RESOLUTION OF THE COMMON COUNCIL OF THE CITY
OF JEFFERSONVILLE APPROVING THE ORDER OF THE
JEFFERSONVILLE PLAN COMMISSION
WHEREAS, the Jeffersonville ("City") Redevelopment Commission ("Commission")
adopted a declaratory resolution on December 22, 1995, as supplemented and amended to date
(collectively, as supplemented and amended to date, "Declaratory Resolution"), establishing the
Inner City Road Economic Development Area ("Area"), and the Declaratory Resolution was
confirmed by a confirmatory resolution adopted on February 28, 1996, as amended to date
(collectively, "Confirmatory Resolution");
WHEREAS, the Declaratory Resolution and the Confirmatory Resolution are hereinafter
collectively referred to as the "Area Resolution";
WHEREAS, the Area Resolution established an allocation area in accordance with IC 36-
7-14-39 ("Allocation Area"), for the purpose of capturing property taxes generated from the
incremental assessed value of real and depreciable personal property located in the Allocation
Area;
WHEREAS, the Area Resolution approved the Economic Development Plan, as amended
("Original Plan") which Original Plan contained specific recommendations for economic
development in the Area;
WHEREAS, on January 27, 2016, the Commission adopted a resolution amending the
Declaratory Resolution ("Amending Declaratory Resolution No. 2016-R-1") and the Original
Plan to expand the Area and Allocation Area by adding certain real property to the Area and the
Allocation Area (collectively, "Expansion Area") as set forth on the map attached as Exhibit A-1
to Amending Declaratory Resolution No. 2016-R-1, the parcel list attached as Exhibit A-2 to
Amending Declaratory Resolution No. 2016-R-1 and to apply the Original Plan to the Expansion
Area;
WHEREAS, on July 27, 2016, the Commission adopted a resolution further amending
the Area Resolution and the Original Plan ("Resolution") to add the construction of certain road
improvements described on Exhibit A of the Resolution, all in, serving or benefitting the
Original Area and/or Expansion Area, to the list of projects in the Original Plan ("2016 Plan");
WHEREAS, the Jeffersonville Plan Commission ("Plan Commission") adopted orders on
March 22, 2016 and August 30, 2016 finding that the amendments to the Area Resolution and
Original Plan conform to the comprehensive plan of development for the City and approving
Amending Declaratory Resolution No. 2016-R-1, the Resolution and the 2016 Plan; and
WHEREAS, the Act requires approval of the action of the Plan Commission by the
Common Council of the City prior to the Commission holding a public hearing on the
amendment;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE
CITY OF JEFFERSONVILLE, INDIANA, THAT:
Section 1. The action of the Plan Commission on March 22, 2016 and August 30,
2016 conform to the comprehensive plan of the City and are hereby in all respects approved by
the Common Council.
Section 2. The Clerk is hereby directed to file a copy of Amending Declaratory
Resolution No. 2016-R-1, the Resolution, the 2016 Plan and the approving Orders of the Plan
Commission with the permanent minutes of this meeting.
Section 3. This resolution shall be effective from and after its passage and approval
of the Mayor.
PASSED AND ADOPTED by the Common Council of the Cit of Jeffersonville,
Indiana, this 6th day of September, 2016, by a vote of ayes and nays.

THAT A RESOLUTION AMENDING THE DECLARATORY RESOLUTION
APPROVED AND ADOPTED BY THE JEFFERSONVILLE
REDEVELOPMENT COMMISSION CONFORMS TO THE
COMPREHENSIVE PLAN AND APPROVING SAID RESOLUTION
WHEREAS, the Jeffersonville ("City") Redevelopment Commission ("Commission")

EXHIBIT A
Project Description and Estimated Costs
10th Street Widening—Penn Street to Reeds Lane
The project will reconstruct and widen 10th Street from 4 to 5 lanes (5th lane will be a center turn lane)
from Dutch Lane/Penn Street to Reeds Lane. It will include the upgrading of turn lanes and signals at
the currently-signalized intersections, and will add sidewalks on each side of the road along the entire
corridor.
Estimated Cost: $16,800,000
10th Street North Reconstruction—Allison Lane to 1-265
The proposed work for overall project consists of installing storm sewers, curb inlets, and yard inlets
along both pavement edges (and not along the roadside ditches to minimize underground utility
relocation),curb and gutter along exterior pavement edges and median curb and gutter along interior
island edges, asphalt overlay of the existing pavement sloped toward the exterior gutters,sidewalks,
fencing, landscaping,three (3) new traffic signals and modernization of three (3) existing signals.

RESOLUTION AMENDING A DECLARATORY RESOLUTION OF THE
JEFFERSONVILLE REDEVELOPMENT COMMISSION ENTITLED
,"DECLARATORY RESOLUTION OF THE JEFFERSONVILLE
REDEVELOPMENT COMMISSION"
WHEREAS, the City of Jeffersonville ("City") Redevelopment Commission
("Commission") adopted a declaratory resolution on December 22, 1995, as supplemented and
amended to date (collectively, as supplemented and amended to date, "Original Declaratory
Resolution"), establishing the Inner City Road Economic Development Area ("Original Area"),
and the Original Declaratory Resolution was confirmed by a Confirmatory Resolution adopted
on February 28, 1996 ("Confirmatory Resolution");
WHEREAS, the Original Declaratory Resolution and the Confirmatory Resolution are
hereinafter collectively referred to as the "Area Resolution";
WHEREAS,the Area Resolution established an allocation area in accordance with IC 36-
7-14-39 ("Original Allocation Area"), for the purpose of capturing property taxes generated from
the incremental assessed value of real and depreciable personal property located in the Original
Allocation Area;
WHEREAS, the Area Resolution approved the Economic Development Plan ("Original
Plan") which Original Plan contained specific recommendations for economic development in
the Original Area;
WHEREAS, the Common Council approved the creation of the Original Area;
WHEREAS, the Commission now desires to amend the Original Declaratory Resolution
to expand the Original Area and the Original Allocation Area by adding certain real property to
the Original Area and the Original Allocation Area (collectively, "Expansion Area") as set forth
on the map attached hereto as Exhibit A-1 the parcel list attached hereto as Exhibit A-2 and to
apply the Original Plan to the Expansion Area;
WHEREAS, IC 36-7-14-17.5 authorizes the Commission to amend the Area Resolution
and Original Plan, after conducting a public hearing, if it finds that:
(i) The amendment is reasonable and appropriate when considered in relation
to the Area Resolution, the Original Plan and the purposes of IC 36-7-14;
and
(ii) The Area Resolution, with the proposed amendment and application of
Original Plan, conforms to the comprehensive plan for the City; and

WHEREAS,the Commission has caused to be prepared a list of the owners of the various
parcels of property proposed to be acquired for, or otherwise affected by, the amendment of the
Area Resolution or the Original Plan for the Original Area as set forth on Exhibit B;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF JEFFERSONVILLE
REDEVELOPMENT COMMISSION THAT:
1. The Area Resolution is hereby amended to expand the Original Area and the
Original Allocation Area by adding certain real property to the Original Area and Original
Allocation Area ("Expansion Area") as set forth on the map attached hereto as Exhibit A-1 and
the parcel list attached hereto as Exhibit A-2.
2. The Commission finds, after consideration of the evidence presented, that the
public health and welfare will be benefited by the amendment to the Area Resolution to establish
the Expansion Area.
3. The Commission now finds and determines, after consideration of the evidence
presented, that the amendment described in Section 1 above is reasonable and appropriate when
considered in relation to the Area Resolution and the Original Plan and the proposed amendment
conforms to the comprehensive plan for the City.
4. The Commission hereby finds that no other parcels of property in the Area will be
affected by the expansion of the Original Area or the accomplishment of the Original Plan.
5. The Commission hereby finds that the amendment to the Area Resolution to
establish the Expansion Area will result in new property taxes that would not have been
generated without establishment of the Expansion Area and the application of the Original Plan
to the Expansion Area as set forth in the letter attached hereto as Exhibit C.
6. The Commission hereby finds that the property so described in Exhibit B is the
property that may be affected by the establishment of the Expansion Area.
7. The base assessment date for the Original Allocation shall remain March 1, 1995
and the base assessment date for the Expansion Area shall be January 1,2016.
8. This paragraph shall be considered the allocation provision for the Expansion
Area for the purposes of IC 36-7-14-39. The Expansion Area shall constitute an allocation area
as defined in IC 36-7-14-39 and shall become a part of the Original Allocation Area for all
purposes other than the base assessment date. Any property taxes levied on or after the effective
date of this resolution by or for the benefit of any public body entitled to a distribution of
property taxes on taxable property in the Expansion Area shall be allocated and distributed in
accordance with IC 36-7-14-39 or any applicable successor provision. This allocation provision
shall expire no later than 25 years after the date on which the first obligation is incurred to pay
principal and interest on bonds or lease rentals on leases payable from tax increment revenues
generated in the Expansion Area.

9. The presiding officer of the Commission is hereby authorized and directed to
submit this resolution to the Jeffersonville Plan Commission ("Plan Commission") for its
approval.
10. The Commission also directs the presiding officer, after receipt of the written
order of approval of the Plan Commission which has been approved by the Common Council, to
publish notice of the adoption and substance of this resolution in accordance with IC 5-3-1-4 and
to file notice with the Plan Commission, the Board of Zoning Appeals, the building
commissioner and any other departments or agencies of the City concerned with unit planning,
zoning variances, land use or the issuance of building permits. The notice must state that maps
and plats have been prepared and can be inspected at the office of the City's department of
redevelopment and must establish a date when the Commission will receive and hear
remonstrances and objections from persons interested in or affected by the proceedings
pertaining to the proposed amendments and will determine the public utility and benefit of the
proposed amendments. Copies of the notice must also be filed with the officer authorized to fix
budgets, tax rates and tax levies under IC 6-1.1-17-8 for each taxing unit that is either wholly or
partly located within the Expansion Area. Notice must also be mailed by first class mail to all
owners of property in the proposed Expansion Area.
11. The Commission also directs the presiding officer to prepare or cause to be
prepared a statement disclosing the impact of the expansion of the Original Area and the Original
Allocation Area, including the following:
(a) The estimated economic benefits and costs incurred by the Expansion
Area, as measured by increased employment and anticipated growth of real property,
personal property and inventory assessed values; and
(b) The anticipated impact on tax revenues of each taxing unit that is either
wholly or partly located within the Expansion Area.
A copy of this statement shall be filed with each such taxing unit with a copy of the
notice required under Section 17 of the Act at least 10 days before the date of the hearing
described in Section 10 of this resolution.
12. The Commission further directs the presiding officer to submit this resolution to
the Common Council for its approval of the amendment to the Area Resolution.
13. In all other respects, the Area Resolution, the Original Plan and actions of the
Commission consistent with this resolution are hereby ratified and confirmed.
14. This resolution shall be effective upon passage.
