AN ORDINANCE CHANGING THE ZONING MAP DESIGNATION OF A CERTAIN TRACT OF
PROPERTY LOCATED ON 6.4.03. ACRES OF LAND IN STACY SPRING SUBDIVISION AND FULLY
DESCRIBED IN ATTACHED EXHIBIT A FROM R3 TO C2.
Whereas, Robert Lynn Company, Inc_ filed a petition before the Jeffersonville Plan
Commission to change the zoning map designation of the real property located on 6.401 acres
of land in Stacy Spring Subdivision and fully described in the attached Exhibit A from R3_ Old
City Residential to C2= Medium to Large Scale General Commercial; and,
Whereas, on July 29, 2014 the Jeffersonville Plan Commission has certified its favorable
recommendation of the enactment of this proposed zoning map designation change by
ordinance of this Common Council; and,
Whereas, this matter is now before the Common Council at its regular meeting after
certification of the proposed change of zoning map designation pursuant to the provisions of
I.C. 36-7-4-608(0(1); and,
Whereas, this Common Council has timely posted notice of its intent to consider the
proposed change of zoning map designation at the regular meeting scheduled for August 4,
2014; and,
Whereas, all interested persons having been given an opportunity to appear before this
Common Council and be heard regarding this matter as required by lave.
Now, THEREFORE, BE IT ORDAINED by the Common Council of the City of Jeffersonville,
Indiana, that the zoning designation of the real property located on 6.401 acres of land in Stacy
Spring Subdivision and fully described in the attached Exhibit A is hereby changed from R3- Old
City Residential to C2= Medium to Large Scale General Commercial.
IT IS FURTHER ORDAINED that the zoning map of the City of Jeffersonville shall be
amended to include such change.
This ordinance shall be in full force and effect upon its adoption.

Whereas, Robert Lynn Company filed a petition before the Jeffersonville Plan

Whereas, after proper notice by publication, the Jeffersonville Plan Commission
held a public hearing on the petition on July 29, 2014 ; and,
Whereas, at the conclusion of the hearing the Jeffersonville Plan Commission
voted by a majority vote of its entire membership to favorably/unfavorably/not
recommend the proposed change of zoning designation of the Property to the
Jeffersonville Common Council.

Summary of the Applications and Process
The Robert Lynn Company submitted multiple applications with the intent to
modify an existing subdivision by changing its proposed lots and zoning. The
first step is to amend the preliminary plat that was approved by the Plan
Commission in 2009. The second step is to rezone the Tots that are intended for
commercial uses. A development plan was submitted for review if the Plan
Commission recommends the requested zoning. The intended use requires a
special exception use so the approval of the development plan would be
contingent on the Board of Zoning Appeals decision.

Property Location and History
The property is located along State Road 62 and is on the northern boundary of
the City's limits. Development in the River Ridge Commerce Center is underway

on land that is across the highway from this property. A new road connecting 1-
265 to State Road 62, to be called River Ridge Parkway, will intersect with SR 62
roughly
This property was annexed by the City in January 2008. Annexed properties
were assigned a zoning district that was most similar to the prior zoning in Clark
County. During the annexation process, the applicant requested that this
property be zoned R3 and C2 because of some variances and permits that were
granted by the County.
In April 2009, the Plan Commission approved the Preliminary Plat for the Stacy
Spring Subdivision (Figure 3).
Preliminary Plat Approval Request
The proposed changes to the Preliminary Plat would create two new commercial
lots and eliminate 11 residential lots. Coronado Court was planned to provide
access to these residences so it would also be removed from the plat. The area
that would be affected contains 6.401 acres.

Ladies and Gentlemen,
Enclosed is an application for an amendment to the preliminary plat approval for the
Stacy Springs Subdivision. The intent here is to remove a cul-de-sac and some residential lots in
favor of commercial lots. The amendment would be for the removal of 11 residential lots, the
replacement of a street intersection with 1 residential lots, and to include two commercial lots on
the frontage of State Road 62 and Lucas Avenue.

Rezoning Request
The applicant is requesting that 6.401 acres of the Stacy Springs Subdivision be
rezoned from R3 (Old City Residential) to C2 (Medium to Large Scale General
Commercial). Figure 6 shows the layout of the subdivision with current and
proposed zoning.

Ladies and Gentlemen,
Enclosed is an application for a zone change of 6.4 acres of property located within and
adjacent to the Stacy Springs development. The purpose of the zone change is to match expand
the existing C-2 zone located within the development and to match the residential lots as
previously approved in the preliminary plat. The change in zone will allow the same uses as
already allowed in property adjacent to the zone change request. The property is located in an
area on a major thoroughfare where adequate utilities exist. The request is solely bounded by
property owned by the applicant, and therefore, no adjacent owner property values will be
affected.

Zoning Change Procedure
The Jeffersonville Zoning Ordinance and Indiana State Statute IC 36-7-4 outlines
that the following should be considered when the Plan Commission is reviewing
a Rezoning Request:
• The Comprehensive Plan;
• Current conditions and character of structures and uses in each district;
• The most desirable use for which the land in each district is adapted;
• The conservation of property values throughout the jurisdiction; and
• Responsible development and growth.
Comprehensive Plan & Planning Districts
The Jeffersonville Comprehensive Plan identifies this property for "Mixed -Use"
and places it in the Traditional Neighborhoods and Traditional Workplace
Planning Districts. The Plan provides the following guidance:
"The Traditional Neighborhood is characterized by predominantly
residential uses, by a grid pattern of streets with sidewalks and often
including alleys. Residential lots are predominantly narrow and often
deep, but the neighborhood may contain sections of large estate lots, and
also sections of lots on which appropriately integrated higher density
residential uses may be located... Traditional neighborhoods often have
and are encouraged to have a significant proportion of public open space
such as parks or greenways and may contain civic uses as wells
appropriately located and integrated neighborhood -serving land uses such
as offices, shops, restaurants and services."
"The Traditional Workplace is characterized by predominantly small to
medium scale industrial end employment uses. The streets are typically
narrow in a grid pattern and often have alleys. Building has little or no
setback from the street. Traditional workplaces are often clos

District Intent
The "C2" (Medium to Large Scale
General Commercial) District Is
intended to provide a land use

the "R3," "M1" and "M2" residential
districts. However, buffering should
be provided between this district

Development Plan Application
The proposed development is a mini -storage facility on a 2.5 acre lot. The plan
includes seven buildings of various sizes and two drives onto Lucas Avenue.
The property has frontage on State Road 62 but no entrances are planned for
that side of the property. Mini -storage facilities are a special exception use in
the C2 zoning district so an approved development plan would be dependent on
the BZA granting the special exception use.
