Home My WebLink About2013-R-14 RESOLUTION AMENDING THE RESOLUTION OF THE JEFFERSONVILLE REDEVELOPMENT COMMISSION ADOPTED ON FEBRUARY 20, 2013, ENTITLED "RESOLUTION AMENDING THE RESOLUTION OF THE JEFFERSONVILLE REDEVELOPMENT COMMISSION ENTITLED "DECLARATORY RESOLUTION OF THE JEFFERSONVILLE REDEVELOPMENT COMMISSION" RESOLUTION NO. O13- R- V1 WHEREAS, the City of Jeffersonville ( "City ") Redevelopment Commission ( "Commission ") adopted a declaratory resolution on December 22, 1995, as amended on December 1, 1999, June 15, 2005 and May 27, 2008 (collectively, as amended, "Original Declaratory Resolution ") establishing and enlarging the Inner City Road Economic Development Area ( "Area "), and the Original Declaratory Resolution was confirmed by a confirmatory resolution adopted on February 28, 1996 ("Confirmatory Resolution "); and WHEREAS, the Original Declaratory Resolution approved the Economic Development PIan, as amended ( "Plan "), which contained specific recommendations for economic development in the Area; and WHEREAS, on February 20, 2013, the Commission adopted its Amending Declaratory Resolution ( "Amending Declaratory Resolution "), for the purpose of amending the Plan to include the construction of projects and improvements as described in said Amending Declaratory Resolution, incorporated herein by reference, to the Amending Declaratory Resolution, together with all necessary appurtenances and related improvements and equipment in, serving or benefiting the Area (hereinafter referred as the "2013 Projects ") in the list of projects in the Plan; and WHEREAS, the Commission submitted the Amending Declaratory Resolution and supporting data to the Jeffersonville Plan Commission ( "Plan Commission ") and the Plan Commission has issued its written order approving the Amending Declaratory Resolution and the Plan; and WHEREAS, the Common Council of the City, by resolution No. 6 adopted on April 1, 2013, amended the order of the Plan Commission; and WHEREAS, the Commission has found that there will be no residents of the Area who will be displaced by the 2013 Projects; and WHEREAS, the Commission published notice in The Evening News of the adoption and substance of the Amending Declaratory Resolution in accordance with IC 36- 7 -14 -17 and IC 5- 3-1 on April 12, 2013, which notice also gave notice of a hearing on the proposed 2013 Projects to be held by the Commission; and WHEREAS, the notice described in the preceding paragraph was also filed in the office of the Plan Commission and any other departments, bodies or officers having to do with City planning, variances from zoning ordinances, land use or the issuance of building permits; and I/2810064.1 WHEREAS, the Commission on April 24, 2013, conducted a public hearing at which the Commission heard all persons interested in the proceedings and considered all written remonstrances and objections that were filed; NOW, THEREFORE, BE IT RESOLVED BY THE JEFFERSONVILLE REDEVELOPMENT COMMISSION THAT: 1. The Commission has considered the evidence presented and now finds and determines that it will be of public utility and benefit to proceed with the proposed amendment to the Plan. 2. The Amending Declaratory Resolution and Plan, as amended, approved by the Commission on February 20, 2013, copies of which are attached hereto and incorporated herein, are hereby confirmed. 3. The Common Council modified the Amending Declaratory Resolution to the extent that the Common Council only approves the following specific projects: (1) the Big Four Ramp project; the Big Four Station project; (3) the Flood Wall Opening project; (4) the Chestnut Street Reconstruction project; and (5) the Thompson Lane project. 4. The Amending Declaratory Resolution, is confirmed as amended by the Common Council to the extent of those projects as identified in the preceding paragraph, shall be attached to and incorporated in this resolution. The 2013 Plan and the Amending Declaratory Resolution are in all respects hereby MODIFIED by the Common Council to the extent that the Common Council only approves the approves the following specific projects: (1) the Big Four Ramp project; (2) the Big Four Station project; (3) the Flood Wall Opening project; (4) the Chestnut Street Reconstruction project; and (5) the Thompson Lane project. 2.
