HomeMy WebLinkAbout2010-R-08BEFORE THE CITY OF JEFFERSONVILLE COMMON COUNCIL RESOLUTION 2010-R-8 A RESOLUTION EXPANDING THE AUTHORITY OF THE CITY OF JEFFERSONVILLE POLICE MERIT COMMISSION WHEREAS, the Common Council of the City of Jeffersonville, under the authority granted to it by the Indiana Code, established a merit system for its police department by the adoption of Resolutions 2008-R-30 and amended by 2009-R-17; WHEREAS, pursuant to the authority vested in the City of Jeffersonville Police Merit Commission ("Commission") by the Indiana Code and City of Jeffersonville Resolutions 2008-R-30 and 2009-R-17, the Commission adopted rules and procedures governing: (1) the selection and appointment of persons to be employed as members of the police department, (2) promotions and demotions of members of the police department, and (3) disciplinary action or dismissal of members of the department; WHEREAS, the most recent collective bargaining agreement between the City of Jeffersonville and Indiana Fraternal Order of Police Labor Council and Lodge #100, effective January 1, 2009 through December 31, 2012 ("Agreement"), outlines certain situations where the parties agreed the Commission should have the authority to act in regard to non-personnel related matters; WHEREAS, the purpose of this Resolution is to grant the Commission the authority to develop rules, policies, and procedures governing these items contained in the Agreement and to grant the Commission the authority to act in regard to these non- personnel related matters contained in the Agreement; NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Jeffersonville, that is specifically and affirmatively finds as follows: 1. That the City of Jeffersonville Common Council, by the authority granted under Indiana Code § 36-8-3.5-1(f), amends the City of Jeffersonville police merit system as established by 2008-R-30 and amended by 2009-R-17. 2. In addition to its vested authority over personnel related matters, the Commission is hereby granted the authority to develop rules, policies, and Page 1 of 3 procedures governing non-personnel related matters and decide these matters as outlined and agreed upon by the parties in the Agreement. 3. That after unanimous consent of all members present to consider the adoption of this resolution at the same meeting at which it was introduced, this Resolution was passed by the Common Council by at least atwo-thirds (2/3) vote of all elected members of the Common Council. This RESOLUTION shall be in full force and effect from and after its passage by the City of Jeffersonville Common Council and approval by the Mayor. Voted f ........
