HomeMy WebLinkAbout1997-OR-46 Ordinance No. 97.OR- 44 AN ORDINANCE REPEALING AND REPLACING ORDINANCE NO. 93 -OR -66 ESTABLISHING RETIREE'S HEALTH INSURANCE BENEFITS FOR CITY EMPLOYEES WHEREAS, the City of Jeffersonville ( "the City") presently offers its full - time employees healthcare insurance benefits during their employment with the City; and WHEREAS, in Ordinance No. 93- OR -66, the Common Council of the City of Jeffersonville ("the Council ") previously established retirees' health insurance benefits for City employees pursuant to the provisions of I.C. 5 -10 -8 et seq.; and WHEREAS, the provisions of I.C. 5 -10 -8 et seq. have been amended since the Council adopted 93- OR -66; and WHEREAS, the Council now wishes to update the provisions of the City Ordinance establishing its retirees' health insurance benefits; NOW THEREFORE, BE IT HEREBY ORDAINED by the Council that the provisions of Ordinance No. 93 -OR -66 are hereby repealed and replaced, effective September 1, 1997, with the following: SECTION I — DEFINITIONS 1) City shall mean the incorporated City of Jeffersonville, Indiana. 2) Retired City Employee shall mean a City employee who: a) leaves employment with the City after June 30, 1986; and b) has completed twenty (20) years of full -time employment with a public employer (as defined in I.C. 5- 10 -8 -1), ten (10) years of which are completed immediately preceding the retirement date; and c) has reached the age of fifty -five (55) years on or before the retirement date, but is not eligible on the retirement date for Medicare coverage; and d) files a written request with the Personnel Department requesting retiree insurance benefits within ninety (90) days after the retirement date or the enactment of this ordinance. 1 • (f) files a written request to the insurance coordinator requesting to rec• e retiree insurance benefits within 90 days after retirement or enacunent of this ordinance; and (g) who, if he or she has already ceased employment with the City, as continued to receive City group insurance benefits, since retirement, with. ut interruption. 3. City Insurance shall mean individual or family group health care insu : - benefits made available by the City to a retired City employee, which shall be • e same as one group insurance coverage available to all full -time City employee.. SECTION II - BENEFITS 1. During the lifetime of a retired City employee, the former employee shall • eligible to receive up to Two Hundred Dollars ($200.00) per month, payable by e City for benefit of the retired City employee, to only be applied to said employ =.'s City insurance premium. However, if a retired City employee opts to recei e individual coverage, rather than family coverage, the Employee shall be eligible to receive a maximum benefit of only One hundred Dollars ($100.00) per month. T e employee shall be responsible for payment of any balance of the monthly C ty insurance premium. 2. A retired City employee who receives benefits under this ordinance shall re required to disclose the availability of health insurance benefits to the employee if the employee's spouse. Failure of the retired City employee to disclose is information and to allow the City to verify this information shall make the retir - d City employee ineligible to receive benefits under this ordinance. 3. A retired City employee who does not receive City insurance shall not be entitl • to receive any other benefits under this ordinance. SECTION III - PAYMENTS 1. If a retired City employee receives retirement benefits directly from the City, e balance of any premium due for City insurance, over and above the portion p .�d pursuant to Section II above, may be deducted from the employee's retire • t benefit check by payroll deduction. If a retired City employee receives bene is under the Indiana Public Employee's Retirement Fund (PERF) or any other pub is retirement fund, it shall be the duty of the employee to forward the balance if monthly premiums over and above the portion paid pursuant to Section II abo e, directly to the Clerk- Treasurer of the City of Jeffersonville on or before the 1st d y of each month. 2 L , , • • to the Clerk- Treasurer of the City of Jeffersonville on or before the 1 day of each month. 3) If a Retired City Employee or Surviving Spouse fails to deliver to the Clerk - Treasurer the Retired City Employee's or Surviving Spouse's portion of the monthly City Insurance premium on or before the 1 day of every month, the City may terminate the Retired City Employee's or Surviving Spouse's City Insurance coverage after notice and a hearing before the Board of Public Works and Safety ( "the Board "). in cases of hardship or upon good cause shown, the Board, at its sole discretion, may allow a Retired City Employee or Surviving Spouse to continue receiving City Insurance coverage if the Retired City Employee or Surviving Spouse makes the delinquent payment in the manner required by the Board.
