HomeMy WebLinkAbout2016-OR-2 202313257 ORD $0.00 07/14/2023 11:01:26P 4 PGS Steve Gill Clark County Recorder IN Recorded as Presented ORDINANCE NO. 2016-OR- II II II II IIII III III II II •III ` t AN ORDINANCE VACATING PUBLIC RIGHT OF WAY WHEREAS, the Common Council for the City of Jeffersonville, Clark County Indiana (hereinafter the "Council"), is the City's statutory Legislative and Fiscal Body pursuant to Indiana Code 36-4-6 et seq.; WHEREAS, the Council has provided notice, pursuant to I.C. 36-7-3-12(c) and I.C. 5-3-1 et seq that it desires to vacate a certain public right of way, described as follows: Being a part of Robin Lane as shown on the Melwood Subdivision as recorded in Plat Book 6, Page 173, situated in the City of Jeffersonville, Clark County, Indiana being described as follows: Beginning at the most easterly corner of Lot 11 in said Melwood; thence along the southwesterly right-of-way line of Robin Lane, North 40 degrees West, 35 feet; thence at right angles, crossing said right-of-way, North 50 degrees East, 50 feet • to the northeasterly right-of-way line of Robin Lane; thence along said right-of-way line, South 40 degrees East, 30.90 feet to the most southerly corner of Lot 10 of said Melwood; thence along a line being the southeasterly terminus of said right-of-way, South 45 degrees 19 minutes West, 50.17 feet to the Beginning. Containing 1,648 square feet, being subject to all easements and right-of-ways. and depicted on Exhibit "A" which is attached hereto and incorporated herein (collectively, the "Vacation Area"); WHEREAS, the City of Jeffersonville Board of Public Works on November 3, 2010, voted unanimously to approve the vacation of the said "Vacation Area", as evidenced in the official minutes for the said board; WHEREAS, a public hearing on this matter has been held consistent with and pursuant to I.C. 36-7-3-12; WHEREAS, no remonstrance or objection to this matter has been filed by any party; NOW, THEREFORE, BE IT ORDAINED by the Common Council as follows: 1. The vacation of the proposed "Vacation Area" will not hinder the growth or orderly development of the unit or neighborhood in which the "Vacation Area" is located or to which the "Vacation Area" is contiguous and vacating the proposed "Vacation Area" does not make access to the lands of any person by means of public way difficult or inconvenient, and vacating the proposed "Vacation Area" does not hinder the public's access to a church, school, or other public building or place; 1 2. The said "Vacation Area" is hereby vacated, 3. This Ordinance shall be in full force and effect upon adoption.
