HomeMy WebLinkAbout2011-OR-41 BEFORE THE CITY OF JEFFERSONVILLE COMMON COUNCIL ORDINANCE NO. 2011 -OR- 4 AN ORDINANCE AMENDING THE SUBDIVISION CONTROL ORDINANCE (#96.OR -28) FOR JEFFERSONVILLE, INDIANA WHEREAS, the City of Jeffersonville, Indiana, adopted the City's Subdivision Control Regulations by Ordinance 96 -OR -28 on or about June 4, 1996; and WHEREAS, the Common Council initiated a proposal to amend the City's Subdivision Control Ordinance and Zoning Ordinance to require developers to install, at the expense of the developer or property owner, street lighting and/or security lighting which meet certain standards; and WHEREAS, City's Plan Commission held a public hearing in accordance with Indiana Code held on June 28, 2011, received public comment, and determined that it is in the best interests of the City and in the interest of the public welfare for the subdivision control regulations to be amended and therefore recommended to the Common Council that the subdivision control regulations and Ordinance 96.OR -28 be amended in the manner set forth herein; and WHEREAS, the Common Council for the City of Jeffersonville has reviewed such recommendations, and believes such recommendation should be followed; NOW, THEREFORE, BE IT ORDAINED by the Common Council for the City of Jeffersonville, Indiana, as follows: 1. AMENDMENTS TO THE SUBDIVISION CONTROL ORDINANCE. The Subdivision Control Regulations as adopted by Ordinance 96 -OR -28 on June 4, 1996 shall be, and are hereby, amended as follows: New Provisions Being Added to the Subdivision Control Ordinance. 155.51 STREET LIGIITS AND SECURITY LIGHTS The applicant shall, at his, her, their, its expense, provide the subdivision with street lighting along public right of ways. All lighting must be shielded with opaque material to project lighting onto adjacent streets, alleys and public right of ways. All lights must have cutoff luminaires with less than a ninety (90) degree angle (downlighting) and may be no more than twenty (20) feet in height. All Page 1 ur3 lights within a single development must be consistent in style, design, height, size and color throughout the development as determined and approved by the Plan Commission at the preliminary and final plat approval stages. The lighting assembly shall be made of rust- resistant material welded or otherwise assembled into a strong and durable, wet location rated assembly. 2. REMAINING PORTIONS OF ORDINANCE UNCHANGED. Except as otherwise provided herein, all other provisions of the Subdivision Control Regulations and Ordinance 96.OR -28 which arc not in conflict herewith shall remain in full force and effect. 3. EFFECTIVE DATE OF ORDINANCE AMENDMENTS. These amendments to the subdivision control ordinance shall become effective immediately from and after the adoption of this ordinance.
