Home My WebLink About2013-R-31 /6U- RESOLUTION NO. & 1 5-3 COMMON COUNCIL CITY OF JEFFERSONVILLE, INDIANA REGARDING THE AMENDMENT OF THE FALLS LANDING AREA ECONOMIC DEVELOPMENT PLAN WHEREAS, the Jeffersonville ( "City ") Redevelopment Commission ( "Commission ") did on December 22, 1995, adopt a Declaratory Resolution, as amended on December 1, 1999, June 15, 2005 and May 27, 2008 (collectively, as amended, "Declaratory Resolution ") establishing and enlarging the Falls Landing Economic Development Area ( "Area ") and the Declaratory Resolution was confirmed by a confirmatory resolution adopted on February 28, 1996; WHEREAS, the Declaratory Resolution approved the Economic Development Plan, as amended ( "Plan ") which Plan contained specific recommendations for economic development in the Area; WHEREAS, on February 20, 2013, the Commission adopted its Amending Declaratory Resolution with respect to the Area ( "Amending Declaratory Resolution "), for the purpose of amending the Plan to add the construction of projects and improvements as described on Exhibit A to the Amending Declaratory Resolution, together with all necessary appurtenances and related improvements and equipment ( "2013 Plan "); WHEREAS, IC 36 -7 -14 and IC 36 -7 -25 and all acts supplemental and amendatory thereto ( "Act ") require approval of the Amending Declaratory Resolution and the 2012 Plan by the Jeffersonville Plan Commission ( "Plan Commission "), which occurred on February 26, 2013, which approving order is attached hereto as Exhibit B; and WHEREAS, the Act requires the approval of the 2013 Plan, the Amending Declaratory Resolution and the action of the Plan Commission by the Common Council of the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA THAT: 1. The 2013 Plan and the Amending Declaratory Resolution are in all respects hereby modified by the Common Council to include the "Construction of new city marina to include renovation of docks and boat ramps along the Ohio River that is in, serving or benefiting the Area." 2. The actions of the Plan Commission approving the 2013 Plan and the Amending Declaratory Resolution are in all respects hereby modified by the Common Council to include only the "Construction of new city marina to include renovation of docks and boat ramps along the Ohio River that is in, serving or benefiting the Area" as described in Exhibit "A ". 3. The Clerk is hereby directed to file a copy of the Amending Declaratory Resolution, the 2013 Plan and the order of the Plan Commission with the permanent minutes of this meeting. I/2810035.2 4. RESOLUTION AMENDING THE RESOLUTION OF THE JEFFERSONVILLE REDEVELOPMENT COMMISSION ENTITLED "DECLARATORY RESOLUTION OF THE JEFFERSONVILLE REDEVELOPMENT COMMISSION WHEREAS, the Jeffersonville ( "City ") Redevelopment Commission ( "Commission ") did on April 27, 1982 (expansion resolutions adopted on December 19, 2002, May 28, 2003, July 1, 2003 and June 11, 2008; expansion and consolidation resolutions adopted on May 10, 2004 and May 28, 2004; and as further amended on June 29, 2005), adopt a Declaratory Resolution (collectively, as amended, "Declaratory Resolution ") establishing the Falls Landing Riverside Redevelopment Area ( "Area ") and the Declaratory Resolution was confirmed by a confirmatory resolution adopted on May 26, 1982 ( "Confirmatory Resolution "); WHEREAS, the Declaratory Resolution and the Confirmatory Resolution are hereinafter collectively referred to as the "Area Resolution "; WHEREAS, the Area Resolution approved the Redevelopment Plan, as amended ( "Original Plan "), which Original Plan contained specific recommendations for redevelopment in the Area; WHEREAS, the Area Resolution established an allocation area in accordance with IC 36- 7-14-39 for the purpose of capturing property taxes generated from the incremental assessed value of real and depreciable personal property located in the Allocation Area; WHEREAS, the Commission now desires to amend the Area Resolution and the Original Plan to include improvements as described on Exhibit A, together with all necessary appurtenances and related improvements and equipment in, serving or benefiting the Area (collectively, "2013 Projects ") in the list of projects in the Original Plan ( "2013 Plan "); WHEREAS, IC 36 -7 -14 -17.5 authorizes the Commission to amend the Area Resolution, after conducting a public hearing, if it finds that: 1. The amendment is reasonable and appropriate when considered in relation to the Area Resolution, the Original Plan and the purposes of IC 36 -7 -14; and 2. The Area Resolution and the Original Plan, with the proposed amendment, conforms to the comprehensive plan for the City; NOW, THEREFORE, BE IT RESOLVED BY THE JEFFERSONVILLE REDEVELOPMENT COMMISSION THAT: 1. The Area Resolution and the Original Plan are hereby amended to include the 2013 Projects. The 2013 Projects shall be funded in accordance with the bond resolutions and a resolution of the Commission restating Resolution No. 2, adopted by the Commission in 2006 in connection with certain lease financings completed by the City; all of such resolutions are attached hereto and incorporated herein by reference. 1/2961539.1 2. The Commission now finds and determines, after consideration of the evidence presented, that it will be of public utility and benefit to amend the Area Resolution and the Original Plan to include the 2013 Projects. 3. The Commission now finds and determines, after consideration of the evidence presented, that the public health and welfare will be benefited by the amendment to the Area Resolution and Original Plan and the implementation of the 2013 Plan. 4. The Commission now finds and determines, after consideration of the evidence presented, that the proposed amendment above is reasonable and appropriate when considered relation to the Area Resolution; and that the Area Resolution and the Original Plan, with in amendment, conform to the comprehensive plan for the City. the 5. The presiding officer of the Commission is hereby authorized and directed to submit this resolution to the Jeffersonville Plan Commission ( "Plan Commission" for its } s 6 . The Commission also directs the presiding officer, after receipt of the written order of approval of the Plan Conunission which has been approved by the Common Council publish notice of the adoption and substance of this resolution in accordance with IC 5-3-1-4 , to to file notice with the Plan Commission, the Board of Zoning Appeals, the Bull i ng g Commissioner, the Board of Parks and Recreation and any other departments or �a enciees of thg e City concerned with unit planning, zoning variances, land use or the issuance of building permits. The notice must state that snaps and plats have been prepared and can be inspected at the off of the City's department of redevelopment and must establish a date when Commission will receive and hear ren]onstrances and objections from persons interested in affected by the proceedings pertaining to the proposed 2013 Projects and will determine the public utility and benefit of the proposed 2013 Projects. 7 . The Secretary is instructed to submit this resolution to the Common Council for approval of the amendment to the Area Resolution and Original Plan. 8. Construction, establishing and equipping of a technology incubator in the North Port Technology Park that is in, serving or benefiting the Area. 12. Construction, establishing and equipping of an Artist Incubator in downtown Jeffersonville that is in, serving or benefiting the Area. 13. Establishment of Arts and Cultural District in downtown Jeffersonville to include the leasing of certain properties to not -for -profit entities that is in, serving or benefiting the Area. 14. Relocation of certain historical structures consistent with the terms of the settlement agreement entered between the Indiana Department of Transportation and the Kentucky Department of Transportation in reference to the Ohio River Bridges project that is in, serving or benefiting the Area. 15. Construction for widening Thompson Lane including the installation of a stoplight at the intersection of 10 Street and Thompson Lane that is in, serving or benefiting the Area. 16. Improvements to the entrances to the city including signage and lighting that is in, serving or benefiting the Area 17. Development and/or leasing of certain property that was purchased for the storm water conveyance system that is in, serving or benefiting the Area. 18. Acquisition and development of Colston Park that is in, serving or benefiting the Area. 19. Acquisition and development of property located at 300 West Maple Street, 301 West Maple Street and 310 West Maple Street that is in, serving or benefiting the Area. 20. Renovations at City Hall to convert existing Police Department into city offices and city court that is in, serving or benefiting the Area. 21. Installation of billboard on the rear of River State that is in, serving or benefiting the Area. 22. Construction of arbor walk that is in, serving or benefiting the Area. 23. Construction and improvements to Hamburg Pike that is in, serving or benefiting the Area. 24. Construction of the ramp to the Big Four Pedestrian Bridge that is in, serving or benefiting the Area.
