ORDINANCE GRANTING PETITION TO VACATE
A PUBLIC RIGHT-OF-WAY
IN THE CITY OF JEFFERSONVILLE
WHEREAS, on September 3, 2013, The City of Jeffersonville, Clark County,
Indiana, filed his Petition to Vacate a Portion of a Public Right -Of -Way in the City of
Jeffersonville, which public right-of-way is described as a part of The Old Levee in
Block 41 , as shown in Plat Book 19, Page 26 of the Clark County, Indiana records as
described in Exhibit "A" being situated in Jeffersonville, Clark County, Indiana, with the
Jeffersonville Common Council (the "Council"), which petition reads as follows:
PETITION TO VACATE A PUBLIC RIGHT-OF-WAY IN THE CITY OF
JEFFERSONVILLE; and
WHEREAS, notice of a public hearing on the City's Petitio to Vacate the Public
Right -Of -Way was published in the Evening News on August ook , 2013 and
WHEREAS, notice of a public hearing on the City's Petition to Vacate was mailed
by certified mail to each owner of land that abuts the property; and
WHEREAS, on September 3, 2013 at 7:00 pm the Council held a public hearing on
the City's Petition and made the following findings:
1. The best use of the property would be to vacate it, as it is not needed or used for
ingress or egress for any purpose.
2. The vacation of the property as described herein would not injure the public
health, safety, welfare or morals of the community.
3. It would be in the best interest of the City Council to grant the City's Petition to
vacate the property.
NOW, THEREFORE, IT IS HEREBY ORDAINED, pursuant to the provisions
of I.C. 36-7-3-12, that the public right -of- way described as being a part of The Old
Levee in Block 41 , as shown in Plat Book 19, Page 26 of the Clark County, Indiana
records as described in Exhibit "A" being situated in Jeffersonville, Clark County,
Indiana, is hereby vacated and the owners are hereby required to record a copy of
this Ordinance in the office of the Clark County Recorder and deliver a copy of this
Ordinance to the Clark County Auditor.

Notice is hereby given that The City of Jeffersonville, Clark County, Indiana
has filed a Petition with the Jeffersonville City Council, Jeffersonville, Indiana asking for
the vacation of an abandoned portion of the right-of-way of a part of 10 Foot Alley in
Block 41, totaling approximately 2035 square feet located in Jeffersonville, Clark
County, Indiana, described as Exhibit "A" of the Petition and being situated in
Jeffersonville, Clark County, Indiana.
A public hearing will be held on September 3, 2013 at 7:00 p.m. in the Council
Chambers, Jeffersonville City Hall, 500 Quartermaster Court, Jeffersonville, Indiana at
which time and place all interested persons will be heard in reference to the matters set
out in said petition.

PETITION TO VACATE A PUBLIC RIGHT-OF-WAY
IN THE CITY OF JEFFERSONVILLE
Petitioner, City of Jeffersonville, petitions the City Council to vacate the public right-of-way
located on a piece of property more specifically described as a part of 10 Foot Alley in Block 41,
as shown in Plat Book 19. Page 26 of the Clark County, Indiana records described as Exhibit
"A", being situated in Jeffersonville, Clark County, Indiana.
In support of this petition, the City states as follows:
1. The names and addresses of all owners of land abutting the property are:

Being a part of a 10 foot wide alley in Block 4I, in the City of Jeffersonville, Clark County, Indiana and
being further described as follows:
Beginning at a steel pin on the north corner of Lot 21 in said Block; Thence S.36.03'479E., along the
southwest Right -of -Way line of Fulton Street, 83.78 to the northwest Iine of said 10 foot wide alley, THE TRUE
PLACE OF BEGINNING:
Thence continuing S.36.03'47"E., along said Right -of -Way line, 10.03 feet to the southeast line of said
Alley:
Thence S.58.23'W., along said southeast line, 203.92 feet;

PROPOSED PROJECT EXPANSION IN JEFFERSONVILLE FOR:

This office is the Corporate Headquarters for 5 other locations in Indiana, Kentucky and Ohio.
The Corporation now has 72 employees and would expect this expansion to hire 30 to 35 more
employees at corporate over a 5 year period. Current minimum wage is $14.00 per hour but this
expansion will involve persons in excess of $50,000 per year with some in excess of $100,000.
IAC bought the old building of Bob Swenson's business and Darling Boat Fabrication being located next
door to Kempf Heating & Cooling. IAC also purchased additional ground and buildings from Van Gilder
Heating & Cooling (of which they have demoed these structures). There is one rental house facing
Fulton Street that can be purchased and also demolish to complete this package proposed.
The proposed expansion to be approximately 20,000 SF with demolition of the Darling Boat Fabrication
Building and a portion of the Swenson Building and addition and remodel of portions of the existing
Swenson Building. There will also be enclosed carport type building to house company vehicles and
trailers and an enclosed fenced compound.
The new steel metal building will include crane rail system, state of the art paint booth for large
commercial air compressor rebuilding. The estimated eve height at this point maybe 14 feet to 16 feet.
The existing Swenson building will house more conference rooms, newer restrooms and part storage
and shipping.
IAC is requesting if Zoning is currently proper for this expansion and if not what will be required from
the Plan Commission and BZA as well as the City Council to move this project forward quickly. Also the 2
alleys behind the project, IAC would like to vacate the portion directly behind and provide a portion of
their property to the west to reconnect the 2 alleys. Finally with the $800,000 to $1,000,000 estimated
construction and improvements, additional jobs and new equipment IAC would like to submit for tax
abatement on the project.
Time line for the project is immediate once all approvals are met as quickly as possible. If the City feels
this is a valid project for the request and approval so we can proceed with preliminary design to present
to all parties. The biggest delay is the Metal Building Design and order placement. This will be a
design/build project with The Estopinal Group and K M Stemler Corporation.
The goal is to have a structure up by December 2013.
