HomeMy WebLinkAbout2015-OR-152015 -OR- % STATE OF INDIANA PLAN COMMISSION RECOMMENDATION TO JEFFERSONVILLE COMMON COUNCIL TO AMEND ORDINANCE AMENDING ORDINANCE 2015 -OR -10 PORTIONS OF THE JEFFERSONVILLE ZONING ORDINANCE 2000-0R-61 WHEREAS, the Jeffersonville Plan Commission has reviewed proposed changes to the Jeffersonville dotting Ordinance as it pertains to amending the Coning Ordinance Uy expanding the list of Special 1✓xcepnon Uses and revising the development standards for the "M1" (I,ow Density Multi -Family 12esidenrial) District as recommended by the Plan Commission in the staff report (a copy of which is attached as I?xhibit "A"); and, and WHEREAS, the Planning 17irector has recommended such changes; WHEREAS, the changes are more consistent with the City's Comprehensive Plan; and WHEREAS, the Plan Cl2c3i minission has held a public hearing on February 24, 2015 in accordance with I.C. 36-7-4-604; and WHEREAS, notice was properly given to the public prior to the public hearing being held; and WHEREAS, the Plan Commission by a majority vote of its entire- membership believes that the proposed changes should be made and that the proposed changes are in the interests of the public health, safety, cottzfort, convenience, morals, and general welfare; NOW, THEREFORE, BE IT RECOMMENDED Uy the Jeffersonville Plan Commission to the Common Council of the City of Jeffersonville, Indiana, that the ante raclincnts and clta.ngcs Uc amending the Toning CJrdinance by expanding the list of Special L;xception Uses and revising the development standards for the "M1" (I.,ow I7ettsity Multi -Family Residential) District as recommended by the. Mi - Moore, May 2 STATE OF INDIANA BEFORE THE JEFFERSONVILLE PLAN COMMISSION IN RE THE APPLICATION OF Jeffersonville Department of Planning & Zoning TO AMEND THE JEFFERSONVILLE ZONING ORDINANCE CERTIFICATION OF FAVORABLE RECOMMENDATION OF PROPOSED ORDINANCE Whereas, the Jeffersonville Department of Planning & Zoning filed a petition before the Jeffersonville Plan Commission to amend the Jeffersonville Zoning Ordinance (2000 -OR -61) by expanding the list of Special Exception Uses and revising the development standards for the "M1" (Low Density Multifamily Residential) District as recommended in the staff report (a copy of which is attached as Exhibit "A"); and, Whereas, after proper notice by publication, the Jeffersonville Plan Commission held a public hearing on the petition on February 24, 2015; and, Whereas, at the conclusion of the hearing the Jeffersonville Plan Commission voted by a majority vote of its entire membership to favorably recommend the proposed amendment to the Jeffersonville Common Council. IT IS THEREFORE CERTIFIED that on February 24, 2015, the Jeffersonville Plan Commission favorably recommends that the Jeffersonville Common Council enact by ordinance the proposed Jeffersonville Zoning Ordinance Amendment as requested in the petition of Jeffersonville Department of Planning & Zoning. Brent Roberts Chairman STAFF REPORT Department of Planning & Zoning — Plan Commission Petitioner: City of Jeffersonville, Planning & Zoning Department Requests: Amend the M1 District List of Special Exception Uses Hearing Date: February 24, 2014 Proposed Change to the Zoning Ordinance The Plan Commission staff recommends that the list of special exception uses of the M1 Zoning District (Low Density Multifamily Residential) be amended to include Assisted Living and that the development standards be expanded with specific standards for assisted living facilities. This use is currently permitted in the M3 district and a special exception use in the M2 district as shown in the attached land use matrix. Zoning Ordinance Amendment Article Three, Section 3.9 (M1 District Intent, Permitted Uses, and Special Exception Uses), should be amended to include Assisted Living in the list of Special Exception Uses. Article Three, Section 3.10 (M1 District Development Standards), should be amended to include the following standards: Maximum Main Floor Area for an Assisted Living Facility: • 60,000 square feet Maximum Number of Floors for an Assisted Living Facility: • 1 Maximum Number of Beds in an Assisted Living Facility: • 100 Attachments • M1 District Intent, Permitted Uses, and Special Exception Uses • Land Use Matrix • M1 District Standards Page 1 of 6 ZO-15-02: M1 District Intent M1 District 3.9 M1 District Intent, Permitted District Intent The "M1" (Low Density Multifamily Residential) District is intended to provide a land use category for small-scale multifamily residential (i.e. duplex, triplex, and quadplex). The provisions that regulate this zoning district allow a limited mix of residential uses and up to two primary structure per lot. The "M1" district is applicable to new and existing developments, small in area, and development standards that recognize multifamily development requires more stringent development standards to proted the quality of life of tenants Jeffersonville's Plan Commission and Board of Zoning Appeals should use this district for existing developments and carefully for new residential developments. A spedal exception use should be granted only when a development is dearly comparable to the intent and standards of this district.
