HomeMy WebLinkAbout2016-OR-86 ORDINANCE NO. 2016-OR- AN ORDINANCE ESTABLISHING THE JEFFERSONVILLE PUBLIC ARTS COMMISSION AND REPEALING AND REPLACING PRIOR PUBLIC ART COMMITTEE RESOLUTIONS WHEREAS, the Common Council for the City of Jeffersonville, Clark County Indiana (hereinafter the "Council"), as the City's statutory Fiscal and Legislative Bodies. WHEREAS, Council desires to repeal and replace the prior Resolutions concerning the Jeffersonville Public Art Committee and to establish the Jeffersonville Public Arts Commission pursuant to the following terms and provisions: (A) Public Policy and Purpose. The City of Jeffersonville recognizes that the arts are an important part of the culture and economy of the community, and that the City has a responsibility to foster an environment conducive to the community's participation in the arts. The conservation and development of the City's artistic resources are essential to the social, educational, and economic growth of the city. Artists, works of art, and artistic institutions contribute to the quality of life and the general welfare of the citizens of Jeffersonville. Consistent with this public policy and purpose, the City has designated and certified the Jeffersonville Arts and Cultural District, and the Jeffersonville Public Arts Commission will oversee public art projects within the Arts and Cultural District and throughout the City. (B) Definitions. As used in this section unless the context clearly requires otherwise: (1) "Commission" means the Jeffersonville Public Arts Commission as created by this ordinance. (2) "Public art project" means an original work of high quality art of any medium, which is created by an artist or artists, which belongs and is accessible to the public. (C) Appointments. The Commission shall consist of nine (9) members. Five (5) members of the Commission shall be appointed by the Common Council, and one (1) of the Common Council's appointments shall be a sitting member of the Common Council. Four (4) members of the Commission shall be appointed by the Mayor. (D) Qualifications. All members of the Commission shall have a demonstrated commitment to the arts. To the extent possible, priority shall be given first to I ensuring a broad representation of professional artists from the disciplines of the visual, performing and literary arts and then to arts administrators and arts consumers and to representatives from the education and business communities. (E) Terms. Members shall serve terms of three (3) years. Members having served two consecutive three-year terms may not be reappointed until one year has passed from the end of the second term. Terms shall be staggered, with three members' first term ending within one year; three members' first term ending within two years, and three members' first term ending within three years after their initial appointment, so that no more than three members will leave the commission at the end of each term, which will be the thirty-first day of January. (F) Powers and Duties. The Commission's powers and duties include, but are not limited to, the following: (1) Develop and present to the City a public art plan, which is a list of potential public art projects to be coordinated by the Commission and produced as a collaborative effort by the City and/or other civic entities; (2) Develop and administer programs to achieve the Commission's purpose; (3) Inform the Common Council, City administration, and City boards and commissions on current arts issues, and offer policy recommendations and advice,- (4) dvice;(4) Review, consider and determine the creation and placement of public art on all City-owned property: (5) That the determination of the creation and placement of public art on city-owned property shall be subject to the approval of the appropriate city board, city commission, or other city entity that has legal ownership or other legal control and/or legal responsibility over the particular city-owned property on which a proposed public art item shall be located. (6) That if the determination of the creation and location of public art involves the expenditure of any city funds, then the said determination shall also be subject to the approval of the Common Council as the fiscal body for the City. (7) Adopt administrative rules and regulations, adopt procedures, conduct activities and form committees, as necessary to conduct the Commission's business. 2 ao i -O R 96 NOW, THEREFORE, BE IT ORDAINED: 1. That the Jeffersonville Public Arts Commission is hereby established pursuant to the terms and provisions as set forth in this ordinance, and that all prior Resolutions concerning the Jeffersonville Public Art Committee are hereby repealed replaced by this ordinance. 2. That this Ordinance shall be effective immediately upon passage and adoption.
