Per the City's request, this scope of work represents only an initial portion of the effort proposed by our original scope of services dated February 1, 2011 and submitted to Construction Solutions, LLC. It is our understanding that the remainder of that initial scope of services will be addressed under separate contract. As specified in the original proposal, conditions would be evaluated within a study area that's consistent with the initial direction provided by Construction Solutions, LLC with one suggested revision. This development should not have a meaningful impact upon Wall Street. Therefore, it is suggested that Spring Street serve as the eastern boundary, removing 9 intersections from the analysis. To that end, this scope of work was developed assuming the study area is bounded by Spring Street to the east, Missouri Avenue to the west, the Ohio River to the south, and 10 Street to the north. To accomplish the study's objectives, several time periods would be evaluated. However, the emphasis would be the afternoon peak hour of a typical weekday, which represents not only a peak period for the development but also a peak period with respect to commuter traffic on the area road system. Because of these overlapping peaks, the heaviest overall traffic volumes are likely to occur at this time. As such, most intersections within the study area would be explicitly evaluated during the aftemoon peak hour. Conditions would also be evaluated during the morning peak hour of a typical weekday and the midday peak hour on Saturday, although these efforts would be more targeted. The morning evaluations would address the impact of the Development Phase 2 street closures upon Jeffersonville Canal Transportation Studies April 13, 2011 Page 2 commuter traffic, and the Saturday evaluations would emphasize traffic management strategies to accommodate overlapping events at the convention center and lagoon plaza. In that regard, only those intersections proximate to the Development Phase 2 street closures would be evaluated in the morning, and only those locations likely to be impacted by the events would be addressed on Saturday. This scope of work has been tailored to meet the project's needs. Therefore, it focuses on establishing safe and efficient access to the development and mitigating adverse impacts upon traffic flows. While the need to accommodate other roadway users (pedestrians, bicyclists, public transit, parking) is recognized, this scope does not explicitly evaluate pedestrian facilities, bicycle accommodations, public transit accessibility, or parking needs (on- street or off - street). We would be happy to modify this scope of work to address these issues, if needed. Furthermore, this scope of work would not evaluate conditions along Interstate 65. Traffic modeling of merging, diverging, weaving, or ramp movements is not included. Our efforts would be limited to evaluating the Interstate 65 ramp terminal intersections with local streets (i.e., Court Avenue, 10 Street, Market Street). Any analysis of reconfigured or modified ramps proposed by INDOT would also be limited to the ramp terminal intersections. Initial Traffic Study - Existing Conditions Analysis & Master Plan Coordination Under this initial scope -of -work, BLA would evaluate existing traffic conditions within the full study area (Ohio River to 10 Street), completing the following tasks: Task 1: Inventory the physical characteristics of the existing road network, noting lane designations, traffic control, signal phasing, speed limits, transit stops, on- street parking, etc. Task 2: Perform observations of traffic flows during the weekday morning and afternoon peak periods and Saturday midday peak period, noting instances and locations of congestion and queuing. Task 3: Collect two -way daily traffic counts at the following locations using automatic machine counters: • Court Avenue between Ohio Avenue and Mulberry Street • Spring Street (one location between Court Avenue and 10 Street) • Mulberry Street near Maple Street • Pearl Street near Maple Street • 6 Street near Michigan Avenue • 7 Street near Michigan Avenue • Michigan Avenue between 6 Street and 7 Street Jeffersonville Canal Transportation Studies April 13, 2011 Page 3 The duration of these machine counts would be a minimum of two full days. A daily average would be calculated. Task 4: Manage tuming movement counts at intersections using manual counters. The majority of intersections within the study area would be counted during the weekday afternoon peak period (the primary focus of this study). Figure 1 below illustrates the intersections to be counted and the peak period(s) when each intersection would be counted. Since the moming analysis would focus on the southern portion of the study area, morning counts would be concentrated in that location. With the Saturday evaluation emphasizing special events traffic, counts at that time would address locations around the proposed convention center. The basis of the morning evaluations would be the peak period between 7:00 a.m. and 9:00 a.m. The aftemoon analysis would reflect the peak period between 4:00 p.m. and 6:00 p.m. Lastly, the Saturday assessment would address peak conditions between 12:00 p.m. and 2:00 p.m. For each period, select high - volume locations would be counted for the full two hours in order to identify fluctuations as well as the specific 60- minute peak hour. Other locations would be counted during the peak hour only, and count sampling for 30 minutes or 15 minutes would be done at low- volume intersections. It should be emphasized that this scope of work and fee estimate reflects the assistance of personnel from Constructions Solutions and /or the City of Jeffersonville. BIA staff would supervise the counts, provide instructions and equipment (manual count boards), and supplement counting. We envision needing 3 -5 personnel to count for 1 -2 hours at a time on 2 weekday mornings, 4 weekday afternoons, and 2 Saturday middays. Task 5: Summarize the traffic count data obtained in Task 4, resulting in peak hour tuming movement traffic volumes. Task 6: Obtain existing traffic signal timings from INDOT and the City of Jeffersonville. We would focus on the weekday afternoon peak hour, although operations during the weekday morning and Saturday midday peak hours would be evaluated at the locations specified in Figure 1. Note that more robust traffic simulation modeling is still recommended for Court Avenue (as proposed in the original scope of services). However, the traffic simulation model would not be developed as part of this scope of work and instead would be deferred to study stage two. Task 8: Using the traffic model developed in Task 7, we would be prepared to respond to inquiries and /or provide input to the project team with respect to traffic, access, and circulation within the study area. Under this agreement, we would expend up to 36 hours of effort in these coordination efforts. Included in this effort would be coordination with the project architect and preparation of a planning -level assessment and written summary of critical traffic issues within the study area. It is our understanding that the written narrative would be assimilated into the project's Master Plan document. Task 9: Attend up to three meetings in Jeffersonville with you and /or other members of the project team to discuss the traffic study. Fees The study services described above would be performed on a lump sum basis for a fee of $40,000.00, as reflected by the attached agreement. This fee would be subject to increase if any tasks in addition to those specifically listed above are required or requested. However, no additional work would be performed without your direction or permission. The scope and fee estimate assumes our attendance at three meetings (Task 9). Any additional meetings that we may be asked to attend (at your request) would be billed as an Extra. (BLA) shall perform the services outlined in this agreement for the stated fee arrangement. Access To Site: Unless otherwise stated, NA will have access to the site for activities necessary for the performance of the services. B&A will take precautions to minimize damage due to these activities, but has not included in the fee the cost of restoration of any resulting damage. Dispute Resolution: My claims or disputes made during design, constmttlon or post - construction between the Client and 81A shall be submitted to non- binding mediation. Client and BLA agree to include a similar mediation agreement with all contractors, subcontractors, subconsultants, suppliers and fabricators, thereby providing for mediation as the primary method for dispute resolution between all parties. Should client and BLA fail to resolve their dispute by mediation, they agree that jurisdiction for any litigation concerning such dispute shall be in a federal or state court situated in Vandenburgh County, Indiana, subject to applicable law. Billings /Payments: Invoices for BU's services shall be submitted, at MA's option, either upon completion of such services or on a monthly basis. Invoices shall be payable within 30 days after the invoice date. If the invoke is not paid within 30 days, BSA may, without waiving any claim or right against the Client, and without liability whatsoever to the Client, terminate the performance of the service. Late Payments: Accounts unpaid 45 days after the invoke date may be subject to a monthly service charge of 1.0% on the then unpaid balance. In the event any portion or all of an account remains unpaid 90 days after billing, the Client shall pay all costs of collection, including attorney's fees and all court costs. Certlfcatlons: Guarantees and Warranties: BLA shall not be required to execute any document that would result in its certifying, guaranteeing or warranting the existence of conditions whose existence 81A cannot ascertain. My opinions or probable project costs or construction costs rendered by BLA represent Its best judgment and are furnished for general guidance only. 81A makes no warranty, either express or implied, as to the accuracy of such opinions as compared to bid or actual costs. LILA warrants only that It will use that degree of care and skill ordinarily exercised under similar conditions by the engineering profession practicing in the same or similar locality. No other warranty, express or implied, is made or Intended by this Agreement. Responsibility for calms: In recognition of the relative risks, rewards and benefits of the project to both the Client and BEA, the risks have been allocated such that the Client agrees that, to the fullest extent permitted by law, BLA's total liability to the Client for any and all injuries, claims, losses, expenses, damages or claim expenses arising out of this agreement from any cause or causes, shall not exceed the amount of MA's total compensation for services paid and received by B1A under this agreement Such causes include, but are not limited to 81A's negligence, errors, omissions, or breach of contract. 81A shall not be responsible for the means, methods and techniques of the construction contractor in the prosecution of its work nor for the construction contractor(sr and their subcontractors safety programs, training or compliance with safety requirements of any federal or state agency. Subcontactors: If 81A has been asked by the Client to subcontract certain geotechnical, architectural, survey or laboratory testing smites on behalf of the Client, MA agrees to do so only as an accommodation to the Client and in reliance upon the Client's assurance that the Client will make no claim to bring any action at law or in equity against BSA as a result of this subcontracted service. The Client understands that BSA is neither tralned nor knowledgeable In the procedures or results of the subcontractor's services and the Client shall not rely upon 81A to check the quality or accuracy of their services. In addition, the Client agrees to the fullest extent permitted by law to indemnify and hold 8W harmless from any damage, liability or cost (including attorneys' fees and costs of defense) arising from the services performed by this subcontractor except only those damages, liabilities or costs caused by the sole negligence or willful misconduct of &A. Termination of services: This agreement may be terminated by the Client or 81A should the other fail to perform its obligations hereunder. In the event of termination, the Client shall pay 81A for all services rendered to the date of termination, all reimbursable expenses, and reimbursable termination expenses. Ownership of Doamesms: All reports, drawings, specifications, computer files, field data, notes and other documents and instruments prepare by 81A as lnsfrumenis of service shall remain the property of H1A. BLA shall retain all common law, statutory and other reserved rights, including, without limitation, the copydghts thereto. OVERTIME work will be performed only at the direction of the client. All work on survey crews, drafting or clerical over eight hours per day or work performed on Saturday or holidays Is considered overtime and will be billed at 1.25 times above quoted rates. CONSTRUCTION LAYOUT: Contractors shall verify construction layout stakes and notify the surveyor of any discrepancies prior to construction. Bernardin, Lochmueller & Associates, Inc. does not assume responsibility for construction costs for any corrections. DIRECT EXPENSES will be charged to the client in addition to the above quoted rates. Mileage will be charged at a rate of .50 per mile. Direct expenses include but are not limited to: mileage, filing fees, testing, express mail costs, etc. provided that they are reasonable and necessary for the accomplishment of the work.
