RESOLUTION NO. 2015-R- 5
RESOLUTION APPROVING INTERLOCAL AGREEMENT BETWEEN THE
CITY OF JEFFERSONVILLE AND THE GREATER CLARK COUNTY
SCHOOL CORPORATION AUTHORIZING TRANSFER OF LAND
WHEREAS, the Greater Clark County School Corporation desires to improve the
traffic congestion in and around Wilson Elementary School located at 2915 Charlestown
Pike, Jeffersonville, Indiana; and,
WHEREAS, the City of Jeffersonville desires to assist with the roadway
improvement in this area to aid in the improvement of the traffic congestion; and,
WHEREAS, in order to begin this roadway improvement, the City of
Jeffersonville needs the area designated for roadway improvement to be transferred to the
City via a Deed of Dedication by the school corporation; and,
WHEREAS, the area to be dedicated is identified on the attached survey as the
"Wilson Minor Plat/Tract 2". (Attached A); and,
WHEREAS, projects of this type can be performed by governmental entities by
means of a joint undertaking which is observed via an approved Interlocal Agreement.
NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the
City of Jeffersonville, Indiana does hereby approve the dedication of this tract of land to
the City of Jeffersonville, Indiana for roadway improvements in or around Wilson
Elementary School and acknowledges that said transfer will be done in conjunction with
the attached Interlocal Agreement.
This Resolution shall be in full force and effect from and after its passage and
approval.

RESOLUTION
FOR INTERLOCAL AGREEMENT WITH
THE CITY OF JEFFERSONVILLE
AUTHORIZING
TRANSFER OF LAND
WHEREAS, it is the desire and intent of the Board of School Trustees for the Greater
Clark County School Corporation to improve the traffic congestion in and around Wilson
Elementary School located at 2915 Charlestown Pike, Jeffersonville, Indiana; and,
WHEREAS, the City of Jeffersonville desires to assist with the roadway improvement in
this area to aid in the improvement of the traffic congestion; and,
WHEREAS, in order to begin this roadway improvement, the City of Jeffersonville

NOW, THEREFORE BE IT RESOLVED, that the Board of School Trustees for the
Greater Clark County School Corporation does hereby approve the dedication of this tract of
land to the City of Jeffersonville, Indiana for roadway improvements in or around Wilson
Elementary School and acknowledges that said transfer will be done in conjunction with the
attached Interlocal Agreement.
BE IT FURTHER RESOLVED that the Board of School Trustees:
1. Acknowledges that the tract of land to be dedicated is identified as being owned by
the Utica School Building Corporation, a public benefit non-profit corporation
organized for a public purpose, as part of a bond refinance project for Greater Clark,
which was administratively dissolved by the state of Indiana on August 28, 2003, thus
returning ownership to the Greater Clark County School Corporation.
2. Authorizes the transfer of this land area as identified herein by means of a Deed of
Dedication.

3. Authorizes the President and Secretary of the Board of School Trustees to file the
Minor Plat Application with the Jeffersonville Plan Commission and to execute all
required legal documents to effectuate this transfer. (Attachment B)

5. Conditions of Eligibility:
Before determining that a subdivision is eligible to be considered as a minor
subdivision, the planning director shall find that all of the following criteria are
satisfied:

Attachment A
1. Orderly Development — the subdivision will not impede orderly development
of land or the provision of public services and improvements.
2. Comprehensive Plan — The subdivision will be consistent with the
Comprehensive Plan.
3. Streets —The subdivision will not interfere with the provision of streets to
provide access to adjoining or nearby property in the event that such
property is developed in the future. The subdivision shall not be eligible for
minor subdivision status if it requires or involves the construction of a new
street or extension of an existing street.
4. Public Street Right of Way Dedication — All parcels of the minor subdivision
shall dedicate to public use the minimum right of way width along the
abutting public street.
5. Utilities and Drainage — All parcels in the subdivision will have adequate
utilities and drainage and will not necessitate the extension of municipal
facilities or the creation of any public improvements.
6. Lot Limitations —The minor subdivision may not contain more than two (2)
lots.
7. Sewage — All lots shall be served by a sanitary sewer system or other on-site
sewage system approved by the Indiana Department of Health, and/or Clark
County Health Department.
8. Water —All lots shall be served by a public or quasi -public water system.
9. Drainage — All lots shall be provided with drainage improvements as
necessary to comply with the requirements of this ordinance's design
standards, the City's drainage requirements and Jeffersonville's Drainage
Board.
10. Driveway Permit — If any lot in a subdivision is to receive access from a State
highway, the applicant must obtain a driveway permit from the Indiana
Department of Transportation. Likewise, if any lot in a subdivision is to
receive access from a city street or road, the applicant must obtain a
driveway permit from the appropriate city department.
11. Limited Access Streets — Frontage on limited access streets on which
driveways cannot open shall not constitute legal access.

12. Topography/Special Conditions/New Street — If by reason of topography,
natural or man-made features, or other conditions relating to the property
requested for subdivision, better access can be provided through
construction of a new street, the petition shall not be eligible for treatment
as a minor subdivision and shall be considered to be a major subdivision.
13. Driveway Standards — All lots will have driveway locations that will provide
for adequate sight distance and will be properly spaced according to city and
transportation safety standards. All driveways which serve a house in a minor
subdivision shall be at least twelve (12) feet wide to allow access to fire
trucks and fire -fighting equipment. Shared driveways may be permitted;
however, the applicant requesting approval of the minor subdivision shall
provide the planning director with a copy of a written access and
maintenance agreement as to who will be responsible for maintaining the
driveway in the proper width.
14. Suitability— All lots in the subdivision will provide suitable building sites for
the purpose for which the land is to be used. Land suitability shall be
determined by the criteria contained in this ordinance, and the zoning
classifications of the City's zoning ordinance.
15. Fire Hydrants—A minor subdivision may not be approved unless each new
parcel is located within 750 feet of a fire hydrant so long as the existing
waterline is sufficient to support the installation and proper operation of a
fire hydrant.
16. Public Health, Safety and General Welfare — The subdivision will not be
detrimental to nor endanger the public health, safety, or general welfare.
Plat Approval — If a minor subdivision has been given preliminary plat
approval by the planning director, it shall be submitted to the Plan
Commission for final plat approval. Minor subdivision plats shall be signed by
the official(s) of the Plan Commission as authorized by the Plan Commission.
Application Fee — The Plan Commission may include on its schedule of
administrative fees a fee for minor subdivision applications, however, the
minor subdivision application fee shall not be less than Twenty -Five Dollars
($25).
Expiration of Approval — Approval for a minor subdivision plat shall be valid
for one year from the date of final plat approval. If the minor subdivision
final plat is not recorded with the Clark County Recorder before the
expiration of one (1) year, the approval shall be null and void.

INTERLOCAL AGREEMENT
BETWEEN

AND
THE GREATER CLARK COUNTY SCHOOL CORPORATION
THIS AGREEMENT is entered into by and between the City of Jeffersonville, Indiana,
(hereinafter referred to as "the City"), through the Mayor and Common Council, and the Greater
Clark County School Corporation (hereinafter referred to as "the School Corporation"), through
its Board of School Trustees.
1. DURATION: This Interlocal Agreement shall remain in full force and effect from the date
first approved by all parties until completion of the Agreement's purpose as set out below.
2. PURPOSE OF AGREEMENT: IC 36-1-7 et al allows political subdivisions in the state of
Indiana to enter into Interlocal Agreements for joint undertakings that benefit the general
public and citizens of the community. The purpose of this Agreement is a joint undertaking
to assist with the roadway improvements needed on Charlestown Pike in and around Wilson
Elementary School, located at 2915 Charlestown Pike, Jeffersonville, Indiana to reduce or
eliminate traffic congestion in and around the school. In order to reduce or eliminate traffic
congestion in this area, the City of Jeffersonville needs the area designated for roadway
improvement as shown on the "Wilson Minor Plat" map to be transferred to the city via a
Deed of Dedication from the School Corporation. This purpose has been established for the
benefit of the School Corporation's students, employees, faculty, administrators, general
public and citizens of the City, Clark County, and surrounding communities.
3. MANNER OF FINANCING, STAFFING AND SUPPLYING THE JOINT
UNDERTAKING AND OF ESTABLSHING AND MAINTAINING A BUDGET
THEREFORE:
a. Manner of Financing — The School Corporation will pay for the costs associated with
the survey preparation, the Plat Map, Survey and Deed of Dedication, to Blankenbeker
& Son, Land Surveyors, Inc. The City shall pay for all costs associated with the actual
roadway improvements. The City's Plan Commission will waive the costs associated
with any filing fees for this project.
b. Staffing — There will be no staffing added by either party for this project.
c. Maintenance of Budget — The School Corporation and the City shall separately
maintain records of the budgeted funds for this undertaking.
d. Supplying the Joint Undertaking — By the School Corporation agreeing to transfer
land for this project via a Deed of Dedication and the City agreeing to perform the
roadway improvements, the joint undertaking will be accomplished.

4. METHODS THAT MAY BE EMPLOYED IN ACCOMPLISHING THE PARTIAL
OR COMPLETE TERMINATION OF THIS AGREEMENT: Once approved, this
Agreement will not be terminated until the purpose is completed.
5. ADMINISTRATION: This Agreement shall be administered jointly by the City of
Jeffersonville's City Engineer and the School Corporation's Superintendent of Schools, or
his designee. These individuals shall be authorized to perform all duties and carry out all
functions as are necessary to effectuate the purpose of this Agreement.
6. ACQUIRING, HOLDING AND DISPOSING OF PROPERTY: The City of
Jeffersonville will acquire land from the School Corporation via a Deed of Dedication to
perform the roadway improvements.
7. PAYMENT SCHEDULE: There are no payments to be made between the parties. The
costs associated with the roadway improvements will be the responsibility of the City.
8. APPROVALS: This Agreement is being approved by Resolution of the Board of School
Trustees for the School Corporation at a public meeting of the Board of School Trustees on
the 3rd day of February, 2015, and is scheduled to be approved by the Mayor and Common
Council of the City of Jeffersonville on the day of � 2015.
9. FILING: The parties agree that upon approval by all parties, the School Corporation will
record the Interlocal Agreement with the County Recorder at its expense and will provide a
recorded copy of the Agreement to the City of Jeffersonville. Within sixty (60) days of the
date the Agreement takes effect, both parties shall file a recorded copy with the State Board
of Accounts for audit purposes pursuant to IC 36-1-7-6.
IN WITNESS WHEREOF the parties have affixed their signatures hereto on the dates
shown above in Paragraph 8 indicating their respective approvals of this Interlocal Agreement in
order to provide roadway improvements along Charlestown Pike at the Wilson School area as
needed for the benefit of the School Corporation's students, employees, faculty, and
administrators along with the general public and citizens of Jeffersonville, Clark County and
surrounding communities.
