RESOLUTION AMENDING A DECLARATORY RESOLUTION OF THE
JEFFERSONVILLE REDEVELOPMENT COMMISSION ENTITLED
"DECLARATORY RESOLUTION OF THE JEFFERSONVILLE
REDEVELOPMENT COMMISSION"
WHEREAS, the City of Jeffersonville ("City") Redevelopment Commission
("Commission") adopted a declaratory resolution on December 22, 1995, as supplemented and
amended to date (collectively, as supplemented and amended to date, "Original Declaratory
Resolution"), establishing the Inner City Road Economic Development Area ("Area"), and the
Original Declaratory Resolution was confirmed by a Confirmatory Resolution adopted on
February 28, 1996 ("Confirmatory Resolution");
WHEREAS, the Original Declaratory Resolution and the Confirmatory Resolution are
hereinafter collectively referred to as the "Area Resolution";
WHEREAS, the Area Resolution established an allocation area in accordance with IC 36-
7-14-39 ("Allocation Area"), for the purpose of capturing property taxes generated from the
incremental assessed value of real and depreciable personal property located in the Allocation
Area;
WHEREAS, the Area Resolution approved the Economic Development Plan ("Original
Plan") which Original Plan contained specific recommendations for economic development in
the Area;
WHEREAS, the Common Council approved the creation of the Area;
WHEREAS, the Commission now desires to amend the Original Declaratory Resolution
and the Original Plan to add the construction of certain road improvements described on
Exhibit A hereto, all in, serving or benefitting the Area (collectively, "Projects") to the list of
Projects in the Original Plan("2016 Plan");
WHEREAS, IC 36-7-14-17.5 authorizes the Commission to amend the Area Resolution
and Original Plan, after conducting a public hearing, if it finds that:
(i) The amendment is reasonable and appropriate when considered in relation
to the Area Resolution, the Original Plan and the purposes of IC 36-7-14;
and
(ii) The Area Resolution, with the proposed amendment and application of
Original Plan, conforms to the comprehensive plan for the City; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF JEFFERSONVILLE
REDEVELOPMENT COMMISSION THAT:

I. The Area Resolution and the Original Plan are hereby amended to include the
Projects. The Commission finds that the Projects will further the Original Plan and that the
Projects will be located in, serve or benefit the Area; therefore, it will be of public utility and
benefit to amend the Area Resolution and the Original Plan to include the Projects. The
Commission further finds that the public health and welfare will be benefited by the amendment
to the Area Resolution and Original Plan and the implementation of the 2016 Plan.
2. The Commission now finds and determines, after consideration of the evidence
presented, that the amendment described in Section 1 above is reasonable and appropriate when
considered in relation to the Area Resolution, the Original Plan and the economic development
purposes set forth in IC 36-7-14-14 and, that the proposed amendment conforms to the
comprehensive plan for the City.
3. The presiding officer of the Commission is hereby authorized and directed to
submit this resolution to the Jeffersonville Plan Commission ("Plan Commission") for its
approval.
4. The Commission further directs the presiding officer to submit this resolution to
the Common Council for its approval of the amendment to the Area Resolution and the 2016
Plan.
5. The Commission also directs the presiding officer, after receipt of the written
order of approval of the Plan Commission which has been approved by the Common Council, to
publish notice of the adoption and substance of this resolution in accordance with IC 5-3-1-4 and
to file notice with the Plan Commission, the Board of Zoning Appeals, the building
commissioner and any other departments or agencies of the City concerned with unit planning,
zoning variances, land use or the issuance of building permits. The notice must state that maps
and plats have been prepared and can be inspected at the office of the City's department of
redevelopment and must establish a date when the Commission will receive and hear
remonstrances and objections from persons interested in or affected by the proceedings
pertaining to the proposed amendments and will determine the public utility and benefit of the
proposed amendments.
6. The Commission hereby finds that the estimated costs of the Projects is
approximately $29,950,000.
7. The Commission hereby finds that all property in the Area will positively benefit
from the Project due to enhanced infrastructure such as roads, sidewalks, lighting, signage, and
similar improvements in the Area.
8. In all other respects, the Area Resolution, the Original Plan and actions of the
Commission consistent with this resolution are hereby ratified and confirmed.
9. This resolution shall be effective upon passage.

EXHIBIT A
Project Description and Estimated Costs
10th Street Widening—Penn Street to Reeds Lane
The project will reconstruct and widen 10th Street from 4 to 5 lanes(5th lane will be a center turn lane)
from Dutch Lane/Penn Street to Reeds Lane. It will include the upgrading of turn lanes and signals at
the currently-signalized intersections,and will add sidewalks on each side of the road along the entire
corridor.
Estimated Cost: $16,800,000
10th Street North Reconstruction—Allison Lane to 1-265
The proposed work for overall project consists of installing storm sewers, curb inlets, and yard inlets
along both pavement edges(and not along the roadside ditches to minimize underground utility
relocation), curb and gutter along exterior pavement edges and median curb and gutter along interior
island edges, asphalt overlay of the existing pavement sloped toward the exterior gutters, sidewalks,
fencing, landscaping, three (3) new traffic signals and modernization of three (3)existing signals.
