HomeMy WebLinkAbout12-02-1991COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE INDIANA DECEMBER 2, 1991 The Common Council of the City of Jeffersonville met in regular session in. Council Chambers in the City-Co ~nty Building~ Jeffersonville, Indiana, at 7:~0 P.M. on the 2nd day of December~ 1891. The meeting was called to order bM Mayor Dale L. Cram with Deputy Clerk Barbara Nollis at the desk. Mayor Cram asked all those present to stand as the mnvo~atmon was given by Reverend Kay McFar!and~, Community Christian Church. He then asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were Councmiperson Jimmy Carter, Marie Clapp, Ron Grooms~ John Perkins~ Andrew Wzllzam~ and Robert Waiz. Absent: Councilperson Tony Harrod. Mayor Cram presented, the minutes of the meeting of November 23~ 1991 for consideration by the Council. Councilperson Perkins made the motion to approve th~ minutes as presented seconded by Councilperson Grooms and carried unanimously, Deputy Clerk Nollis presented the claim register with one additional claim. Following all discussion oouncllperso Williams made the motion to approve the Claims as presented along with the additional claim~ seconded by Coun~ilperson Waiz~ and carried unanimously~ Mayor Cram introduced Mr. David MosleM, Attorney for the Town of Utica. Mr. Moslem reviewed those points made at the previous Council meeting concerning the request for permission from Jeffersonville for the Town of Utica to annex certain areas. Councilperson Perkins asked questions regarding litigation and remonstrance. Mr. Moslem stated he feels all necessary requirements have been met. i~b is Mr. Moslem~s belief that approximately $0% of the residents have signed a petition in favor of annexation~ Councilperson Grooms asked questions regarding tile benefit. Mr. Moslem does not believe there is one with regard to sewers. A member of the audience inquired how the ']['own of Utica can use - ~=.~ of Utica, Mr. Moslem recommended he contact Mr. grant money <~u ...... de Mark Smith of River Hills, Council President Carter asked this member PAGE 2 DECEMBER 2, 1991 of the audience if he had signed the petition in favor of the annexation. He explained he had not, but that his tax rate would be $3.00 higher and he would gain nothing. Councilperson Perkins then stated the only question Jeffersonville had to answer was if they had designs to annex this property to which the answer is no. He does believe Utica has serious legal problems. Attorney Filer recommended that if it is the Council's desire to give consent that it be "time certain". At the conclusion of all discussion, Councilperson Grooms made the motion to pass Resolution No. 91-R-36 giving permission to annex Areas A, B, C, and D by December 31, 1991 or the permission be rescinded as Jeffersonville does not object~ and is not interested~ seconded by Council President Carter and carried unanimously. Council President Carter introduced Ordinance No. 91-OR-66~ An Ordinance Amending Ordinance No. 86-OR-54~ An Ordinance Relating To The Control of Noise, for the third, reading. Council President Carter made the motion to pass Ordinance No. 91-OR-88 on the third and final reading, seconded by Councilperson Waiz, and opened for discussion. Councilperson Grooms feels the 7:00 P.M. restriction will be too hard to enforce and he would feel more comfortable with 9:00 P~M. Mr. Kenny Williams stated his problems and enforced the 7:00 P~M. restriction. Councilperson Perkins feels the time should not matter if the noise reaches certain levels. Mayor Orem feels this may not help as the pro~blem may be more of a reverberation problem as opposed to a decible problem. Neighbors in a certain area could not hear their television over the music as far a 250 feet away. The question was raised if a band for hire (commercial?) could practice in a residential area. Councilperson Williams inquired if there was another nuisance Ordinance in effect that would allow this certain problem to be solved. Following ail discussion the vote was taken with Ordinance No. 9I-OR-66 passing on the third reading on a vote of 5-1 with Councilperson Williams voting in opposition. Council President Carter suggests the new Council look into purchasing new noise measuring equipment~ Police Chief ~odden stated there is a State Law that allows for the arrest for disorderly conduct if there is not quiet following being asked. PAGE S DECEMBER 2~ 1991 Resolution Accepting the Statement of Benefits for additional equipment at Ashley Lithographing and Company, Inc.~ Councilperson Perkins stating this is a nice addition to Jeffersonvitle made the motion to pass Resolution No. 91-R-37 and accept the Statement of Benefits for Ashley Lithographing and Company Inc., for 5 years, seconded by Couneilperson Clapp. There followed discussion regarding the fellow up on the number of employees hired. Attorney Filer informed the Council there will be required forms to file in. t[he future and if the statements are not followed the abetment can be revoked~ Resolution No. 91-R-S7~ and the Statement of Benefits passed on a vote of 6-0. Council President Carter introduced Ordinance No. 9!-OR-67, A Health Care Benefit Ordinance For Retired City Employees And/Or City Elected Officials. Following discussion, Council President Carter made th motion to suspend the rules for Ordinance No~ 91-OR-~7, seconded by Councilperson Perkins, passing unanimously. Council President Carter then made the motion to pass Ordinance No. 91-OR-67 readings, seconded by Councilperson Waiz, passing on the call vote: Ayes: Councilperson Grooms, on. all three following roll Carter Wililams, Clapp~ Waiz~ and Perkins. Ordinance Councilperson Caldwell and Nays: None. Councilperson Transferring Grooms has informed the Grooms introduced Ordinance No. 91-OR-64~ An Certain Funds Within Same Department. discussed this with Park Superintendent Council of the conversation. Following all discussion~ Councilperson Perkins made the motion to suspend the rules for Ordinance No. 91-OR-64, seconded by Council President Carter and carried unanimously. Councilperson Perkins then made-the motion to pass Ordinance No. 91-0R-64 on all three readings, providing the money be used to pay for the truck and only if it is found the truck is paid for may the money be used for playground equipment, seconded by Council President Garter, passing on the following roll call vote: Ayes: Councilper~ons Perkins, Waiz, Clapp, Williams, Carter and Grooms. Nays: None. PAGE 4 DECEMBER 2, 1991 Couneilperson Grooms introduced Ordinance No. 9t-0R-83~ An. Ordinance Amending Certain Por'tions Of Section I Of Ordinance No. 90-0R-37. Following all discussion, and. answering of questions bM Park Superintendent Caldwell, Counci!person Grooms made the motion to suspend the rules for Ordinance No. 91-OR-63, seconded by Couneilperson Clapp and carried unanimously. Couneilperson Grooms then made the motion to pass Ordinance No. 91-OR-63 on all three readings~ seconded by Couneilperson Clapp, passing on the following roll call vote: Ayes: Councilpersons Grooms, Carter, Williams, Clapp~ Waiz, and Perkins. Nays: None. Councilperson Grooms read a letter addressed to the Parks Board requesting Ingramville Park be renamed to Harlan Voght Park. Councilperson Grooms feels this would be a nice gesture. Park Superintendent Caldwell stated the Park Board has met with the Voght Family and considers%ion is being made to rename the Park Place Median Park, Councilperson Perkins inquired who will be paying the electric bill for the lights at Preservation Park~ He does feet either the City or the Parks Department should pay this. Park Superintendent Caldwell stated that Jeff-Clark Preservation has been a friend of the Parks and the lights are a beautiful addition. He feels the Park Board will agree to take over this bill, Councilperson Perkins suggests if the Park Board has objections, the City should pay. The Council does recommend the Park Department pay the bill. Mayor Orem commented on the official lighting o£ the Clark Memorial Bridge. He urges all to see the bridge and monumental lighting taking notice to the sculpture work on the monuments. These electric bills will be paid for by Louisville and Louisville Gas and Electric Company with the exception of the monument lights on the Indiana side. The need for another bridge was discussed and the current problems w~th one lane of the Sherman Minton Bridge being closed. Council President Carter reintroduced Ordinance No. An Ordinance Amending Certain Portions Of Section 1 Of Ordinance No. 90-OR-37, It is felt additional money for 1992 should be addressed by the new Council. Following all discussion, Council President Carter PAGE 5 DECEHBER 2, made the motion to untable Ordinance Councilperson Weis, passing un. animouslM~ made the motion to suspend the rules seconded by Councilperson Grooms and 1991 Not 91-OR-62, seconded by Council President Carter then for Ordinance No. 91-OR-82, carried unanimously. Council President Carter then made the motion to pass Ordinance No. 91-OR-82 on all three readings, providing proof is received Agent of Record Cooper paid $750, seconded by Councilperson Perkins, passing on the following roll call vote: Ayes: and Perkins. Nays: Councllperson Grooms~ Carter, Witliams~ Clapp, Weis, December 11, all those in held Sunday. None. Councilperson Grooms announced and encourages attendance at a Bridge Study Committee Meeting to be held at Jeffersonville High School, 1991, at 7:00 o~clock P.M. He also reminds the Council and attendance of the Jeff-Clark Preservation Home Tour to be Councllper~,on Perkins requests Police Chief Rodden get quotas on a decible meter, and how much it would cost.to have an officer obtain certmfmca~,lon. Council President Carter reminded the meeting for this Council will be December 21, i991~ Council the final A Mayor Orem asked Mr. Roll. Mn Blankenbeker if he had any comments. Mr. B!ankenbeker stated if the Utica annexation is successful the Jeffersonville 2-~ile Fringe and [3tics Area A will be a common line. Counciiperson Perkins made the motion to approve all claims and transfers necessary ±.o close the books for the year, seconded bM Councilperson Williams and carried unanimously. There being no further business to come before the Council~ Councilperson Perkins made the motion to adjourn at 9:15 o'clock seconded 'by Council President Carter and carried unanimously. ATTEST
