HomeMy WebLinkAbout1994-R-22 RESOLUTION FOR THE ESTABLISHMENT OF A TAG-BASED YARD WASTE MANAGEMENT SYSTEM IN JEFFERSONVILLE WHEREAS, the Indiana legislature has mandated that vegetative waste matter be collected separately from ordinary refuse after June 30, 1994, and; WHEREAS, the Indiana legislature has prohibited the landfilling of vegetative waste matter after September 30, 1994, and; WHEREAS, a separate system for the Collection and processing of vegetative waste matter will result in a substantial additional expense to the City for which funds are not available, and; WHEREAS, research and experience has shown that careful landscape management may ~'eatly reduce or even eliminate the generation of waste vegetative matter, and; WHEREAS, the City of Jeffersonville vigorously encourages all citizens and businesses to manage their properties so that the generation of vegetative waste matter is minimized. THEREFORE, the City Council of the City of Jeffersonville does hereby resolve to establish a tag- based system for the collection and processing of vegetative waste matter to take effect on July 1, 1994. For the purposes of this resolution, vegetative waste matter includes any yard or landscape waste, including but not limited to leaves, grass, brush, Cin'istmas trees, limbs, branches and tree trunks up to six (6) inches in dian~eter originating from residential sources which has not been processed or otherwise degraded, decomposed, shredded, chemically or biologically stabilized or otherwise prepared for beneficial reuse. After June 30, 1994, all vegetative waste matter set out for collection by municipal waste collection forces, or by private waste collection conuactor under franchise contract to the City, must be separated from regular refuse. Vegetative waste matter set out for collection after June 30, 1994 must be contained in any specially-marked peruranent metal or plastic yard waste container with a maximum capacity of thkty-three (33) gallons or fifty (50) pounds whichever is less, any ninety (90)-gallon specially-marked yard waste container designed roi: semi-automatic or automatic collection, or in biodegradable brown paper bags of a capacity not to exceed thh-ty-thi-ee (33) gallons or fifty (50) pounds whichever is less. After June 30, 1994, plastic bags o~ any type are no longer acceptable for the disposal of vegetative waste matter in Jeffersonville. Page 1 All vegetative waste matter set out for collection after July 31, 1994 must have one (1) Jeffersonville City yard waste disposal tag attached for each thirty-three (33) gallons or each fifty (50) pounds of vegetative waste material, or any portion thereof. Vegetative matter collection containers of capacity in excess of thirty-three (33) gallons must include one Jeffersonville City yard waste disposal tag for each thirty-three (33) gallons of capacity or any portion thereof which is included within the container. Any limbs set out for collection after June 30, 1994 must be bound in bundles no greater than eighteen (18) inches in diameter and no more than fora' (4) feet in length. Each limb bundie must include one Jeffersonville City yard waste tag. No vegetative .waste matter will be collected under City authority unless a Jeffersonville City yard waste tag is attached thereto. Jeffersonville City yard waste tags will be available for pm'chase by the public at many local grocery stores, garden centers, and at the office of the Clark County Solid Waste Management District. The cost of each Jeffersonville City yard waste tag shall be based on the actual cost of vegetative waste management in Jeffersonville and this cost may vtuT annually based on the previous years experience.
