AN ORDINANCE AMENDING SECTION 156.03
OF THE JEFFERSONVlLLE ZONING CODE
WHEREAS, on the 29th day of October, the Jeffersonville Plan Commission
recommended the adoption of an ordinance amending section 156.03 of the
Jeffersonville Zoning Code; and
WHEREAS, the Common Council of the City of Jeffersonville, Indiana (hereinafter "the
Council") is concerned with preserving the City's neighborhoods; and
WHEREAS, the Council has noticed a trend toward conversion of large buildings into
sleeping rooms for a transient population; and
WHEREAS, such conversions are not in the beSt interest of the citizens of the City of
Jeffersonville; and
WHEREAS, such conversions often pose a danger to the residents therein; and
WHEREAS, the following amendment is adopted to preserve the public health, safety
and welfare in the City of Jeffersonville;
NOW THEREFORE, BE IT HEREBY ORDAINED that Section 156.03 Definitions of the
Jeffersonville Zoning Code is hereby amended as follows:
·.. "DWELLING." A building, or a portion thereof, affixed to the land containing
dwelling units, but not including hotels, motels, lodging or boarding homes, tents,
buses, vans, tourist homes, or recreational vehicles.
"DWELLING UNIT." A dwelling unit consists of two or more reoms which are
arranged, designed, and used as living quarters for one family only. A
permanently installed individual bathroom including a sink, bathtub or shower,
and toilet facilities and a permanently installed complete kitchen facility shall
always be included in a dwelling unit ....
This Ordinance shall be in full force and effect from and after its passage and approval.

CERTIFICATION OF FAVORABLE/UNFAVORABLE/NO RECOMMENDATION
OFPROPOSED ORDINANCE
Whereas the Common Council of the City of Jeffersonville referred to the Plan
Commission for its consideration and recommendation the attached proposed
Ordinance marked as "Exhibit A" to amend the zoning ordinance; and
Whereas, after proper notice by publication, the Jeffersonville Plan Commission
held a public hearing on the proposed ordinance on ~/'('r'2 -"/~---'~' ('~C'~o~- ~';~
and,
Whereas, at the conclusion of the hearing the Jeffersonville Plan Commission
voted by a majority vote of its entire membership to favorably/unfavorably/not
recommend the proposed ordinance to the Jeffersonville Common Council.

NOTICE OF INTENT TO CONSIDER PROPOSED ZONING AMENDMENT
Notice is hereby given that On November 4, 1996 at 7:00 p.m., in the Multi-
Purpose Hearing Room on the Third Floor of the City-County Building at 501 East Court
Avenue, Jeffersonville, Indiana, the Common COuncil of the City of JefferSonviile,
Indiana, intends to consider two ordinances, which, if adopted, would Amend the zoning
ordinance applicable to the entire City of Jeffersonville and its two-mile zoning fringe.
The following are summaries of the Amendments:
(1) Changes to the definitions of "Dwelling" and "Dwelling Unit", to require two or
more rooms and bathroom facilities.
(2) Regulation of the distance betWeen premises used for certain charitable
purposes.
The Plan Commission favorably recommended that the Jeffersonville Common
Council enact by ordinance these proposed Amendments to the Zoning Ordinance. All
interested persons are invited to attend and be heard regarding these matters. This
Common Council meeting may be continued from time to time as found necessary. The
Common Council may take official action at the conclusion of debate at this meeting.
