3 An Ordinance Regarding the Posting of Signs and Bills on
4 Streets in Jeffersonville For the Purpose of Beautification
s And Safetv Of The Citizens of The Citv

7 Whereas, the Jeffersonville City Council is vested with the duty and obligation to
8 promulgate laws, ordinances and regulations that provide for the health, safety and well-
9 being of the citizens of the City;
10 Whereas, the express purpose of this Ordinance is to provide maximum visibility
11 at affected intersections, roads and highways, to prevent unreasonable distraction of
12 operators of motor vehicles, to prevent interference with the effectiveness of traffic
13 lights, signs or signals, to preserve and enhance the natural and scenic beauty or
14 aesthetic features of the affected areas of the City, and to promote the safety and
15 comfort of the users of the roads, highways and streets of Jeffersonville, Indiana;
16 Whereas, in order to achieve these goals the Jeffersonville City Council adopts
17 the following rules and regulations

19 Section One: Posting Bills on Streets.
20 Except as otherwise provided by the Ordinances of the City of Jeffersonville, no
21 person shall post or affix to any pole or other structure on any street, right of way,
22 avenue, alley, park or public ground of the city, any handbill, card, circular or other
23 printed material, including directional signs; provided however, that signs may be affixed

24 or posted with the permission of the Board of Public Works of the City designating the
25 location or direction of institutions of higher learning, stadiums or arenas, or other
26 sporting facilities, publicly-owned parks and playfields, publicly-owned parking facilities,
27 publicly-owned buildings, highway destinations, highway routes, business districts
28 located off major thoroughfares, churches located off through highways, bridges,
29 interchanges, or ramp connections, and/or any Museum; provided further that
30 temporary signs for special events by charitable institutions may be posted with the
31 approval of the Board of Public Works; provided further, that temporary signs giving
32 notice of public hearings of departments, offices, boards and commissions, of the City of
33 Jeffersonville and city council or council committees may be posted in locations
34 approved by the Board of Public Works; and provided further that newspapers of
35 general circulation in the City of Jeffersonville may be sold from racks, containers and
36 bags attached to poles and other structures on city sidewalks in accordance with
37 uniform rules and regulations adopted by Ordinance relating to the safety and
38 unobstructed use of the streets by vehicular and pedestrian traffic.
39 Whoever violates this section shall be guilty of posting bills on streets, and shall
40 be fined not more than $2,500 nor less than $100.

Severability Clause:
Should any section, paragraph, sentence, clause or phrase of this ordinance, or its application to
any person or circumstance, be declared unconstitutional or otherwise invalid for any reason, or
should any portion of this ordinance be preempted by state or federal law or regulation, such
decision or preemption shall not affect the validity of the remaining portions of this ordinance or
its application to other persons or circumstances.
This Ordinance shall be in full force and effect from and after its passage and
Aoaroval.
