Under Scope of Services, ADD the following: "13. Interim Model Calibration and Alternative Meetings With Regulators-Attend an interim model calibration and alternative meeting with regulators on August 13, 2009, with the United States Environmental Protection Agency (USEPA) including preparation and follow-up. Attend up to two more alternative identification and evaluation meetings with USEP A. 14. Responses to Regulatory Information Requests-Respond to information requests from USEP A. 15. Inclusion of a Stormwater Canal in the Long Term Control Plan (LTCP) Alternative Evaluation-Include the canal in various LTCP alternatives being evaluated to address USEPA's comment that "all alternatives must be evaluated with and without the canal." 16. Estimation of Integrated Canal Costs at Various Levels of Combined Sewer Overflows (CSO) Control-Develop an integrated canal concept, provide opinion of probable cost resulting from three levels of CSO control, and include in the LTCP alternative evaluation process and documentation. 17. Future Regulatory Meetings (Flooding/Canal)-Attend up to five regulatory meetings to discuss flooding issues and the canal concept. 18. Contingencies-Include a contingency budget to provide funds that can only be spent when efforts are requested/authorized by the Sewer Board or Wastewater Utility." An open-channel canal was identified as a potential L TCP alternative because of the additional flood control and economic development benefits. The purpose of these services is to evaluate the feasibility of a canal. Scope of Services Generally, the following services shall be provided by ENGINEER to OWNER. A detailed Scope of Services is as follows. This Conceptual Design and Feasibility Study includes the development of a conceptual design, identification of three potential routes to accomplish the goals of the project, and completion of a feasibility study on the three potential routes to identify obstacles, and make a recommendation of the preferred route. The project team includes ENGINEER and two subconsultants (SUBCONSULTANT) hereinafter referred to as TEAM. 1. Proi ect Management a. Meet with sub consultants and keep OWNER informed of the project's progress. A schedule of meetings and their purposes are listed below: i) August 13, 2009: Introduce project to ENGINEER and sub consultants (organized by OWNER). ii) August 28, 2009: Develop proposal. iii) September 1,2009: Discuss the canal project with OWNER. iv) September 4, 2009: Discuss basic parameters of the canal with OWNER. v) September 11, 2009: Internal TEAM meeting to draft scope. vi) September 11, 2009: Organized by OWNER. vii) September 14,2009: Internal TEAM meeting to draft budget. viii) September 15, 2009: Present draft Task Order to OWNER. Prepare a project management plan identifying key technical and project management personnel, staffing, budget projections, and a forecast by task and month for the duration of the project. ENGINEER will submit electronic and hard-copy versions of updated schedules as requested by OWNER. The roles of the SUBCONSULTANTS will be identified with a clear delineation of responsibilities. Although the ENGINEER will provide general guidance to the subconsultants, the sub consultants shall remain responsible for their own means, methods, techniques, and procedures including the safety of their own personnel. c. Provide OWNER with hard copy and electronic versions of minutes for future meetings with OWNER within one week of the completed meeting date. d. Conduct a project kickoff meeting to include ENGINEER's key technical and project management personnel and OWNER's staff to revil.3w lines of communication, protocol, project goals and objectives, critical success indicators, scope, and schedule. e. Meet with OWNER on a weekly basis to discuss the status of the project, schedule, and budget. ENGINEER will maintain a schedule of activities and submit the data to OWNER's Project Manager. A total of 10 progress meetings are budgeted. ENGINEER will also attend OWNER's progress meetings as requested by OWNER's Project Manager to assist in reporting project status. f. Prepare a Project Communications Plan that identifies a process for interaction and communication between TEAM, OWNER, and vested stakeholders. The Plan will include the following elements: i) Project organizational chart and lines of communication. ii) Deliverables. iii) Invoicing procedures. iv) Meetings. 2. Identification of Canal Basics a. Prepare draft and final memorandum of understanding and review with OWNER. i) Hydrological Goals-Stormwater Separation: Define the separate stormwater to be diverted to the canal and the extent of the JDH :das\R:\LOU\Documents\Agreements\J\leffersonville, City of (fN)\Wastewater Collection & Treatment System.2005\TO\09-01 \5944030.docx Si STRANO ASSOCIATES, INC.~ ENGINEERS City of Jeffersonville, Indiana Task Order No. 09-01 Page 3 September 17, 2009 storm water to be separated from the combined sewer system and diverted to the canal. ii) Hydraulic Goals-Design Storms: Define level of services of the canal, corresponding flow velocities and canal widths, the level of service of the canal outfall, and the level of service of the flood control measures. iii) Economic and Redevelopment Goals: Document redevelopment needs of the canal as provided by OWNER. iv) Expectations, Preferences, and Limitations: Discuss limitations of the canal. 3. Development and Analysis of Canal Conceptual Design(s) Identify and evaluate the major components affecting up to eight conceptual canal designs. The following procedures will be used by the TEAM: a. Identification and Presentation of Canal Basics and Initial Concept Designs After the canal basics have been identified and evaluated, the TEAM will present OWNER's goals, expectations, preferences, and limitations for the canal. TEAM will present up to eight initial concept designs. ENGINEER will lead this effort. b. Work Sessions Conduct work sessions with TEAM and OWNER to identify ideas and refine the conceptual designs. Input from OWNER and TEAM members is extremely important and valuable to identify the most beneficial design and the overall success of the project. Three work sessions are included. Minutes of these sessions will be composed. ENGINEER will lead this effort. c. Consideration of the Hydrology and Hydraulics, Cross Sections, and Long-Term Control Plan Early Action Projects Assess the hydrology, hydraulics, and cross sections of the canal conceptual designs. TEAM will evaluate the implications of the canal conceptual designs on the early action projects as identified in the Consent Decree and work with OWNER and OWNER's consultants to facilitate integration of facilities. A brief report documenting considerations of hydrology and hydraulics, cross sections, and Long-Term Control Plan (LTCP) Early Action Projects will be prepared. ENGINEER will lead this effort. Consideration of Interim Flood Control Projects Assess the implications of the canal conceptual designs on the interim flood control projects, specifically the addition of a flood pumping station near the intersection of 8th and Ohio Streets, and work with OWNER and OWNER's consultants to facilitate integration of facilities. A brief report documenting considerations of interim flood control projects will be prepared. SUBCONSUL T ANT will lead this effort. e. Consideration of Other Projects Assess the implications of the canal conceptual designs on other projects, specifically the convention center, Big Four Bridge ramp, and 9th Street Park to facilitate the effectiveness of the canal project. A brief report documenting considerations of other projects will be prepared. SUBCONSUL T ANT will lead this effort. f. Presentationes) of the Conceptual Designs and Recommendation Present the conceptual designs to OWNER as they develop and become more refined. The TEAM will make recommendations to OWNER in selecting the conceptual design. ENGINEER will lead this effort. 4. Identification of Three Potential Routes a. Meet with OWNER to identify routes that benefit these goals. Meeting minutes will be prepared. SUBCONSUL T ANT will lead this effort. The goals of the integrated canal project, in order of importance, are to increase flood control, increase combined sewer overflow (CSO) control, and reduce CSO in the form of storm water separation. b. Present potential routes identified to discuss concerns and recommendations to OWNER. This meeting will be conducted during a Sewer Board Executive Session because of pending property acquisition. Meeting minutes documenting OWNER's concerns and recommendations will be prepared. SUBCONSUL T ANT will lead this effort. 5. Phase 1 Data Collection (Potential Route Review) Collect data for the feasibility study including information and documentation available on existing utilities, topography, subsurface conditions, traffic flow, and permits. The TEAM will request information and documentation on existing gas, electric, communication, and water distribution infrastructure from the various local utilities. a. Topographical Review (ENGINEER will lead this effort.) i) Prepare GIS level base topographical maps to review data collected on utilities and physical features within the proposed project limits for potential impacts to proposed improvements. ii) Visit the project area, assist in identifying pertinent physical improvements that could be impacted by the project, and propose mitigation strategies. iii) Prepare a topographical data summary memorandum. b. CSO Control Review (ENGINEER will lead this effort.) i) Review potential routes regarding CSO control benefits and assess the difference in opinion of probable costs for CSO controls among the potential routes. ii) Prepare a brief report of the CSO control review will be prepared. c. Flood Control Infrastructure and Flood Plain Review (SUB CONSUL T ANT will lead this effort.) i) Review the potential routes regarding flood control infrastructure (floodwall and pumping capacity) and flood plain issues. ii) Prepare a brief report. d. Existing Utility Review (SUBCONSUL T ANT will lead this effort.) i) Review data collected on utilities within the proposed potential route limits for potential impacts to proposed improvements. ii) Visit the project area and identify pertinent utilities that could be impacted by the project. iii) Identify proposed mitigation strategies. iv) Review permitting requirements to address possible utility conflicts. v) Prepare a brief report. Existing Easement Review (SUBCONSULTANT willlead this effort.) i) Review data collected on existing easements within the proposed potential route limits for potential impacts and proposed improvements. ii) Prepare a brief report. f. Land Acquisition Review (SUB CONSULTANT will lead this effort.) i) Perform a land acquisition review within the proposed potential route limits. ii) Document in graphical format expected land acquisition costs within an appropriate area of interest of each potential route. iii) Prepare brief report. g. Traffic Counts and Review (ENGINEER will lead this effort.) i) Obtain and review local and regional traffic data from the Indiana Department of Transportation (INDOT) and City of Jeffersonville Public Works Department. ii) Count in-field A.M. and P.M. peak-hour traffic, including turning movements at no more than 15 intersections to be selected after the three potential alignments ,!-re assessed. iii) Completed traffic counts in accordance with Institute of Transportation Engineers (ITE) standards and local requirements. Counts for signal warrant analysis are not included in this scope and are considered extra services. iv) Prepare a brief report. h. Geotechnical Review (SUBCONSULTANT will lead this effort.) i) Prepare GIS level base maps to review data collected by previous soils investigations (as provided by OWNER) within the proposed project limits for potential impacts to proposed improvements. Three to four test borings may be advanced in areas where no previous data were obtained to evaluate if conditions are consistent with prior experience in the area. ii) Review pertinent soils information that could impact the project objectives and proposed mitigation strategies. iii) Prepare a brief report. 1. Cultural Review (SUBCONSULTANT will lead this effort.) i) Review information published on archeological, historical, and cultural resources to identify potential impacts on the project. ii) Prepare a brief report. Hazardous Material/Soil Contamination Review (SUB CONSUL T ANT will lead this effort.) i) Review published data related to known instances of soil and/or groundwater contamination along the project corridors, as well as historical land use records. ii) Prepare a brief report of this review as it relates to the proposed project corridors. k. Endangered Species Review (SUBCONSULTANT will lead this effort.) i) Review published data on endangered species within the proposed project limits to identify potential impacts on the project, including the new river outfall. ii) Prepare a brief report. 1. Design Guidelines and Permit Review (SUBCONSULTANT will lead this effort.) i) Establish specific guidelines for the design of proposed improvements and permit requirements for eventual construction of proposed improvements. ii) Communicate with local, state, and federal agencies such as Jeffersonville Board of Public Works and Safety, Indiana-American Water Utility, United Stations Environmental Protection Agency (EP A), Indiana Department of Environmental Management (IDEM), Indiana Department of Natural Resources (IDNR), Anny Corps of Engineers (ACOE), and INDOT. iii) Prepare a brief report. m. Integration with Other Projects (Big Four Bridge Ramp, Ninth Street Park, Convention Center, Clark Street Separation) i) Review information collected on other projects within the proposed project limits to identify potential impacts on the canal project. ii) Prepare a brief report. n. Conceptual Design Cost Opinion Assessment (SUBCONSUL T ANT will lead this effort.) i) Develop cost opinions that applies the recommended or selected conceptual design to each of the identified potential routes. ii) Prepare a brief report. Conceptual Design Construction Schedule Assessment (SUBCONSUL T ANT will lead this effort.) i) Develop a construction schedule that applies the recommended selected conceptual design to each identified potential routes. ii) Prepare a brief report. 6. Final Feasibility Report (ENGINEER will lead this effort.) a. Prepare a draft feasibility report for review by OWNER. b. Prepare a final feasibility report including the recommendation of the most beneficial route that considers OWNER's comments and concerns. 7. Scope and Budget For Preliminary Design and Final Design (ENGINEER will lead this effort.) a. Develop a scope and budget for preliminary and final Designs, including National Environmental Policy Act documentation. Service Elements Not Included In addition to those identified under the referenced Technical Services Agreement, the following services are not included in this Task Order. If such services are required, they shall be provided as noted. 1. Preliminary Design 2. Final Design 3. Construction Observation 4. Postconstruction Compliance Monitoring Compensation ENGINEER's compensation for services under this Task Order shall be on an hourly rate basis in accordance with ENGINEER's current fee schedule plus expenses. Expenses incurred on this Task Order such as those for travel, meals, printing, postage, copies, computer, electronic communication, and long distance telephone calls shall be billed at actual cost plus 10 percent. The total compensation for these services, including expenses, is projected to be approximately $300,000.
