HomeMy WebLinkAbout2011-OR-64 Ordinance 2011 -OR- 64 AN ORDINANCE AMENDING ORDINANCE NO. 2000-OR-28 AND 90 -OR -9 ESTABLISHING A SPAY - NEUTER PROGRAM FOR ANIMALS ADOPTED FROM THE JOSEPHINE B. OGLE ANIMAL SHELTER WHEREAS, in 1990, and again in 2000, the Jeffersonville Common Council adopted an ordinance establishing a spay - neuter program for animals adopted from the Jeffersonville -Clark County Animal Shelter; and WHEREAS, often owners of animals adopted from the Shelter fail to have the spay/ neuter procedure performed after they adopt the animal even though they have paid the necessary fee for the spay/ neuter procedure and received a voucher, and WHEREAS, the Council believes that spaying and neutering animals before new owners are allowed to take possession of animals adopted from the Shelter will reduce the population of unwanted animals over the course of time; and WHEREAS, the City of Jeffersonville wishes to hire a Shelter Veterinarian capable of performing all spay/ neuter procedures on site at the Shelter prior to allowing new owners to take possession of animals adopted from the Shelter and wishes to pay the Shelter Veterinarian a portion of her/his salary from the non - reverting fund into which the fees provided by Ordinance no. 90 -OR -9 and 2000 -OR -28 are deposited; NOW, THEREFORE, BE IT ORDAINED that Ordinance No. 90 -OR -9 and Ordinance 2000 -OR -28 adopting a spay/ neuter program for the Shelter is hereby amended to read as follows: I. All persons wishing to adopt an animal at the Josephine B. Ogle Animal Shelter, must pay, along with their regular adoption fees, the cost of having the animal spayed or neutered. 2. The Shelter Director is hereby ordered to obtain at least annually from all licensed veterinarians in Jeffersonville Township quotes for fees those veterinarians charge the general public spay and neuter fees. The Shelter spay /neuter fee must be equal to the lowest and best quote from a responsible and responsive quote. 3. If the animal to be adopted is of sufficient age and health to be spayed or neutered at the time of the adoption, the animal must be spayed or neutered prior to being released to the new owner, but after the new owner has paid the adoption fees and the spay /neuter fee. The new owner may take physical of the animal upon the Shelter Veterinarian's certification that the animal is sufficiently recovered from the spay /neuter procedure. If the animal is not sufficiently recovered within ten (10) days following the spay /neuter procedure, the new owner may, at his/her option revoke the adoption and receive a refund of the adoption fee and the spay /neuter fee. 4. If the animal to be adopted is not of sufficient age and health to be spayed or neutered at the time of the adoption, the Shelter will issue a voucher to the new owner of the animal requiring the spay /neuter procedure to be performed by the Shelter Veterinarian at the Shelter prior to an expiration date established by the Shelter Veterinarian. 5. Subject to prior written approval by the Shelter Director, the new owner may refuse the spay /neuter procedure, however the new owner must pay the spay /neuter fee unless the adopted animal has already been spayed or neutered. 6. The Shelter must deposit all monies collected for the spay /neuter program with the Clerk- Treasurer or Controller of the City of Jeffersonville, which ever exists at the time, for deposit in the Spay/Neuter Program Non - reverting Fund created herein. 7. A special non - reverting operating fund is hereby established for the purpose of receiving and holding fees charged by the Shelter for the spay /neuter program. This fund shall be entitled "Animal Shelter Spay /Neuter Non - Reverting Fund" and monies may only be expended for the spay/ neuter service prescribed herein, and only upon the filing of a proper claim in issuance of a warrant for payment by the Clerk - Treasurer, or Controller, whichever exists at the time. Hereafter, the Clerk- Treasurer, or Controller, which ever exists at the time, may not deposit monies the Shelter or the City receives as spay /neuter fees, or any other funds donated and designated by the donor as a donation to the spay/ neuter Program Non - reverting Fund, into the City's General Fund, but must deposit those funds and fees into this non - reverting fund. This ordinance is in full force and effect upon its passage, promulgation and approval.
