AN ORDINANCE ANNEXING CONTIGUOUS TERRITORY
BY VOLUNTARY PETITION
WHEREAS, the L.R. Inman Builders, Inc., the owner of 1.361 acre parcel of land
(hereinafter "the Parcel") located outside of but contiguous to the City of Jeffersonville
(hereinafter "the City") has filed a petition requesting annexation of the Parcel (the "Petition"),
which Petition is attached hereto as Exhibit A and incorporated herein by reference; and
WHEREAS, the Petition was set for public hearing on August 21, 2000 at the regularly
scheduled meeting of the Jeffersonville Common Council (the "Council"); and
WHEREAS, on July 18, 2000, L.R. Inman, President, L.R. Inman Builders, Inc. was
provided written notice of the public hearing of this Voluntary annexation; and
WHEREAS, notice of the public hearing on the Petition was published in the Evening
News on July 22, 2000; and
WHEREAS, after holding a public hearing at its regularly scheduled meeting of
August 22, 2000, the Council finds:
The Parcel is contiguous to the City as required by IC 36-4-3-1.5 except
that at least ¼, instead of 1/8 of the aggregate external boundaries of the
Parcel coincide with the City's boundaries;
The Parcel is needed and can be used by the City for its development in
the reasonably near future.
The City has developed and adopted a written fiscal plan as
memorialized in Resolution 2000-R- ; and
WHEREAS, the Council believes it is in the best interests of the City that the Petition
be granted and the Parcel be annexed into the City;
NOW, THEREFORE, BE IT HEREBY ORDAINED that, pursuant to the provisions
of Indiana Code 36-4-3-5, the Parcel is hereby annexed into the City as a portion of the Fourth
Municipal Legislative District; and
IT IS HEREBY FURTHER ORDAINED that pursuant to the provisions of Indiana
Code 36-4-3-22, the Clerk-Treasurer of the City of Jeffersonville is hereby ordered to
immediately:
1. File this annexation ordinance with the Clark County Auditor, the Clark Circuit Court
Clerk, and the employee of the State Board of Tax Commissioners currently designated by the
Governor as the state certifying official for the Boundary and Annexation Survey of the United
States Bureau of the Census pursuant to the provisions of Indiana Code 6-1.1-30-15, and
2. Record a copy of this annexation ordinance in the office of the Clark County
Recorder.
This Ordinance shall be in full force and effect from and after its passage mad approval.

LEGAL DESCRIPTION
Being a part of Survey No. 21 of the Illinois Grant to Clark County, Indiana and
being further described as follows: Beginning at a magnetic aluminum
monument on the north comer of said Survey No. 21, same being the west
comer of Survey No. 22, and in the line of Survey No. 34; thence S. 49 deg. 58'
44" W. (Basis of Bearings), along the line dividing Survey Nos. 21 and 34,
1455.35 feet to a point in the centerline of the New Albany-Charlestown Pike;
thence S. 55 deg. 33' 19" E., 1109.0 feet to an iron pipe in the centerline of the
Jeffersonville-Charlestown Pike; thence N. 14 deg. 32' 39" E., along said
centerline, 140.55 feet to an iron pin, THE TRUE PLACE OF BEGINNING;
thence continuing N. 14 deg. 32' 39" E., along said centerline, 309.34 feet to a
raikoad spike; thence S. 66 deg. 15' 17" E., 180.00 feet to an iron pin; thence
S. 12 deg. 21' 24" W., 241.06 feet to an iron pin; thence S. 49 deg. 40' 47" W.,
140.00 feet to an iron pin; thence N. 40 deg. 19' 13" W., 130.00 feet to THE
TRUE PLACE OF BEGINNING, containing 1.361 acres, more or less.
Subject to the right-of-C~ay of the Jeffersonville-Charlestown Pike and
all easements and restrictions of record affecting this real estate.
