HomeMy WebLinkAbout2011-R-2 RESOLUTION No. 201I-R- OZ BEFORE THE .IF.FFERSONVILLE BOARD OF PUBLIC WORKS AND SAFETY FOR THE CITY OF JEFFERSONVILLE IN TAE STATE OF INDIANA A RESOLUTION CONVEYING A PRIVATE ACCESS, PARKING, UTILITY AND DRAINAGE EASEMENT WHEREAS, the City of Jeffersonville (hereinafter called "the City") owns property, whose legal description is set out in attached exhibit "A ", and is surrounded on three sides by Sec ion 5, Lot 1 of the Jeffersonville MarketPlacc, owned by Koetter Five Star Properties, Indiana LLC, and David L. Summitt for C&S Properties (hereinafter called "the Owners") all of which is rendered by survey drawing in exhibit "A -1 ". WHEREAS, pursuant to I.C. 36 -9-6 -2 The Board of Public Works and Safety shall have the authority, among other things, to supervise the public grounds, and other property of the city. WHEREAS, the Owners seek to obtain an easement for private parking, and utility access over/through that Iand described in attached Exhibit "A ". WHEREAS, the Owners seek to obtain a drainage easement as described in Exhibit "B" and rendered by surveyor's drawing in Exhibit "R -1 ". WHEREAS, the Board of Public Works and Safety ( "BPW') believes it in the best interest of the citizens and taxpayers of Jeffersonville that the City grant said easements; NOW, THEREFORE, IT IS HEREBY RESOLVED, that the Roard of Public Works and Safety approves the conveyance of the aforementioned casements and authorized the Mayor to execute the necessary documents to effectuate said transactions.
