OF JEFFERSONVILLE, INDIANA
April 6, 2015
The Common Council of the City of Jeffersonville, Indiana met in regular session in Room 101, 500
Quartermaster Court, Jeffersonville, Indiana at 7:OOpm, on Monday, April 6, 2015.
Council President Gill, with Vicki Conlin, City Clerk, called the meeting to order at 7:OOpm. President Gill asked
those in attendance to stand as Mr. Bobby Campbell gave the Invocation. Cub Scout Pack 4043 New Chapel
Methodist Church led in the Pledge of Allegiance to the Flag.
The roll call and those present were: Councilperson Smith, Council Vice President Zastawny, Councilperson
Wadsworth, Councilperson Sellers, Councilperson Julius, Councilperson Webb, President Gill, Councilperson
Owen and Councilperson Samuel.
MINUTES TO BE APPROVED:
Councilperson Sellers made a motion to APPROVE the March 16, 2015, Council Regular Proceedings with
Councilperson Owen seconding, PASSING on a vote of 9-0.
APPROVAL OF THE AGENDA:
Councilperson Owen made a motion to APPROVE the agenda with Councilperson Sellers seconding, PASSING on
a vote of 9-0.
General Claims: Controller Amy Deering presented the general claims list in the amount of $1,249,420.14.
Councilperson Owen made a motion to APPROVE the general claims list with Councilperson Sellers seconding,
PASSING on a vote of 8-0-1 with Councilperson Julius ABSTAIN.
REPORT OF THE CLERK: None at this time.
A. UNFINISHED BUSINESS:
None at this time.
B. NEW BUSINESS:
1. Chief Kenny Kavanaugh JPD — Training Request
A. Moving Surveillance Training: Two narcotics officers will be going to Indiana Drug Enforcement
Academy, it is going to be a weekend surveillance school. The officers will partake in about 500
miles in training. The expense and registration fee is $100.00. The travel cost is $700.00.
Councilperson Samuel made a motion to APPROVE the request for moving surveillance training with
Councilperson Sellers seconding, PASSING on a vote of 9-0.
B. Officer Training: Two officers will be attending ILEA, the firearms academy. The dates that you see
have been changed from June 1-5 to July 27-31. The course expense is $1,300.00 for both officers, it
is a little high due to ammunition costs. The travel expense is $1,000.00.

Councilperson Owen made a motion to APPROVE the request for officer training with Councilperson
Samuel seconding, PASSING on a vote of 9-0.
C. Police Vehicle Request: The previous administrators had purchased within the LOIT funds the nine
vehicles already appropriated for, was going to be six Chevy Caprices and three Tahoes. The Tahoes
are two- wheel drive and we are in the process of putting those out. They are not effective in
inclement weather. So within the fleet we drop down to six vehicles. Out of these six vehicles none
are actually geared and ready as far as a police packaged vehicle that we are using. By upgrading
the vehicles I am able to deploy all the officers needed. We found a fleet buyer in the state of
Florida of police vehicles and we were able to do a transaction of $84,750.00. We brought that back
in to the City in the General Fund. I am asking for an appropriation to have those funds come back
out. Working with Coyle Chevrolet and within our budget, we are prepared to move forward having
the $84,750.00 to come back. City Attorney Lewis stated they would need to have Controller Amy
Deering do an additional appropriation for this.
2. Clark Miles- update on paving: Last year close to $800,000.00 was spent on the roads. This year looks
like it will probably be about $1,500,000.00 spent. Waiting on updated final figures, going to have
money coming in, should be close to half a million. Wanted to make sure Council was informed that he
was going to be looking for maybe another $500,000.00 to hold on to, just in case it is needed for the
roads. It may not all be needed, but once I get figures back I will make you aware and update you. With
the last two winters that we've had, we have some roads that are in pretty bad shape. Hopefully we can
get things worked out within a decent, good budget.
3. Kim Calabro- 2015 -OR -17 An Ordinance Amending 2014 -OR -54 Fixing the Salaries of Appointed
Officers and Employees for All the Departments of the City of Jeffersonville, Clark County, Indiana for
the Year 2015: Councilperson Samuel asked if there were an additions since the Workshop. Mrs.
Calabro stated no. Councilperson Samuel makes a motion to APPROVE 2015 -OR -17 on the First
Reading, seconded by Councilperson Sellers, PASSING on a vote of 9-0.
4. Scott Lewis- Certificate of Override of Mayor's Veto of Ordinance 2015 -OR -13: This is the first regular
meeting since the date of the Mayor's veto. So if it is the desire of the Council to override the veto, this
is the meeting to do so. Councilperson Zastawny wanted to clarify that the action the Mayor took was
to veto the creation of a fund. There was no spending of money, there was no facility being considered
for purchase, or construction. It was just the creation of a fund for future use. City Attorney Lewis
stated yes, that the fund was created as a place holder, to put money in at a later time. It doesn't create
any spending or transfer of money into the fund at this point in time. Councilperson Sellers stated the
Mayor's reasons for vetoing was because he said we were going to be building an indoor athletic facility
which we've made clear at previous meetings that is not what was happening. I would like to make a
motion that we override the Mayor's veto. Councilperson Owen seconds. Councilperson Smith states it
needs a roll call vote. Councilperson Wadsworth stated that he thought it would be useful to clarify that
the Non Reverting Fund is actually a vehicle recommended by the State Board of Accounts, and the
purpose of it is so that any money that is left over at the end of an accounting period or the end of the
year will not revert outside the control or the possession of the city of Jeffersonville. Councilperson
Owen stated that there is no dollar amount of money attached to the creation of this fund. Council
President requested a roll call vote.

After the roll call votes, the motion PASSES unanimously by a vote of 9-0.
5. Les Merkley- 2015 -OR -18 An Ordinance Amending Ordinance 1012 -OR -2, Which Amends Ordinance
2011 -OR -49, Which Amends Ordinance 2009 -OR -33, Which Amends 2009 -OR -13, Which Amends 2008 -
OR -56, An Ordinance Establishing Departmental Petty Cash And/Or Cash Change Funds: This ordinance
comes upon recommendation of the police chief. There is one change in the ordinance, the new
amount would be $50.00; previously it was $25.00. Councilperson Samuel makes a motion to APPROVE
2015 -OR -18 on the First Reading, seconded by Councilperson Sellers, PASSING on a vote of 9-0.
6. Amy Deering- 2015 -OR -19 An Ordinance Transferring Certain Funds Within the Same Department:
Chief Kavanaugh has asked to speak on this ordinance. Chief Kavanaugh states that if the money is
moved, he will most likely be back asking for more money. They are trying to look into ways to conserve
on the utility bill. Exploring options to be more energy efficient. He stated that just if you transfer this
money out, there is a high probability that I will be back asking for money. We are looking at the Big
Four Bridge with over time. That is where it is going to go significantly. It cannot be all done with over
time dollars so we are trying to strategically move around people and place on duty officers there in
shifts. Councilperson Julius stated that he needs to come in and request money before he is completely
out. Councilperson Owen makes a motion to APPROVE 2015 -OR -19 on the First Reading, seconded by
Dennis Julius, PASSING on a vote of 9-0.
7. Amy Deering- 2015 -OR -20 An Ordinance of Additional Appropriation (Public Hearing to be held on
April 20, 2015): First two items are just for accounting purposes: moving a vehicle that has already been
purchased underneath the motor vehicle department from the council, and a 2014 invoice received for
the Safety Department vehicle this year. All additional items are for the new Green Team employees.
Councilperson Owen made a motion to APPROVE 2015 -OR -20 on the First Reading with the change,
seconded by Councilperson Julius, PASSING on a vote of 9-0.
8. Les Merkley- 2015 -OR -21 PUBLIC HEARING- Plan Commission Recommendation to Jeffersonville
Common Council to Amend Ordinance 2000 -OR -61 With Revised Sign Standards (Article 7.17, 7.18, &
7.19) and Definitions Article (14) (Need only one reading for passage): Shane Corbin gives a
presentation on revised sign standards for the city. Development codes need updated as far as signage.
Consistency on signage throughout the city is important to attract business. We have updated our
standards and expanded, and made adjustments to existing code to create consistency throughout the

city. Adding definitions and clarifying them. We have addressed LED lights since there isn't a clear set of
guidelines. Political signs are touched on as well.
PUBLIC HEARING opened at 7:57 p.m. with no comments/discussion, closed at 7:57 p.m.
Councilperson Smith makes a motion to APPROVE 2015 -OR -21, seconded by Councilperson Sellers,
PASSING on a vote of 9-0.
9. Les Merkley- 2015 -OR -22 PUBLIC HEARING- An Ordinance Changing the Zoning Map Designation of a
Certain Tract of Property Located at 1101 E. 10th Street and Fully Described in Attached Exhibit A from
R3 to NC (Need only one reading for passage): This property is located at 1101 E. 10th Street, the
petitioner is here and requesting that the property be zoned from R3, residential, to NC, neighborhood
commercial. This comes to you from the Planning Commission with a favorable recommendation by
unanimous vote. Mark Keeling, petitioner, states that his current thought is to implement the structure
for a small business. Making plans and trying to proceed along that route. Intent is to have a small,
second hand vintage type store.
PUBLIC HEARING opened at 8:02 p.m. with no comments/discussion, closed at 8:02 p.m.
Councilperson Smith makes a motion to APPROVE 2015 -OR -22, seconded by Councilperson Owen,
PASSING on a vote of 9-0.
10. Nathan Samuel- Public Arts Master Plan Session held March 30, 2015: This was an interactive type
session and we had from 75-100 people come. It was very well attended and the people who came
were individuals that don't usually come to our meetings; there were new faces. It was very positive.
Our Planning and Zoning office are actually doing the report and once it is complete we will bring that
back here and give everyone a copy so you can see.
CITY COUNCIL ATTORNEY REPORT: None at this time.
COUNCIL BOARD/COMMISSIONS APPOINTMENTS REPORTS: None at this time.
DEPARTMENT HEAD REPORTS: None at this time.
PUBLIC COMMENT:
Paul Duckworth — Woehrle Fields: Wanted to give his perspective on how the soccer complex is doing and
effecting the community. Last year we had 319 registrants and this year that number is up to 439. Everyone
loves the facility and all the major soccer clubs from Louisville are using the facility, so it isn't just the youth. We
have the Louisville FC, the new professional team and the River City Rovers, a semi pro team playing there. This
is bring people in. Semi pro football is playing there, Jeff High teams are utilizing the facility as well. It is getting
a lot of usage. One advantage to these numbers is we are able to pay referees, most of them are teenagers.
This is an income stream for them and teaches them responsibility. We have several tournaments and a new
one coming up at the end of April. We have had parking issues but we are working on that and think it will be
ok. Everyone love the facility and there is nothing like it in Louisville. Thanked council for their support.

COUNCIL COMMENTS:
Councilperson Smith: None at this time.
Councilperson Zastawny: Wanted to touch on insurance. We have had a poor worker's comp mod. It is a
factor to say you are going to pay more or less based on your experience. There was a time when we were
paying twice what we are. This goes to having a Safety Director and accidents, drug testing, back to work
programs. These save the city so much money, it adds up. Wanted to bring that to everyone's attention.
Councilperson Wadsworth: None at this time.
Councilperson Sellers: Wanted to thank Nathan for all he has done with the Art Commission. It is awesome to
see what is going on throughout the city. It is all thanks to his leadership.
Councilperson Webb: None at this time.
Councilperson Julius: Earlier/later last week called the Mayor of Scottsburg and talked to him about the HIV
issue and needle exchange. Going to talk to Amir about safety issues for the city and city workers. Believes they
can take an active role and be preventative. Councilperson Zastawny stated that is why garbage workers don't
just pick up bags, it must be in a can. Councilperson Julius stated that the Parks were a problem because
needles are discarded there and there is protocol to discarding. Going to talk to Amir, maybe there is training
we can do.
Councilperson Owen: The New Chapel Church is having their Sausage Supper is Saturday from 3-7. Out in the
Jeffersonville 6th District.
Councilperson Samuel: Invoices came in for the fire truck that was completely redone. Totaled about
$70,000.00. It was a little under budget. Wanted to thank everyone for the timely repairs. Second, for
President Gill, do we have a code to get in the employee entrance? President Gill stated she would email that
out.
President Gill: Also wanted to thank Nathan. She was thrilled to see so many people for Go Jeff and even more
people came after. It was just so positive to see the city move in that direction. Asked if everyone got their
utility box locations out. Also needs someone to email or message her for the JNLA so they can fill that table.
Thanked the fire and police for their service, she will always be their voice. Public safety is something I take very
seriously. Just so the public knows, we hired three police officers. And we are having meetings to discuss hiring
2 or 3 new fire fighters. Once again, I applaud you all. The fire department assisted in New Chapel with a house
fire over the weekend, right on the heels of a flood rescue. We can't get the message out enough that people
continue to drive thru swift water and the car can be swept away in just 2-3 inches of swift water going across
the roadway.
