HomeMy WebLinkAbout2012-R-12 i Y 4 ' coe BY THE REDEVELOPMENT COMMISSION FOR THE CITY OF JEFFERSONVILLE, INDIANA , 01) — k RESOLUTION NO 1 (;\ A RESOLUTION ADOPTING A LIST OF REAL PROPERTY INTERESTS TO BE ACQUIRED AND THE PRICES TO BE OFFERED TO THE OWNERS OF SUCH PARCELS 1;i,, WHEREAS, the Jeffersonville Redevelopment Commission (the "Commission ") was i duly created by the City of Jeffersonville, Indiana (the "City "); and WHEREAS, during its August 26, 2010 meeting the Commission found that (i) the areas shown on the maps attached hereto as Exhibits Al, A2, A3 and A4 (collectively, the "Redevelopment Project Areas "), and the parcels identified in Exhibit B attached hereto k (collectively, the "Parcels "), constitute area(s) needing redevelopment because of repeated flooding and one or more of the conditions set forth in Ind. Code § 36- 7 -1 -3, (ii) such conditions cannot be corrected by regulatory processes or the ordinary operations of private enterprise without resort to Ind. Code § 36 -7 -14, and (iii) the public health and welfare will be benefited by f i rillio the acquisition, clearing and redevelopment of the Parcels; and ,, WHEREAS, the Commission caused to be prepared all items required by Ind. Code § 36- i 7- 14 -15, including maps and plats in compliance with the statute, lists of the owners of the Parcels, and an estimate of the costs, if any, to be incurred for the acquisition and redevelopment of the Parcels; and WHEREAS, during its August 26, 2010 meeting, the Commission adopted its resolution 2010 -R -12, wherein the Commission declared that (i) Redevelopment Project Areas are a menace to the social and economic interest of the City and its inhabitants, (ii) it will be of public utility and benefit to acquire the Redevelopment Project Areas and redevelop them under Ind. x Code § 36 -7 -14; and (iii) the Redevelopment Project Areas are designated as a redevelopment g; project are for the purposes of Ind. Code § 36 -7 -14; and WHEREAS, pursuant to Ind. Code § 36- 7- 14 -16, said resolution was approved by (i) the Jeffersonville Plan Commission on August 31, 2010, by its resolution 2010 -R -02 and (ii) the Jeffersonville Common Council on September 7, 2010, by its resolution 2010 -R -24; and k. WHEREAS, pursuant to Ind. Code § 36- 7- 14 -17, the Commission published notice, in accordance with Ind. Code § 5 -3 -1, of (i) the adoption and substance of the resolution, (ii) the (111'00 date for public hearing with respect to the actions to be taken under the resolution and (iii) the availability of the maps and plats for public inspection; and r 1 , i Ei (11, WHEREAS, pursuant to Ind. Code § 36- 7- 14 -17, and in accordance with the published public notice, the Commission held a public hearing on October 6, 2010 during which all persons interested in the proceedings were heard, all written remonstrances and objections were considered and the Commission, after considering the evidence presented, confirmed its resolution; and WHEREAS, no appeals were made pursuant to Ind. Code § 36- 7- 14 -15; and WHEREAS, the Commission has received a grant from the Indiana Housing and x` Community Development Authority ( "IHCDA ") Supplemental Disaster Recovery Appropriation -2 Community Development Block Grant Program (the "IHCDA Grant ") for the purpose of acquiring, demolishing and relocating the owners of a portion of the Parcels (the "IHCDA Grant Parcel(s) "); and WHEREAS, the IHCDA Grant expires on December 31, 2012 and the Commission has requested a six -month extension of the term to ensure adequate time to complete all grant activities, which extension request is still pending at IHCDA; and WHEREAS, the Commission is prepared to proceed with the acquisition of such parcels notwithstanding the pending status of the extension request, and has obtained all necessary appraisals required by the Uniform Relocation Assistance and Real Properties Acquisition Policies Act of 1970, as amended, and the implementing regulations at 49 CFR Part 24 (the "URA "); and WHEREAS, the Commission is adopting this resolution pursuant to Ind. Code § 36 -7 -14- 19 in order to (i) approve the acquisition of each IHCDA Grant Parcel, which IHCDA Grant Parcels are listed on Exhibit C attached hereto and (ii) the price to be offered to the owner of each IHCDA Grant Parcel, which price shall be the price set forth in the review appraisal for each IHCDA Grant Parcel, as shown on the list attached hereto as Exhibit C. NOW, THEREFORE, BE IT RESOLVED by the Commission as follows: 1. The foregoing recitals are incorporated herein as a substantive part of this resolution. 2. In connection with the acquisition of the IHCDA Grant Parcels in the Redevelopment Project Areas, the Commission hereby approves and adopts (i) the list of IHCDA Grant Parcels to be acquired and (ii) the prices to be offered to the owners of such parcels, all as t ie set forth on the list attached hereto as Exhibit C. 2 } (11, 3. The Commission hereby authorizes the Redevelopment Director, and /or attorneys or other third parties engaged by the Commission for such purpose, to make offers and negotiate for the acquisition of the IHCDA Grant Parcels, but the Commission shall not be bound by any agreement to purchase any of the IHCDA Grant Parcels until the Commission shall have approved and accepted such agreement, including any negotiated purchase price that exceeds the offer prices adopted herein. 4. The Commission further authorizes the Redevelopment Director, and /or attorneys or other third parties engaged by the Commission for such purpose, to determine the amount of relocation assistance that any occupant of IHCDA Grant Parcel shall be entitled to under the #' relevant provisions of the URA and to provide an estimate of such relocation assistance payment to the such occupant in connection with the negotiation process.
