HomeMy WebLinkAbout2009-R-15i~ 1 2009-R-~ 2 BEFORE THE COMMON COUNCIL 3 FOR THE CITY OF JEFFERSONVILLE 4 IN THE STATE OF INDIANA 5 6 RESOLUTION AUTHORIZING THE CONTINUANCE OF THE JEFFERSONVILLE ~ URBAN ENTERPRISE ZONE AND THE RIVER RIDGE URBAN ENTERPRISE ZONE 8 UNDER THE MANAGEMENT OF THE JEFFERSONVILLE URBAN ENTERPRISE 9 ASSOCIATION io 11 WHEREAS, there currently exists within the boundaries of the City of Jeffersonville the 12 Jeffersonville Urban Enterprise Zone (JUEZ); and i3 14 WHEREAS, the Urban Enterprise zone was authorized by the Indiana Economic 15 Development Corporation (formerly the Indiana Department of Commerce) in 1999; and i6 17 WHEREAS, the JUEZ is managed by the Jeffersonville Urban Enterprise Association 18 (JUEA); and i9 20 WHEREAS, there also currently exists in the City of Jeffersonville the River Ridge 21 Urban Enterprise Zone (RRUEZ) under the authority of IC 5-28-15-11, (attached hereto and 22 incorporated herein); and 23 24 WHEREAS, the RRUEZ was formerly governed by the Indiana Army Ammunition 25 Plant (INAAP) Enterprise Association, which subsequently dissolved; and 26 27 WHEREAS, in 2005, this Council authorized and supported the continuance of the 28 JUEZ and the RRUEZ by Resolutions 2005-R-44 and 2005-R-45, respectively, (attached hereto 2g and incorporated herein), and designated the JUEA to serve as the governing body and board of 3o directors of the RRUEZ; and 31 32 WHEREAS, both the JUEZ and the RRUEZ are important economic development tools 33 for the City of Jeffersonville; and 34 35 WHEREAS, the JUEA has developed important partnerships with community 36 organizations such as the City of Jeffersonville Redevelopment Department, Jeffersonville Main 37 Street, the Southern Indiana Minority Enterprise Initiative, the Jeffersonville Housing Authority, 38 and others; and 39 4o WHEREAS, the JUEA has played a major leadership role in such projects as Riverstage, 41 rental of downtown parking, revitalization projects, and many others; and 42 43 WHEREAS, the Jeffersonville Urban Enterprise Zone is scheduled to expire at the end 44 of calendar year 2009, according to IC 5-28-15-10 (attached hereto and incorporated herein); 45 ~ WHEREAS, the Indiana General Assembly has recently amended IC 5-28-15-10 to 2 authorize the Common Council to adopt a resolution renewing an Urban Enterprise Zone for an 3 additional five (5) years; and 4 5 WHEREAS, it is necessary to complete this renewal by resolution 30 days prior to the 6 Zone's expiration date of December 31, 2009; and 7 8 WHEREAS, the Common Council of the City of Jeffersonville recognizes the value of g the JUEZ, the RRUEZ, and the JUEA to the economic development efforts of the community; 10 ~1 IT IS HEREBY RESOLVED that the Common Council of the City of Jeffersonville 12 does hereby renew the existence of the Jeffersonville Urban Enterprise Zone and the River Ridge i3 Urban Enterprise Zone, for a period of five (5) years, beginning on January 1, 2010 until i4 December 31, 2014. 15 16 IT IS FURTHER RESOLVED that the Jeffersonville Urban Enterprise Association 17 shall continue to serve as the governing body and board of directors for the Jeffersonville Urban 18 Enterprise Zone, and the River Ridge Urban Enterprise Zone. i9 20 PASSED AND ADOPTED by the Common Council of the City of Jeffersonville this 21 Day of October, 2009. 22 23 24 25 Connie Sellers, President 26 Common Council, City of Jeffersonville 27 28 Approved and signed by me this ~ ~ day of October, 2009. 2g 30 31 ~ 5 32 Thomas R. (a) Notwithstanding any other provision of this chapter, one (1) or more units {as defined in IC 36-1-2-23}may declare all or any part of a military base or another military installation that is inactive, closed, or scheduled for closure as an enterprise zone. The declaration shall be made by a resolution of the Iegislative body of the unit that contains the geographic area being declared an enterprise zone. The legislative body must include in the resolution that a U.E.A. is created or designate another entity to function as the U.E.A, under this chapter. The resolution must also be approved by the executive of the unit. (b) If the resolution is approved, the executive shall file the resolution and the executive's approval with the board. If an entity other than a U.E.A. is designated to function as a U.E.A., the entity's acceptance must be filed with the board along with the resolution. The enterprise zone designation is effective on the first day of the month following the day the resolution is filed with the board. (c) Establishment of an enterprise zone under this section is not subject to the limit of two (2) new enterprise zones each year under section 9(a) of this chapter. As added by P. APPENDIX C IC 5-28-15-10 Expiration of enterprise zone; renewal Sec. 10. (a) Subject to subsection (b), an enterprise zone expires ten (10) years after the day on which it is designated by the board. (b} In the period beginning December 1, 2008, and ending December 31, 2014, an enterprise zone does not expire under this section if the fiscal body of the municipality in which the enterprise zone is located adopts a resolution renewing the enterprise zone for an additional five (5) years. An enterprise zone may be renewed under this subsection regardless of the number of times the enterprise zone has been renewed under subsections (c) and (d). A municipal fiscal body may adopt a renewal resolution and submit a copy of the resolution to the board: (1) before August 1, 2009, in the case of an en#erprise zone that expired after November 30, 2008, or is scheduled to expire before September 1, 2009; or {2) at Ieast thirty (30) days before the expiration date of the enterprise zone, in the case of an enterprise zone scheduled to expire after August 31, 2009. If an enterprise zone is renewed under this subsection after having been renewed under subsection (d), the enterprise zone may not be renewed after the expiration of this final five (5) year period. (c) The two (2) year period immediately before the day on which the enterprise zone expires is the phaseout period. During the phaseout period, the board may review the success of the enterprise zone based on the following criteria and may, with the consent of the budget committee, renew the enterprise zone, including all provisions of this chapter, for five (5} years: (i) Increases in capital investment in the zone. (2) Retention of jobs and creation of jobs in the zone. {3) Increases in employment opportunities for residents of the zone. (d) If an enterprise zone is renewed under subsection (a), the two {2) year period immediately before the day on which the enterprise zone expires is another phaseout period. Daring the phaseout period, the board may review the success of the enterprise zone based on the criteria set forth in subsection (a) and, with the consent of the budget committee, may again renew the enterprise zone, including alI provisions of this chapter, for a f nal period of #ive (5} years.
