ORDINANCE 2017-OR-a
AN ORDINANCE AMENDING THE CITY OF JEFFERSONVILLE 2035
COMPREHENSIVE PLAN WHICH UPDATES THE FUTURE LAND USE MAP
Whereas, Jeffersonville Department of Planning and Zoning filed a petition before
the Jeffersonville Plan Commission to amend the City of Jeffersonville 2035 Comprehensive
Plan as recommended in the staff report(a copy of which is attached as Exhibit "A"; and,
Whereas, on April 25, 2017 the Jeffersonville Plan Commission has certified its
favorable recommendation of the enactment of this proposed zoning ordinance amendment by
ordinance of this Common Council; and,
Whereas, this matter is now before the Common Council at its regular meeting after
certification of the proposed change of zoning map designation pursuant to the provisions of I.C.
36-7-4-608(f)(1); and,
Whereas, this Common Council has timely posted notice of its intent to consider the
proposed change of zoning map designation at the regular meeting scheduled for May 1, 2017;
and,
Whereas, all interested persons having been given an opportunity to appear before this
Common Council and be heard regarding this matter as required by law.
Now, THEREFORE, BE IT ORDAINED by the Common Council of the City of
Jeffersonville, Indiana, that the City of Jeffersonville 2035 Comprehensive Plan is hereby
amended to update the Future Land Use Map as recommended in the staff report (a copy of
which is attached as Exhibit "A".
IT IS FURTHER ORDAINED that the City of Jeffersonville 2035 Comprehensive Plan
shall be amended to include such change.
This ordinance shall be in full force and effect upon its adoption.

Proposed Changes to the Comprehensive Plan Map
The Planning & Zoning Department has recommended the following amendment
to the City of Jeffersonville 2035 Comprehensive Plan which updates the Future
Land Use Map.
The update includes:
1. Transitioned all agricultural land to residential for future housing needs.
(Preserved legacy farmland as open space.)
2. Transitioned the flood plain at Silver Creek to open space.
3. Changes made based upon new infrastructure improvements (e.g. 1-265).
4. A new category called Mixed Residential.
a. The new future land use category of Mixed Residential allows land
to be used for single family development, but could also be
appropriate for multi-family development.
The full list of changes can be found in Exhibit B.
Proposed Changes to the Comprehensive Plan Definitions
The definition for Agriculture is proposed to be removed. The definition for the
Recreation/Open Space is proposed to be replaced with the following text which
blends the definition for the removed Agriculture designation.
Open Space, Recreation and Agriculture
These areas are reserved for the provision of outdoor recreational amenities
and/or the preservation of existing landscapes. Open space areas may consist of
heavily wooded, swampy, or otherwise environmentally sensitive areas. They
may also exist to preserve undeveloped floodplain and/or existing agricultural
uses. These open spaces promote healthy recreation, provide an escape from
urban landscapes and serve as a connection to our community's history. Open
spaces may also provide natural services, such as drainage control and air
quality improvements. As such, open spaces tend to increase property values
within the city. Open space may be intended for public use, especially as parks
with trails, playing fields, and other recreational spaces. Sometimes, however,
they may consist of a privately owned facility that may or may not be publicly
accessible. Additional uses that fall into this category include cemeteries, sport
facilities, urban parks/plazas and event facilities.

CERTIFICATION OF FAVORABLE RECOMMENDATION OF PROPOSED
ORDINANCE
Whereas, the Jeffersonville Department of Planning &Zoning filed a petition before the
Jeffersonville Plan Commission to amend the Jeffersonville Comprehensive Plan (2015-OR-58)
to revise the Future Land Use Map on page 35 as recommended in the staff report (a copy of
which is attached as Exhibit"A"); and,
Whereas, after proper notice by publication, the Jeffersonville Plan Commission held a
public hearing on the petition on April 25, 2017; and,
Whereas, at the conclusion of the hearing the Jeffersonville Plan Commission voted by a
majority vote of its entire membership to Favorably Recommend the proposed amendment to the
Jeffersonville Common Council.
IT IS THEREFORE CERTIFIED that on April 25, 2017, the Jeffersonville Plan
Commission favorably recommends that the Jeffersonville Common Council enact by ordinance
the proposed Jeffersonville Comprehensive Plan Amendment as requested in the petition of
Jeffersonville Department of Planning&Zoning.

Notice is hereby given that the Jeffersonville Plan Commission has filed
Ordinance with the Jeffersonville City Council, Jeffersonville, Indiana asking for an
Amendment of the City of Jeffersonville 2035 Comprehensive Plan which updates the
Future Land Use Map as recommended by the Plan Commission in the staff report (a
copy of which is attached as Exhibit"A".
A public hearing will be held on May 1, 2017 at 7:00 p.m. in the City Council
Chambers, 1st floor, City Hall, 500 Quartermaster Court, Room 101, Jeffersonville,
Indiana at which time and place all interested persons will be heard in reference to the
matters set out in said ordinance.
