HomeMy WebLinkAboutJULY 20, 2015COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA JULY 20, 2015 The Common Council of the City of Jeffersonville, Indiana met in regular session in Room 101, 500 Quartermaster Court, Jeffersonville, Indiana at 7:01pm, on Monday, July 6, 2015. Council President Gill, with Vicki Conlin, City Clerk, called the meeting to order at 7:07pm. President Gill asked those in attendance to stand as Councilperson Samuels gave the Invocation with special attention to the recent tragedy in Chattanooga, TN. Council President Gill then led all those present in the Pledge of Allegiance to the Flag. The roll call and those present were: Councilperson Smith, Councilperson Zastawny, Councilperson Wadsworth, Councilperson Sellers, Councilperson Webb, Council President Gill, Councilperson Julius, Councilperson Owen, and Councilperson Samuel. MINUTES TO BE APPROVED: Councilperson Samuels made a motion to APPROVE the July 6, 2015, Council Regular Proceeding minute, with Councilperson Sellers seconding, PASSING on a vote of 9-0. APPROVAL OF THE AGENDA: Councilperson Sellers made a motion to APPROVE the agenda, with Councilperson Zastawny seconding, PASSING on a vote of 9-0. CLAIMS TO BE APPROVED: General Claims: Assistant Controller Heather Metcalf presented the general claims list in the amount of $656,311.84. Hand carried claim is for Vehicle maintenance. Council President Gill advised that the claim for Burns property maintenance for $25,000 needed to be pulled because it requires a contract. Councilperson Samuels stated it was his understanding that the new people doing the mowing would be taking care of the fire department as well however there are claims for the fire department in the claims being presented, he would like clarification on that. Gill made copies, no contract in place and the assistant chief is supposed to be taking care of that. Paul said that because of the other things they should be able to start mowing the fire department. Council President Gill stated the company mowing the Fire Department are firefighters and wanted to know if a conflict of interest needed to be filed? Council Attorney Mr. Lewis stated a Conflict of Interest did need to be filed. The claims are for $930 and $570 (one is for landscaping and one is for mowing). Councilperson Owen motioned to APPROVE with those 3 claims removed with the motion b on a vote 7- 0-2. Councilperson Webb and Councilperson Julius abstained from voting. REPORT OF THE CLERK: City Clerk Vicki Conlin did not have anything to report at this time. A. UNFINISHED BUSINESS: 1 1. Heather Metcalf —Public Hearing 2015 -OR -32 An Ordinance on Additional Appropriation Additional vehicle for Building Commission is $23500. Councilperson Owen made a motion to APPROVE 2015 -OR -32 An Ordinance on Additional Appropriation on the last reading noting the change from $35000 to $23500 with Councilperson Zastawny seconding, PASSING on a vote 9-0. 2. Les Merkley- 2015-R-9 A Resolution Regarding the Amendment of the Falls Landing Redevelopment Plan (Tabled 6/20/2015) - Councilperson Sellers motioned to TABLE due to the Workshop not being completed. PASSED on a vote 9-0. 3. Les Merkley- 2015-R-10 A Resolution Regarding the Amendment of the Inner City Road Redevelopment Plan (Tabled 6/20/2015) - Councilperson Sellers motioned to TABLE due to the Workshop not being completed. PASSED on a vote 9-0. B. NEW BUSINESS: 1. Les Merkley — PUBLIC HEARING — 2015 -OR -34 An Ordinance Changing the Zoning Map Designation of Property Located at Thirteen (13) Properties on East 10th Street and Fully Described in Attached Exhibit A From M2, IS & C1 to C2 (ONE READING NEEDED). Mr. Merkley introduced the David Nicklies of Nicklies' Development. The company has contracted for 81.3 acres off of 10th Street. The company has been developing approximately 25 years around the Kentuckiana area. This will be retail, office space, apartments and hospitality as part of the community. This company will keep architecture and will refer to this project as Jeffersonville Commons. Councilperson Sellers asked if the company met with the neighbors who had questions and concerns following the Zoning meeting. Mr. Nicklies stated that he had, and he satisfied their questions. Councilperson Zastawny for an approximate number on how much development would go back there and a preliminary number is approximately $40,000,000 Council President Opened up Public Hearing. Councilperson Owen motioned to APPROVE with Councilperson Sellers seconding. The motion PASSED on a vote 9-0. 2. Les Merkley- PUBLIC HEARING — 2015 -OR -35 an Ordinance Changing the Zoning Map Designation of 2415 Charlestown Pike and Fully Described in Attached Exhibit Z from C2 to R3 (ONE READING NEEDED). Favorable recommendation by the planning commission. Infinity Homes asking for a downzone from commercial to residential. Matthew Toole- residential development, known for Craftsman style communities. This specifically will be craftsman style homes that will sell for $180,000-$220,000. The goal is to have more of a neighborhood community feel where people who can stay outside and socialize with neighbors. Mr. Toole is currently working with Shane and the attorney to comply with the standards the City is setting forth. Councilperson Zastawny stated this property is in his district and he believes it is the absolute best use for the land and encouraged the Council to pass the motion. Councilperson Sellers noted that the neighbors who were present at the Planning and Zoning Meeting had no major oppositions to this project. Council President Gill opened up Public Hearing, no one came forward to speak so the Public Hearing was closed. Councilperson Smith made a motion to APPROVE and the motion PASSED on a vote 9-0. 2 3. Chief Kenny Kavanaugh JPD Police a. Advance SWAT School- This training will be for the four newest operators cost is $400 per person with the money already built into the budget. The training is located in Louisville, KY. b. New Vehicles, Radio and Equipment. — Chief Kavanaugh handed out a report outlining the vehicles and the mileages. The other appropriation is for the equipment. Chief Kavanaugh is looking to get 6 base radios in which would be approximately $23,000. Additionally the force lost the Narcotics vehicle, it was totaled out by the insurance and Chief Kavanaugh would like that money deposited back into the Police Department Budget. 4. Heather Metcalf — 2015 -OR -36 An Ordinance to Transferring Certain Funds within the Same Department. Starts with 42000- For the Fire Department: We are reclassifying some. The more expensive gear (tanks, suits, masks, etc.) is going into a capital fund. Vissing Park- Transferring these funds for construction is so that everything is in the right category (improvement). Animal shelter came up during the finance committee meeting- this is just so that the animal shelter gets the funds that they were planning on receiving for the rest of the year. Councilperson Samuels mad a motion to APPROVE with Councilperson Sellers seconding, PASSING on a vote 9- 0. 5. Heather Metcalf — 2015 -OR -37 An Ordinance of Additional Appropriation This covers the Police Department, Parks Department (What to do in Jeffersonville Flier), and the Animal Shelter (Spray and Neuter Funds). Councilperson Owen made a motion to APPROVE with Councilperson Julius seconding, PASSING on a vote 9-0. 6. Heather Metcalf- 2015 -OR -38 An Ordinance Transferring Certain Funds within the Same Department. This is for $4,000,000 band that is due for the Vissing Park so we do not accrue interest. Councilperson Zastawny made a motion to APPROVE with Councilperson Sellers seconding, PASSING on a vote 9-0. 6A. Heather Metcalf — 2015 -OR -39 An Ordinance of Additional Appropriation Councilperson Samuels motioned to AMEND the agenda to add 6A with Councilperson Sellers seconding, PASSING on a vote 9-0, Zastawny motion to PASS with Julius seconding, PASSING on a vote 9-0. 7. Heather Metcalf — Budget Calendars for Departments Budge Hearings with Council. Heather passed out a list of dates for the Budget scheduling. Half of the Department's time is to discuss their budgets and the other half is for the Council to ask questions. CITY COUNCIL ATTORNEY REPORT: None at this time. DEPARTMENT HEAD REPORTS: None at this time. Fire Chief Hederick stated they had 3 participants in the World Police and Fire games and we brought back 2 Golds and a Silver Medal. Council President Gill stated that is an awesome representation of Jeffersonville and would like to coordinate with the Chief to have those individuals recognized. 3 PUBLIC COMMENT: Called for Josh Rodriguez (was no longer present) Susan Steinberg from JNLA thanked the Council for the $6000 funds for the program on August 4th from 6 PM until 8 PM (17 or 18 neighborhoods are participating). COUNCIL COMMENTS: Councilperson Mike Smith: Nothing at this time. Councilperson Ed Zastawny: Nothing at this time. Councilperson Wadsworth: Nothing at this time. Councilperson Sellers: A street needs to be added to the closure list for the National Night Out list. A special meeting needs to be held for the Parks Department on Friday 7/24/2015 at 8:30 AM in the Mayor's conference room. Councilperson Webb: Nothing at this time. Councilperson Julius: Reached out to One SI to come up with a new format for tax abatements. Hopefully for our next council meeting we can come up with something on a points system that will allow us to grade qualifications by a point system. This will give us the opportunity to give more of an incentive to companies bringing larger investments to our community. Some of the city vehicles are not marked. We have an ordinance 2007 -OR -45 that says all City vehicles have to be marked. Also there is a policy put in place in the handbook that states those who have a City vehicle are not allowed to use the vehicle for personal use. Additionally City vehicles cannot be taken across State lines. Maybe we should discuss labeling our equipment with what department it belongs too. Drainage crews are being pulled off to do other projects. If we can identify equipment then that can help to eliminate some of that. We have a lot of drainage crews being pulled off and that needs to be addressed. Councilperson Owen: Deferred his time to Mr. Hurt- There is retired fire fighter (Jimmy Vangilder) he is very sick and a week from today they are going to be donating 10% of proceeds to the union and they will be donating to Jimmy). Will send out flyers, Clerk's Office. Greenway put out an article in the News and Tribune about what they are looking to do for the next few months and the direction they would like to move towards. Councilperson Samuel: There was vandalism to floodwall art, at least 5 panels. They are currently in the process of trying to remove the spray paint without moving to paint below it however this could become very costly. Councilperson Sellers remembers way back that they required a protective sealant being put on those. There is an Ordinance coming up that deals with grants and matching dollars for grants for art funds. Councilperson Samuels Went to a meeting today with Councilperson Owen and Councilperson Julius (Regional Cities meetings - Scott, Floyd, Harrison) about a new initiative that is pushing for attractions for people to live here and stay here- they are focusing on quality of life in an area to keep people living where they do. Cities that focus on quality of life retain people. Councilperson Samuels would like to give recognition to Councilperson Zastawny for his advocating for the community parks. 4 Council President Gill: Council President Gill sent out an email on Greenway but did not receive any response, do we need them to come and give a presentation or just submit a claim. Unable to schedule the workshop for before this Council Meeting, can't be August 3"1, we are waiting on additional dates others are available. Employees that are concerned, been here 20 or 30 years and our salary ordinance prevents them from getting raises. We may need to revisit the salary ordinance. Clerk Conlin: We never received a receipt for the American Red Cross Table. ADJOURNMENT: Council President made a motion to ADJOURN at 8:05 pm with Councilperson Owen moving the motion.
