HomeMy WebLinkAbout2010-R-02A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF JEFFERSONVILLE, INDIANA, APPROPRIATING AND CONDEMNING REAL PROPERTY FOR USE BY THE CITY OF JEFFERSONVILLE, INDIANA FOR THE ACQUISITION OF EASEMENTS AND RIGHT OF WAYS ALONG HAMBURG PIKE RESOLUTION NUMBER ~ ~`~ ~ ~ r WHEREAS, the Board of Public Works (the "Works Board") of the City finds that the corridor along Hamburg Pike is in disrepair and inadequate to carry the current amount of traffic traveling along the roadway. The citizens of Jeffersonville would benefit from the repair and widening of Hamburg Pike; and WHEREAS, the Works Board has determined that, to best serve the Citizens of Jeffersonville, the City should acquire temporary and permanent easements and right of ways along Hamburg Pike so as to undertake a roadway widening project; WHEREAS, THE Works Board has determined that the City should acquire a temporary and permanent right of way over the real property located at the common address 3711 Hamburg Pike, Jeffersonville, IN, over the specifically described area identified in Exhibit A, and evaluated in Exhibit B, hereinafter "371.1 Hamburg Pike Property"; and WHEREAS, IC 32-24-2 provides a mechanism pursuant to which the Works Board may proceed such condemnation and appropriation; and WHEREAS, the Works Board has determined that it is of benefit and in the best interests of the City to proceed to condemn and appropriate the 3711 Hamburg Pike Property under the mechanism set forth in IC 32-24-2; and WHEREAS, IC 32-24-2-6 requires the adoption by the Works Board a resolution expressing the desire of the Works Board to condemn and appropriate such interests, and identifying such real property as may be injuriously or beneficially affected; and WHEREAS, IC 32-24-2-6 requires the Works Board to publish notice of the adoption of said resolution and of the date and time and place at which the Works Board shall receive or hear remonstrances from persons interested in or affected by the Works Board's proceeding under IC 32-24-2. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF JEFFERSONVILLE, INDIANA, AS FOLLOWS: 1. That the Works Board hereby declares that the acquisition of the 3711 Hamburg Pike Property is beneficial and of public benefit. 2. That pursuant to IC 32-24-2-6, the Works Board hereby declares that it is beneficial to condemn and appropriate the 3711 Hamburg Pike Property. 3. That the Works Board declares that the real property that may be injuriously or beneficially affected by such condemnation and appropriation includes the property described in Exhibit A (i.e. the 3711 Hamburg Pike Property) attached hereto, along with any additions or improvements to the property hereafter occurring in the affected area. 4. That the Works Board hereby sets the 28'" day of April, 2010 at 9:30am, at the Mayor's Conference Room in City Hall, as the date, time and place at which the Works Board shall receive and hear remonstrances from persons interested in or affected by this proceeding. 5. That at the hearing set herein for remonstrance, the Works Board shall consider any such remonstrance and shall thereafter or at a future meeting take final action confirming, modifying, or rescinding this Resolution. 6. That the Clerk of the Works Board shall and hereby is directed and authorized to send notice of said hearing to Gary and Brenda Holman, and publish notice of this Resolution in at least one newspaper of general circulation in the City of Jeffersonville once each week for two (2) consecutive weeks, the last publication to be at least ten (10) days before Apri128, 2010, the date the Works Board will hear remonstrances from persons interested in or affected by this proceeding. This Resolution shall be in full force and effect from and after its adoption by the Board of Public Works of the City of Jeffersonville, Indiana. Adopted this day of , 2010.
