OF ORDINANCE 2015 -OR -13
The undersigned , as the duly appointed President of the Common Council of the
City of Jeffersonville, Indiana, hereby certifies that on the 6th day of April, 2015, the
Common Council of the City of Jeffersonville, Indiana, at its first regular or special
meeting following either (i) the express veto of the above -referenced Ordinance by the
Mayor of Jeffersonville within (10) days after its presentation to him by the City Clerk, or
(ii) the failure of the Mayor of Jeffersonville to either approve or veto the above -
referenced Ordinance within ten (10) days after its presentation to him by the City Clerk,
PASSED and ADOPTED the above -referenced Ordinance over the veto of the Mayor of
Jeffersonville by a two-thirds (2/3) vote of its entire membership. The provisions of the
above -referenced Ordinance shall be fully effective from and after such action of the
Common Council in accordance with the provisions of Indiana law.

VETO AND STATEMENT OF REASONS
Comes now the Mayor for the City of Jeffersonville, Mike Moore, having reviewed
Ordinance No. 2015 -OR -13, "An Ordinance Establishing A Woehrle Athletic Complex and
Parks Projects Non -Reverting Fund" hereby vetoes said ordinance and in support states the
following reasons:
1. While an indoor athletic facility is a worthwhile project, there are more important
priorities that should be funded.
2. Any surplus funds should be set aside for public safety and paving of streets.
a. The City of Jeffersonville requires additional police
officers and firefighters to comply with national standards.
b. The recent winter was especially harsh on our city streets that
require more paving than budgeted.

ORDINANCE NO. 2015 -OR- I
AN ORDINANCE ESTABLISHING A WOEHRLE ATHLETIC COMPLEX
AND PARKS PROJECTS NON -REVERTING FUND
WHEREAS, the Common Council for the City of Jeffersonville, Clark
County Indiana (hereinafter the "Council"), is the City's statutory Fiscal and
Legislative Bodies pursuant to Indiana Code; and
WHEREAS, the City and the Jeffersonville Parks Authority desires to
expand and improve the Woehrle Athletic Complex and consider other future
parks projects; and
WHEREAS, it is necessary for the City to fund the construction and
property acquisition for the expansion and improvements to the Woehrle Athletic
Complex and for other future parks projects from various revenue sources; and
WHEREAS, it is economically desirable to create a non -reverting fund for
the deposit, expenditure and disbursement of funds designated for the expansion
and improvement of the Woehrle Athletic Complex and for other future parks
projects;
NOW, THEREFORE, BE IT ORDAINED by the Common Council:
1. That a special non -reverting operating fund is hereby established for
the purpose of receiving and holding funds for the expansion and improvements
to the Woehrle Athletic Complex and for other future parks projects as
determined by the Jeffersonville Parks Authority. This fund shall be entitled "The
Woehrle Athletic Complex Construction and Expansion and Parks Projects Non -
Reverting Fund" and monies may be expended from this fund only upon the filing
of a proper claim in issuance of a warrant for payment by the Controller after
appropriation and approval by the Common Council. Hereafter, the Controller
shall not deposit funds for the construction and expansion of the Woehrle Athletic
Complex and for other future parks projects, regardless of the revenue source,
into the City's General Fund, but shall deposit those funds into "The Woehrle
Athletic Complex Construction and Expansion and Parks Projects Non -Reverting
Fund".
2. That the Common Council is hereby required to use the said Non -
Reverting Fund to the extent and in the manner allowed by law.
This Ordinance shall be in full force and effect from and after its passage
and approval.
