property located at the foot of Spring Street along the Ohio River in
the City of Jeffersonvilleo (Property is illustrated on Exhibit A,
attached herewith); and,
~I~qEAS, the ~/layor desires to designate the Coamon Council to
~ve notice and to conduct a public hearing and to notify the Mayor
of recommendations regarding the disposal of such propertyby lease
pursuant to IC 36-1-11-3; and,
WHEREAS, the Ccamon Council has determined that the property
shown in Exhibit A, attached herewith, cannot be feasibly disposed of
under IC 36-1-11-10 (Lease of property; procedure) because of
difficulties in appraising such property, and because of additional
public in~provements that will be required if a riverboat facility is
constructed thereon;

1. The Mayor hereby designates the Ccamon Council to give
notice and to conduct a public hearing, and to notify the Mayor of
recuul~ndations regarding the disposal of such property by lease
pursuant to IC 36-1-11-3.
2. The Coumon Council hereby determines that the property
shown in Exhibit A, attached herewith, cannot be feasibly disposed of
under IC 36-1-11-10 (Lease of property; procedure) because of
difficulties in appraising such property, and because of additional
public improvements that will be required if'a riverboat facility is
constructed thereon.
3. The Cu~,,~n Council hereby rejects the proposed lease
between the City and its Parks Department and the Star of Louisville,
Inc., for the operation of a floating restaurant at the Spring Street
site. Such approval or rejection is required under IC
36-1-11-3(b)(2)(lease for mere than $3000.00 annually) and IC
36-1-11-10(f)(lease for mere than three years). Rejection is
appropriate because the property was advertised for bid prior to the
authorization of riverboat gan~lingby the Indiana Legislature.
4. The Mayor hereby grants authorization to the Ccamon Council
to use provisions of IC 36-1-11~12 (Lease of property: Request for
Proposal).
5. The C~aDn Council has reviewed a "Request for Proposal to
Lease Property for Development and Operation of Riverboat G~ming
Facility" (Exhibit B, attached herewith) and hereb~ approves the
Request for Proposal, certifying that all necessary statements are
contained therein.
6. Notice of the "Request for Proposal" shall be given by
publication in accordance with IC 5-3-1 as soon as possible after the
passage of this resolution.
7. Upon passage of these resolutions by the Ccrm~ncouneil and
approval by the ~yor of the City of Jeffersonville, copies of the
Request for Proposal may be distributed to any interested persons
and/or entity.
