AND SPRING STREET AND FULLY DESCRIBED IN ATTACHED EXHIBIT A FROM MULTIPLE ZONING DISTRICTS TO C2 Whereas, White Reach Development filed a petition before the Jeffersonville Plan Commission to change the zoning map designation of 14 parcels of land located at 10Th and Spring Street and fully described in the attached Exhibit A from Multiple Zoning Districts to C2: Medium to Large Scale General Commercial; and, Whereas, on July 29, 2014 the Jeffersonville Plan Commission has certified its favorable recommendation of the enactment of this proposed zoning map designation change by ordinance of this Common Council; and, Whereas, this matter is now before the Common Council at its regular meeting after certification of the proposed change of zoning map designation pursuant to the provisions of I.C. 36-7-4-608(f)(1); and, Whereas, this Common Council has timely posted notice of its intent to consider the proposed change of zoning map designation at the regular meeting scheduled for August it, 2014; and, Whereas, all interested persons having been given an opportunity to appear before this Common Council and be heard regarding this matter as required by law. Now, THEREFORE, BE IT ORDAINED by the Common Council of the City of Jeffersonville, Indiana, that the zoning designation of 14 parcels of land located at 10Th and Spring Street and fully described in the attached Exhibit A is hereby changed from Multiple Zoning Districts to C2: Medium to Large Scale General Commercial. - IT IS FURTHER ORDAINED that the zoning map of the City of Jeffersonville shall be amended to include such change. The requested zoning for all of the properties is C2 (Medium to Large Scale General Commercial). The parcels included in the request are identified by their parcel number and current zoning classification: 10-19-00-101- 461.000-010(C1), 10-19-00-101-470.000-010(R3), 10-19-00-101-469.000- 010(R3), 10-19-00-101-468.000-010(R3), 10-19-00-101-467.000-010(R3), 10-19- 00-101-466.000-010(R3), 10-19-00-101-465.000-010(R3), 10-19-00-101- 464.000-010(R3), 10-19-00-101-481.000-010(R3), 10-19-00-101-480.000- 010(R3), 10-19-00-101-483.000-010(R3), 10-19-00-101-475.000-010(NI), 10-19- 00-101-934.000-010(C1), and 10-19-00-101-482.000-010(R3). History of the Property The parcels involved in the rezoning are owned by redevelopment and purchased as part of the combined sewer mitigation initiative. The area is currently a mixture of HC, NI, R3, 01, and C2 zoning classifications. All buildings have been removed and the parcels are vacant. In 2013, Jeffersonville's Redevelopment Commission released a national request for proposals on these parcels and is currently in a purchase agreement with a developer. Zoning Change Procedure The Jeffersonville Zoning Ordinance and Indiana State Statute IC 36-7-4 outlines that the following should be considered when the Plan Commission is reviewing a Rezoning Request: • The Comprehensive Plan; • Current conditions and character of structures and uses in each district; • The most desirable use for which the land in each district is adapted; • The conservation of property values throughout the jurisdiction; and • Responsible development and growth. Page 1 of 8 PC -14-19: 10th and Spring (Falls Landing) Comprehensive Plan & Planning Districts The Jeffersonville Comprehensive Plan as it relates to this rezoning request is as follows: 1. The Jeffersonville Comprehensive Plan's Planning Districts Map identifies several of these properties within Traditional Neighborhood District and describes it as the following: "This form is characterized by predominantly residential uses, by a grid pattern of streets with sidewalks and often including alleys. Residential lots are predominantly narrow and often deep, but the neighborhood may contain sections of larger estates lots, and also sections of lots on which appropriately integrated higher density residential uses may be located. The higher density uses are encouraged to be located in centers or near parks and open spaces having sufficient carrying capacity. There is usually a significant range of housing opportunities, including multi -family dwellings. Traditional neighborhoods often have and are encouraged to have a significant proportion of public space such as parks or greenways, and may contain civic uses as well as appropriately located and integrated neighborhood -serving land uses such as offices, shops, restaurants and services. Although many existing traditional neighborhoods are fifty to one hundred twenty years old, it is hoped that the Traditional Neighborhoods district will be revitalized under the new Comprehensive plan. Revitalization and reinforcement of the Traditional Neighborhood District will require particular emphasis on (a) preservation and renovation of existing buildings in stable neighborhoods (if the building design is consistent with the predominant building design in those neighborhoods), (b) the preservation of the existing grid pattern of streets and alleys, (c) preservation of public open spaces." • The Jeffersonville Comprehensive Plan's Planning Districts Map also identifies several of these properties within the 10th Street Primary Gateway and describes it as the following: "Design elements and infill development within this area should be contemporary in nature to reflect the current development t trends in the area north of the downtown historic district. However, future redevelopment or gateway features between Interstate 65 and Spring Street should also include, or make reference to the historic Train Depot." Desirable Use of the Land & Conservation of Property Values The applicant is seeking to rezone all parcels to C2 because this zoning classification allows their desired future uses of the property of hotels and sit down restaurants. C2 does not allow drive through restaurants. NI — Neighborhood Industrial 2. C1 — Small to Medium Scale Commercial 3. C2 — Medium to Large Scale Commercial 4. R3 - Old City Residential Zoning between adjacent parcels must match in order to merge parcels together and create new lots. Therefore, the zoning in this area needs to be consolidated to a single zoning classification that best matches the desired range of uses for future build out. The applicant has agreed to deed restrict these properties to exclude these uses from future development. "C2" District 4.15 "C2" District Intent, Permitted Uses, and Special Exception Uses District Intent The "C2" (Medium to Large Scale General Commercial) District is intended to provide a land use category for most Targe scale general business uses. The provisions that regulate this land use district should not overly restrict normal business practices. This district can be used adjacent to all other commercial districts and the "R3," "M1" and "M2" residential districts. However, buffering should be provided between this district and any residential district. Jeffersonville's Plan Commission and Board of Zoning Appeals should strive to use this district with the "Cl" District to encourage a strong and stable area for commerce. The Plan Commission and Board of Zoning Appeals should not encourage "strip development", rather development in clusters which share resources and minimize the cost of public utilities and services. C2 zoning will allow these properties to be developed at the highest commercial uses allowed in the City's zoning code, restrict Tess desirable commercial uses, and protect the City's gateway. A public hearing will be held on August 4, 2014 at 7:00 p.m. in the City Council Chambers, lst floor, City Hall, 500 Quartermaster Court, Room 101, Jeffersonville, Indiana at which time and place all interested persons wi be heard in reference to the matters set out in said ordinance.
