COMMON COUNCIL OF THE CITY
OF JEFFERSONVILLE, INDIANA
May 17, 2010
The Common Council of the City of Jeffersonville, Indiana met in regular session
in Room 101, City Hall, 500 Quartermaster Court, Jeffersonville, Indiana, at 6:30 P.M.
on Monday May 17, 2010.
Mayor Tom Galligan, with Deputy Clerk Treasurer Barbara Hollis at the desk,
called the meeting to order at 6:30 P.M. Also present were City Attorney Darren Wilder,
and Council Attorney Greg Clark. Mayor Galligan welcomed all in attendance, asking
those present to stand as Councilperson Ron Grooms gave the invocation. Mayor
Galligan then asked all those present to join him in the pledge of allegiance to the flag.
The roll was called and those present were; Councilpersons Mike Smith, Ed
Zastawny, Keith Fetz, Connie Sellers, Barbara Wilson, Ron Grooms, and Nathan Samuel.
Absent: None.
Council President Samuel made the motion to approve the agenda with moving
item No. 13 to No. 9B, the addition of 9A certificate presentation, and the removal of
item No. 23, second by Councilperson Sellers, passing on a vote of 7-0.
Mayor Galligan presented the minutes for consideration. Councilperson Wilson
made the motion to approve the minutes of May 3, 2010 (5:30 P.M.) second by
Councilperson Fetz, passing on a vote of 7-0. Councilperson Wilson then made the
motion to approve the minutes of May 3, 2010 (6:30 P.M.), second by Councilperson
Fetz, passing on a vote of 6-0.
Deputy Clerk Hollis presented the claim list for consideration by the Council.
Following discussion, Councilperson Fetz made the motion to approve the list of claims
second by Councilperson Smith, passing on a vote of 7-0. Councilperson Grooms then
made the motion to preapprove the Park claim list as presented, second by Councilperson
Fetz, passing on a vote of 7-0.
PUBLIC COMMENT:

COUNCIL COMMENT:

Councilperson Grooms presented a Certification of Commendation to Micah
Shrewsberry, Butler University Basketball Coach. Coach Shrewsberry is a native of
Jeffersonville and the son of former Councilperson Bill Shrewsberry. His wife Molly and
his three children were also introduced. Councilperson Grooms praised and reviewed
Coach Shrewsberry's history of accomplishments. Mayor Galligan said Coach
Shrewsberry has "done the City proud". Coach Shrewsberry expressed appreciation
saying he is happy to be back and considers himself to be a "true Jeff native".
AGENDA ITEMS:
Mr. Jordan Briner of Steel Dynamics, appeared before the Council requesting
passage of Resolution No. 2010-R-12, A Resolution Approving Statement Of Benefits
For Purposed Real And Personal Property Tax Abatement (Steel Dynamics, Inc.).
Councilperson Zastawny noted the Redevelopment Commission unanimously approved
the request. Mayor Galligan noted the Company is looking at doing other things in the
area. They have great jobs and are worth the investment. Mr. Mat Smolek, representing
the Ports of Indiana-Jeffersonville, announced support. Councilperson Zastawny
reviewed the agreement. Councilperson Zastawny made the motion to pass Resolution
No. 2010-R-12, second by Councilperson Wilson, passing on a vote of 7-0.
DEPARTMENT HEAD REPORTS:
Mayor's Administrative Assistant Dana Young appeared before the Council with
a City Partnership report. Assistant Young reported the committee did not want to go
with banners this year, deciding on landscaping, flowers and topiary for the Riverstage
area. Assistant Young presented and reviewed the list of 2010 City Partners. This list
increased from 15 to 35. She then reviewed the 2009 and 2010 cash and in-kind
donations, saying the goals were exceeded. She has compiled a City Profile Book.
Mayor Galligan thanked Assistant Young, Peggy Duffy, and Becky Hutchins. He
applauds Assistant Young for doing a good job. The work is beautiful and absolutely
amazing. Assistant Young noted the generosity is astounding.

Mr. Clint Decker gave a canal update. He noted a meeting has been set up with
the Corps of Engineers. There was a meeting with Senator Lugar. He then reviewed
future planned meetings.
Mr. Ed Flaugh appeared before the Council saying he feels the City has unfair
zoning laws and equal opportunity. He presented a new zoning proposal, asking the
Council to consider passing.
City Attorney Darren Wilder explained revisions made to Ordinance No. 2010-
OR-7, An Ordinance Amending 2009-OR-31, Regarding Refuse/Garbage Collection.
Following discussion, Councilperson Grooms made the motion to pass Ordinance No.
2010-OR-7 on the third reading, second by Councilperson Zastawny, passing on a vote of
7-0.
City Attorney Wilder next explained revisions made to Ordinance No. 2010-OR-
18, An Ordinance Regulating Taxicab Service And Taxicab Drivers In The City Of
Jeffersonville. Council President Samuel appreciates the input of Officer Grimes.
Council President Samuel made the motion to pass Ordinance No. 2010-OR-18 on the
second and third readings, second by Councilperson Sellers, passing on a vote of 7-0.
City Attorney Wilder has emailed an interlocal agreement and will be asking for
passage at the next meeting.
Plan Commission Attorney David Lewis reviewed Ordinance No. 2010-OR-19,
An Ordinance Amending The Subdivision Control Ordinance (#96-OR-28) For
Jeffersonville, Indiana. The Plan Commission is in favor of this Ordinance.
Councilperson Fetz made the motion to pass Ordinance No. 2010-OR-19 on the second
and third readings, second by Councilperson Wilson, passing on a vote of 7-0.
Council Attorney Greg Clark explained and read portions of Resolution No. 2010-
R-13, A Resolution Recognizing The Clark County Council's Adoption Of A Local
Option Income Tax For Public Safety. Council President Samuel made the motion to
pass Resolution No. 2010-R-13, second by Councilperson Zastawny, passing on a vote of
7-0.
Council Attorney Clark next presented and reviewed Resolution No. 2010-R-14,
A Resolution Recognizing June 18th & 19th, 2010 As Jeffersonville Arts On The Ohio

Days. Councilperson Fetz made the motion to pass Resolution No. 2010-R-14, second by
Councilperson Zastawny, passing on a vote of 7-0.
Council Attorney Clark explained the need for passage of Ordinance No. 2010-
OR-20, An Ordinance Establishing The Federal Asset Forfeiture Program Fund.
Councilperson Zastawny made the motion to pass Ordinance No. 2010-OR-20 on the first
and second readings, second by Councilperson Sellers, passing on a vote of 7-0.
Council Attorney Clark presented Ordinance No. 2010-OR-21, An Ordinance
Amending The Salary Ordinance (2010-OR-1) For Jeffersonville, Indiana.
Councilperson Grooms made the motion to table Ordinance No. 2010-OR-21, second by
Councilperson Zastawny, passing on a vote of 7-0.
Council President Samuel explained the need for passage of Ordinance No. 2010-
OR-2~, An Ordinance Of Additional Appropriation (General Fund -Fire Department),
making the motion to pass on the first and second readings, second by Councilperson
Smith, passing on a vote of 7-0.
Councilperson Grooms explained the need for passage of Ordinance No. 2010-
OR-23, An Ordinance Transferring Certain Funds Within Same Department (EDIT),
making the motion to pass on the first and second reading, second by Councilperson
Wilson, passing on a vote of 7-0.
COMMITTEE REPORTS, COUNCIL AND MAYOR COMMENTS:
Councilperson Smith noted bids will be opened for a Bioswale at the Drainage
Board meeting.
Councilperson Fetz, noting the Council has established a Property Tax Alternative
Committee, encouraged the naming of appointees. Councilperson Fetz next asked if the
City has purchased the Community Kitchen Building, and if relocation has been
discussed. He also asked if the Jaycees are active. There is a need in the community.
Mayor Galligan said he has talked with the people operating the Community Kitchen
telling them they have until January 1, 2011 to be out. Alternative places were discussed.
The intention is not to leave the group high and dry. The City will help with what they
can. Areas are being looked at. They have been told they can have what is inside the
building. Councilperson Fetz asks what would happen if an owner does not exist. Mayor
Galligan said someone owns it. The money from the sale is going to a scholarship fund.

Councilperson Grooms noted there is a group of Jaycee charter members and he
understands they were polled. He believes the true owner is the Indiana Jaycees or the
National Jaycees. Councilperson Fetz next asked about the "Muncy" property. Mayor
Galligan said it has been turned over to the attorney for closing.
Councilperson Sellers read a thank you card from retired City Engineer Bob
Miller.
Councilperson Wilson announced the Concerts In The Park started last Friday.
She invites all to attend.
Councilperson Grooms says thank you to Mat and Brandon for recording the
meeting and also to Officer Grimes for his attendance. Councilperson Grooms also says
thank you to Assistant Dana Young for an awesome presentation. The Finance.
Committee will meet Friday, May 21, 2010 at 9:00 A.M.
Council President Samuel asked the status of the proposed street renaming.
Councilperson Fetz said he has talked with three School Board Members. It looks like
15th Street is acceptable to the group requesting the change. There have been no issues
from the school. Council President Samuel issued an invitation to a program on
Thursday, May 20, 2010 from 3:00-4:30 P.M. presented by Dr. DeBoer. He then asked
about the proposal from Mr. Flaugh and was told Planning and Zoning Director Brian
Fogel has a copy of the proposal. Council President Samuel asked if the new tire
company on 10th Street will be installing sidewalks. Councilperson Fetz said they would
be.
Councilperson Fetz next reviewed a proposed building for the Howard Steamboat
Museum, explaining the area that is being considered. The Museum Board intends to
build public restrooms. The area was discussed. This is at the Flood Wall. The Flood
Control District has to be to the Corps of Engineers.
Mayor Galligan again commended Assistant Dana Young's work. He then
announced the Mayor's Conference will be held here on June 2, 3, and 4. He asks all say
Hi if they are seen on the street. He invites the Council to the events. Mayor Galligan
gave three talks last week regarding the proposed canal. All were received well, and all
three groups are excited. He is trying to get information out. Mayor Galligan introduced

Clarence Hulse.
As there was no further business to come before the Council, the meeting was
adjourned at 8:00 P.M.
