AN ORDINANCE REQUIRING A SPRINKLER SYSTEM
IN CONVERTED RESIDENTIAL UNITS
WHEREAS, the City of Jeffersonville (hereinafter "the City") contains numerous
large buildings (schools, churches, commercial buildings) that could easily be converted
to residential use; and
WHEREAS, the Common Council of the City of Jeffersonviile (hereinafter "the
Council") is concerned that the health, safety and general welfare of potential residents
of buildings converted to residential uses be preserved to the greatest degree possible;
and
WHEREAS, one of the greatest potential hazards to residents of buildings
converted to residential uses is fire;
NOW THEREFORE, BE IT HEREBY ORDAINED that the following regulations
requiring sprinkler systems in buildings converted to residential uses are hereby
adopted:
SPRINKLER SYSTEMS
§92.80 DEFINITIONS.
Congregate Residence - Any structure formerly used for: a single-family residence, or
a non-residential purpose, that has been converted to dwelling units for housing
multiple occupants whether for profit or not-for-profit.
Owner - any person, firm or corporation who alone, jointly or severally with others, holds
all or part of the legal title or beneficial ownership of any congregate residence, with or
without actual possession thereof, including a mortgagee in possession; or any person,
firm or corporation who has charge, care, or control of any congregate residence as
Executor, Administrator, Trustee, Guardian of the Estate, or duly authorized agent. Any
such person representing the actual owner shall be bound to comply with the owner's
obligations under this section.
Dwelling Unit - any room or group of rooms which are arranged, designed, and used as
living quarters for one or more persons. For purposes of this ordinance, a dwelling unit
may include a room in a rooming house, a hotel, a motel, a tourist home, a school
dormitory, place of worship, or an apartment building whiCh;may or may not have some
additional facilities for eating or cooking contained therein.
§92.81 WHEN SPRINKLER SYSTEM REQUIRED
When any structure's character or use is changed from its current use to a use to place
as a congregate residence this ordinance shall apply.
§92.82 TYPE AND PLACEMENT OF SPRINKLERS
Sprinklers shall be installed in all congregate residences in accordance with National
Fire Protection Association ("NFPA") Standard 13R.
The owner(s) of the congregate residence shall be responsible for installing, in operable
condition, the sprinkler system before occupancy. At time of installation a test
certificate shall be furnished showing the system is in compliance with NFPA
Standards. Maintenance testing shall be performed on a regular schedule as required
by NFPA Standards.
§92.83 ENFORCEMENT
The Fire Prevention Bureau of the City of Jeffersonville, Indiana, Department of Fire
shall be primarily responsible for the enforcement of this ordinance. The Building
Commissioner and/or his designated inspectors, shall assist the Fire Prevention Bureau
of the City of Jeffersonville, Indiana by making referrals to the Bureau as part of its
regular inspection and enforcement of all City Building and Fire Safety Codes.
These enforcement agencies shall in their discretion exercise their right to enter
properties regulated by this ordinance, which right is granted in Indiana Code 36-1-6-2.
§92.84 PENALTIES
Any violation of this ordinance shall be punishable by the imposition of a fine of not less
than $125.00 nor more than $2,500.00, for each such violation. All owners shall be
required to correct or remedy such violations or defects within a reasonable time.
When not otherwise specified, each day that prohibited conditions are maintained shall
constitute a separate offense.
The application of the above penalty shall not be held to prevent the enforced removal
of prohibited conditions.
§92.85 REPEAL OF CONFLICTING ORDINANCES
All former ordinances or parts thereof conflicting or inconsistent with the provisions of
this ordinance or of the code hereby adopted are hereby repealed.
§92.86 SEVERABILITY, CONFLICT WITH OTHER ORDINANCES
If any provisions of this ordinance or the application thereof to any person is held
invalid, such invalidation shall not affect other provisions or applications of this
ordinance, which shall remain in full force and effect. To this end, the provisions of the
ordinance are severable.
In any case where a provision of this ordinance is found to be in conflict with a provision
of any fire or safety code of the City of Jeffersonville, Indiana, the provisions which
establish the higher standard for the promotion and protection of health and safety shall
prevail.
This Ordinance shall be in full force and effect from and after its passage and
approval.
