public streets, including curbs and sidewalks, and highways where the mechanical parking devices are in use, and all streets connected therewith. (4) Acquiring by lease or purchase suitable land for off-street parking facilities and for the payment of the principal and interest on bonds issued to acquire parking facilities and devices, the improvement and maintenance of land for parking purposes, and for the purchase, installation and maintenance of mechanical parking devices on the land. (5) Payment of the costs of purchase, maintenance, operation, repair, and all other incidental costs of providing approved school crossing protective facilities. (A) The Board of Public Works and Safety is hereby authorized to create loading zones within the parking meter zones established by this section. These loading zones may be established only where a retail or wholesale business has no access to back street or alley parking. ('77 Code, § 11-54) (B) The Board of Public Works and Safety is hereby authorized to abolish a loading zone at any time for any cause which, in the exercise of its discretion, is deemed to be su~cient. ('77 Code, § 11-55) (B) If the Board of Public Works and Safety grants the application of any person for the establishment of a loading zone the applicant shall pay an annual fee for the use of the zone as may be established by the Board. (A) For the purpose of this section the following definitions shall apply unless the context clearly indicates er requires a dJ.fferent meaning. PARKING.FACILITY. Any facility or combination of facilities for motor vehicle parking which contains parking spaces for the public. This shall include a privately owned area which is nornmlly used for parking and which is accessible to the public. Any person who has been issued a placard or special registration plate or decal for a motor vehicle by the Bureau of Motor Vehicles under IC 9-7-4.1-1 or §§ 72.60 and 72.61. (B) it shallbe unlawful for any person to park a motor vehicle, motorcycle, moped, bicycle, °r °ther vehicle of any nature which does not have displayed a handicapped person's decal or registration plate as set forth above in a parking space reserved in a parking facility for a handicapped person's vehicle. (C) If any vehicle is parked unlawfully in violation of any of the provisious of this subchapter and the identity of the driver cannot be determined, the owner or person in whose name the vehicle is registered shall be held prima facie responsible for the violatior!. (D) In addition to any fines which may be given as a result of violations of this subchapter, any vehicle which is parked in a manner in violation of this subchapter may be towed to an area designated by the Chief of Police of the city at the owner's expense. The owner shall also be required to pay any and all storage fees resulting from this action. (A) Whenever any police officer finds a vehicle standing upon a highway in violation of any of the provisions of this subchapter, the officer is hereby authorized to require the driver or other person in charge of the vehicle to move the same to a position off the paved or improved or main-traveled part of the highway, provided that if any person so directed shall fail or refuse to move the vehicle or if the vehicle is unattended then the officer is hereby authorized to provide for the removal of the vehicle to the nearest available garage or other place of safety. (B) Whenever any police officer finds a vehicle unattended upon any bridge or causeway or in any tunnel where the vehicle constitutes an obstruction to traffic, the officer is hereby authorized to provide for the removal of the vehicle to the nearest available garage or other place of safety. ('77 Code, § 11-14) (C) In the event any vehicle is found to be double parked on a street or alley, the vehicle may be towed to the Police Department by a towing service called by the parking meter officer or any member of the Police Department, with the expense of the towing being paid by the owner of the vehicle. (A) Any person who obtains a parking meter violation ticket shall, if the ticket is turned in at the police station within 24 hours after the violation, be allowed to pay the sum of $.25 in satisfaction of the violation. (1) Except as provided in division (A) above, any person who obtains a parking meter violation ticket, and who with/.n 10 days of the violation charged in the t{cket presents the same at the police station, shall be allowed to pay the sum of $1 in satisfaction of the violation. (1) The Judge of the Jeffersonville City Court shail be authorized to establish a Traffic Violations Bureau to receive payment of penalties. Payment of penalties shall be made to the Clerk of the Jeffersonville City Court at the City Court Clerk's Office. (2) Any person receiving a citation as the result of a violation of any of the provisions of this chapter shall pay an assessment of $15 (except as hereinafter provided) if paid within 72 hours of the time of the violation to the Clerk-Treasurer or to the officer in charge at the Jeffersonville Police Headquarters at the City-County Building, 519 East Court Avenue, Jeffersonville, Indiana. The owner of the vehicle or the person fit whose name the vehicle is registered shall be held prima facie responsible for violations of this chapter, and as a result thereof shall pay any tow-in charges and fines for violations prior to the redemption of any such vehicle. (D) The Board of Public Works and Safety is hereby authorized, in its discretion, to suspend the operation of the two hour only perking zones in order to further a' general, planned business promotion or other special activity. (E) It shall be unlawful for any person to cause, allow, permit or suffer any vehicle of which he is the operator or the registered owner to be parked for more than the designated maximum period in one of the aforementioned parking zones. Avehicle shall be considered to be parked overtime when it has remained in the zone for longer than the maximum permissible time during the following periods: Monday through Friday from 9:00 a.m. until 5:00 p.m., provided, however, that unlimited parking shall be permitted on all legal holidays. 48 Je~e~onville - ~ Code (I~) A person who violates this schedule shall pay a fine in the amount of $5. However, if the fine is not paid within 48 hours of the violation then the fine shall be $15. Each consecutive designated period of time that a vehicle is not moved shall constiute a separate offense. (G) h shall be the duty of each traffic patrolman and all of c/ther employees of the city that are so directed by the Mayor to take the number of each vehicle which is parked in violation of this schedule and report them to the Police Department. (H) Any violator who has found to have received five violations which are unpaid shall have his vehicle towed-in and shall pay the towing charge and fines for violations prior to redemption of h/s vehicle.
