HomeMy WebLinkAbout1995-R-6 i i 1 ce r 2 7 i qt 71f G all61 / 6 �/ 1"1, Z /cc � i t i i s N NO. 6 -95 RESOLUTION < r ' DECLARATORY RESOLUTION OF THE t JEFFERSONVILLE REDEVELOPMENT COMMISSION WHEREAS, the City of Jeffersonville ( "City ") Redevelopment Commission I ( "Commission ") has investigated, studied and surveyed economic development areas within the corporate boundaries of the City; and I WHEREAS, the Commission has selected an economic development area to be developed under IC 36 -7 -14 and IC 36 -7 -23 (collectively the "Act "); and f t i WHEREAS, the Commission has prepared an economic development plan ( "Plan ") for , Cr the selected economic development area, which Plan is attached to and incorporated by reference in this resolution; and WHEREAS, the Commission has caused to be prepared: (1) Maps and plats showing: (A) the boundaries of the economic development area, the location of various parcels of property, streets, alleys, and other features affecting the acquisition, clearance, replatting, replanning, rezoning or economic development of the area, indicating any parcels of property to be excluded from the acquisition; and (B) the parts of the acquired areas that are to be devoted to public ways, levees, sewerage, parks, playgrounds, and other public purposes under the Plan; (2) Lists of the owners of the various parcels of property proposed to be acquired; and (3) An estimate of the cost of acquisition, redevelopment and economic development; and WHEREAS, IC 36 -7 -14 -39.3 authorizes the Commission to modify the definition of ( property taxes in IC 36- 7- 14 -39(a) for the purposes of including taxes imposed under IC 6 -1.1 on the depreciable personal property of a designated taxpayer and all other depreciable property located and taxable on the designated taxpayer's site of operations within the allocation provision included in a declaratory resolution; and] WHEREAS, the Commission has caused to be prepared a factual report ( "Report") in 55 r y _ y Cie a. The attraction and retention of permanent jobs; b. An increase in the property tax base; c. Improved diversity of the economic base; and d. Improved traffic circulation; and e. Upgrading of sanitary sewer conditions. 6. The plan for the Economic Development Area conforms to other development and redevelopment plans for the City. 7. The Commission does not now propose to acquire interests in real property within the boundaries of the ICRED Area. If the Commission determines that it is necessary to acquire Art real property in the ICRED Area, it will amend the Plan and this Resolution P rior to any acquisition. 8. The Commission estimates that the cost of implementing the Plan will not exceed $ 13,600,000 . 9. The Commission finds that no residents of the ICRED Area will be displaced by any project resulting from the Plan; and, therefore, the Commission finds that it does not need to give consideration to transitional and ermanent p provisions for adequate housing for the residents. If the Commission determines that it is necessary to displace any residents of the ICRED Area, it will amend the Plan and this Resolution prior to any displacement and give consideration to transitional and permanent provisions for adequate housing for the residents. 10. This paragraph shall be considered the allocation provision for the purposes of IC 36- 7- 14 -39. The entire ICRED Area shall constitute an allocation area as defined in IC 36 -7 -14- 39. Any property taxes levied on or after the effective date of this resolution by or for the benefit of any public body entitled to a distribution of property taxes on taxable property in the allocation area shall be allocated and distributed in accordance with IC 3- 7- 14 -39. The Commission hereby modifies the definition of property taxes in IC 36-7-14-39(a) 3-7-14-39. [ The for the purposes of including taxes imposed under IC 6 -1.1 on the depreciable personal property of the designated taxpayer described below and all other depreciable property located on and taxable on (6, the designated taxpayer's site of operations within the allocation provision included in a declaratory resolution.] This allocation provision shall expire no later than 30 years after the effective date of this resolution. 11. All of the rights, powers, privileges, and immunities that may be exercised by the Commission in a Redevelopment Area nr 1Trha PAnA11,.11 .?s I 1 CV 12. The presiding officer of the Commission is hereby authorized and directed to submit this resolution, the Plan, and the Report to the Jeffersonville Plan Commission for its approval. 13. The Commission also directs the presiding officer, upon receipt of the written order of approval of the Jeffersonville Plan Commission which has been approved by the Common Council to publish notice of the adoption and substance of this resolution in accordance with IC 5 -3 -14 and to file notice with the Jeffersonville Plan Commission, the Board of Zoning Appeals, the Board of Public Works, the Park Board, the building commissioner and any other departments or agencies of the City concerned with unit planning, zoning variances, land use or the issuance of building permits. The notice must state that maps and plats have been prepared and can be inspected at the office of the City's department of redevelopment and must establish a date when the Commission will receive and hear remonstrances and objections from persons interested in or affected by the proceedings pertaining to the proposed project and will determine the public utility and benefit of the proposed project. Copies of the notice must also be filed with the officer authorized to fix budgets, tax rates and tax levies under IC 6- 1.1 -17 -5 for each taxing unit that is either wholly or partly located within the proposed allocation area. 14. The Commission also directs the presiding officer to prepare or cause to be prepared a statement disclosing the impact of the allocation area, including the following: (A) The estimated economic benefits and costs incurred by the allocation area, as measured by increased employment and anticipated growth of real property, personal property and inventory assessed values; and (B) The anticipated impact on tax revenues of each taxing unit that is either wholly or partly located within the allocation area, A copy of this statement shall be forwarded to each such taxing unit with a copy of the notice required under Section 17 of the Act at least 10 days before the date of the hearing described in Section 14 of this Resolution. 15. The Commission further directs the presiding officer to submit this resolution to the Common Council for its approval of the establishment of the Inner City Road Economic Development Area. pi p 3 tof { NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION THAT: 1. The Commission has selected as an economic development area an area within its corporate boundaries, which area the Commission is hereby designating as the Inner City Road Economic Development Area ( "ICRED Area "), and which ICRED Area is described in Exhibit A. 2. The Commission finds that the Plan for the ICRED Area a. Promotes significant opportunities for the gainful employment of the citizens of the City; b. Attracts major new business enterprises to the City; c. Retains or expands a significant business enterprise existing in the City; %No d. Benefits the public health, safety, morals and welfare of the citizens of the City; e. Increases the economic well - being of the City and the State of Indiana; and f. Serves to protect and increase property values in the City and the. State of Indiana. 3. The Commission finds that the Plan cannot be achieved by regulatory processes or by the ordinary operation of private enterprise without resort to the powers allowed the Commission under IC 36 -7 -14 because of: a. The lack of local public road and sewer improvements; b. Existence of conditions that lower the value of the land below nearby land; and • c. The lack of ublic facilities needed for p potential industrial and commercial development to be realized. 4. The Commission finds that the public health and welfare will be benefited by the accomplishment of the Plan for the Area, specifically by: a. Providing for safer traffic conditions; b. Decreasing the likelihood of through traffic in residential neighborhoods; and c. Correcting health conditions through improved sanitary sewer facilities. G T1 n • • r . __ _ I 16. INNER CITY ROAD PROJECT FEASIBILITY STUDY REPORT On December 19, 1994, the Common Council of the City of Jeffersonville authorized the Department of Redevelopment to proceed with a feasibility study of the Inner City Road Project. Work items which were to be included in this study were Project Cost, Development Potential, and Financial Strategy. The team of individuals which was involved in this process includes: Bobby Potter, City Council of Jeffersonville Barbara Wilson, City Council of Jeffersonville Steve Stemler, City Council of Jeffersonville Jorge Lanz, Jacobi Toombs & Lanz Brian de St. Croix, SIEDC Gary Malone, H. J. ' l y Umba�:gh & Associates y Buddy Downs, Ice Miller Donadio & Ryan Carroll G. Gowens, Department of Redevelopment Meetings were held on Tuesday, January 10, 1995, Wednesday, February 15, 1995, and Tuesday, March 14, 1995, to discuss the work items which are a part of this report. r : ' Before detailed discussion is presented regarding the study's work items, several recommendations must be stated which have developed from extensive discussion among the Team members and also from input given by regional commercial /industrial realtors (See Exhibit A) . * The Team recommends that the alignment of the Inner City Road Corridor be changed to encompass New Albany - Charlestown %. Pike and Holmans Lane (See Exhibit B). * The Team recommends that the Inner City Road Project be constructed in two phases, thereby allowing the City to be encumbered with less debt service from the bond issue used to fund the construction of this project. * The Team recommends that the TIF District which will be developed to allow for the issuance of TIF bonds be extended to include the corridor along SR 62 between Holmans Lane and I -265. The Realtors believe that this area will see significant commercial development within 3 -5 years. * The Team recommends that sanitary sewer extensions be constructed along SR 62 to provide potential developments with ready access to sewer service. The Realtors have been emphatic from this study's outset that access to utilities will be a crucial factor if the City expects development to occur along the Inner City Road Corridor. (10 * The Team recommends that the City CLEARLY delineate the path of the Inner City Road Corridor in ALL planning documents so as to preserve the corridor for future phase construction. I Ar Ile PROJECT COST The first work item involves Project Cost. The Team has developed cost estimates for Phase 1 and Phase 2 of the Inner City Road Project and for Sanitary Sewer Extensions along SR 62, as exemplified below: PHASE 1: INNER CITY ROAD, FROM SR 31 TO NEW ALBANY - CHARLESTOWN PIKE t This phase includes a bridge overpass on SR 31 /Conrail Railroad tracks, five (5) lanes from SR 31 to about 300' southeast of Hamburg Pike, three (3) lanes from about 300' southeast of Hamburg Pike to New Albany - Charlestown Pike, the realignment of a section of New Albany - Charlestown Pike to intersect the new Inner City Road, a traffic signal at Hamburg Pike, improving Hamburg Pike south 700' and north 300' (total of 1000') and a new crossing at the CSX railroad tracks. t Estimated Construction Cost = $ 2,247,500 Estimated Right -of -Way Acquisition Cost = $ 275,000 Estimated Design & Inspection Costs = g p $ 239,315 Cle Total Estimated Phase 1 Project Cost = $ 2,761,815 PHASE 2: INNER CITY ROAD, FROM NEW ALBANY - CHARLESTOWN PIKE TO A POINT ON HOLMANS LANE WHERE THE SR 62 /ALLISON LANE INDOT PROJECT TERMINATES This phase includes the realignment of the horizontal curve at New Albany - Charlestown Pike and Holmans Lane, a new signalized intersection at Holmans Lane and Jeffersonville- Charlestown Pike, the widening of Holmans Lane to provide a minimum of two (2) 12 -foot traffic lanes with turn lanes at the major street intersections to the point at which the INDOT project terminates approximately 700' north of SR 62. Estimated Construction Cost = $ 1,845,000 Estimated Right -of -Way Acquisition Cost = $ 300,000 Estimated Design and Inspection Cost = $ 223,375 { Total Estimated Phase 2 Project Cost = $ 2,368,375 GRAND TOTAL PHASE 1 AND PHASE 2 COST = $ 5,130,190 (10* } FS i t SANITARY SEWER EXTENSIONS The extensions to the current Sanitary Sewage Collection System are required to provide this service to proposed annexation /TIF areas that will be part of the overall Inner City Road Project. These are as follows: PART 1: TRUNK SEWER FROM MILLCREER PUMP STATION TO ALLISON LANE - - ON SR 62 Estimated Total Project Cost = $ 1,652,425 PART 2: TRUNK SEWER AND PUMP STATION BETWEEN ALLISON LANE AND I- 265 ON SR 62 Estimated Total Project Cost = $ 1,068,480 1 TOTAL SEWER PROJECTS COST = $ 2,720,905 These estimates include construction, right -of -way acquisition, design and inspection costs, and have been used as a basis for the creation of the Team's financial strategy recommendations. DEVELOPMENT POTENTIAL The area impacted by the proposed Inner City Road is generally east of I -65 and south of I -265 along the following road corridors: State Road 62, Hamburg Pike, New Albany- Charlestown Pike and Jeffersonville - Charlestown Pike. For data collection and analysis purposes, the area can be defined by 1990 Census Tracts 503.04, 506.01, and 506.03, with Census Tract 506.01 being the largest area and the most likely recipient of development generated by the construction of the Inner City Road. Traffic Zone data for Zones 623, 624, 625, 633, 634, 636, 637, 638, 640, and 642, which are congruent to the three census tracts, will also be utilized to predict development potential of the Inner City Road Corridor. Having analyzed the data available for the Inner City Road Corridor area, the Team has determined that the area to be impacted by the Inner City Road, particularly Census Tract 506.01, is one of the premier development areas in Jeffersonville. In 1990, while the Louisville MSA and Clark County were losing population and Jeffersonville was increasing by only slightly over one (1) percent, the Inner City Road Corridor area gained about 8 percent including a 23 percent gain for Census Tract 506.01. By the year 2010, this area is expected to grow by over 18 percent from 12,939 people in 1990 to 15,296 by 2010. Census Tract 506.01 is expected to achieve a growth of over 28 percent or 1362 persons. These population projections represent only a portion of what might be expected if the Inner City Road becomes a reality. This road, At however, will not only affect population. Again, Census Tract 506.01 is expected to lead the way with a gain of over 87 percent. The total employment gain is expected to be about 600 jobs for a total in 2010 of approximately 1700 jobs. More specifically, non - retail employment is projected to increase by nearly 47 percent or 300 jobs for a total of about 1000 jobs by 2010. As expected, the largest gain - over 90 percent or 250 jobs - is anticipated in Census Tract 506.01. One important feature of this project that the Realtors discussed was the road's proximity to the new I -65 Interchange. They believe that significant development will occur very rapidly around the interchange, both before and after its construction. Once the interchange has been built, however, the additional access provided and a general shortage of commercial /industrial land in Louisville will make the area along the Inner City Road Corridor even more lucrative. Two areas along the Corridor were targeted by the Realtors as "hot spots ": the area between SR 31 and New Albany- Charlestown Pike and the area between Holmans Lane and I -265 along SR 62. The estimated time frame for development in these areas is 1 -3 years for the Northern leg of the Corridor and 3 -5 years for the Southern leg. Types of development which have been predicted for the Corridor include primarily office /warehouse, light manufacturing, and distribution center development. A light smattering of strip retail development may appear along New Albany - Charlestown Pike and Holmans Lane, including banks, fast food restaurants, and convenience centers. These developments would be located in close proximity to residential areas. M1 ir Ihw Two factors which the Realtors indicated would be KEY to the success of the Inner City Road Project were utility access and zoning. The Realtors indicated to the Team that development recruitment would be difficult, at best, if utilities were not available when sites were purchased. In addition, the City must take responsibility now to ensure that all developable areas are properly zoned for commercial /industrial development. FINANCIAL STRATEGY The financial strategy of the Inner City Road Project involves three major steps: 1. The City will annex key areas which are along the Inner City Road Corridor to allow for the formation of a TIF (Tax Increment Financing) District (See Exhibit C). 2. The City will create a TIF District which includes the Inner City Road Corridor and prime commercial /industrial real estate around the Corridor (See Exhibit D). 3. The City will issue bonds to fund design and construction of Phase 1 of the Inner City Road Project. Monies to be used in repayment of these bonds will be captured from assessed improvements in the TIF District. Funding options and sources for Phase 2 will be explored at a later date. C e City officials are currently discussing an Inter -Local Agreement with the Town of Clarksville to finance construction of the Inner City Road. Joint costs of construction will be negotiated between the municipalities and the State. Payment of those costs is not addressed in this report. Four schedules of financial information have been included in this report which exemplify the Phase I investment and the development needed to support a bond issue of that size (See Exhibit E). If the City chooses to finance Phase #1 of the Inner City Road Project in this manner, further cost analyses will be done using final budget figures and realistic projections of new development to be s` located in the TIF District. SUMMARY In summary, the Inner City Road Project is located in the section of Jeffersonville with the most potential for growth. The development of this thoroughfare will not only provide easy access }' to the interstate system and other major arterials thereby creating convenient residential opportunities, but will also enhance the marketability of the proposed Inner City Road Corridor for commercial and industrial use The greatest value of this road's construction, however, will be to provide easy interstate access to ri, prime commercial /industrial development areas in the City of Jeffersonville, which are presently an untapped asset for the City's overall growth. Without the Inner City Road, the corridor CIW is likely to continue its relatively slow growth pattern, primarily through residential development, intermittent retail establishments and occasional examples of light industrial or non - retail operations.
