CODE 36-7-14, its successors and assigns {Grantee), the real estate in Clark County, Indiana, more particularly described in Exhibit "A" attached hereto and made a part hereof (the "Property"). TO HAVE AND TO HOLD, the same unto the Grantee, its successors and assigns forever, in fee simple, and with covenant of General Warranty. The Property was acquired by the City of Jeffersonville through condemnation as evidenced by Resolution 02-R-17 of the Jeffersonville Board of Public Works, recorded as Instrument 200212151 in the office of the Recorder of Clark County, Indiana; such Resolution was amended by Resolution 09-R- 3 This conveyance is made subject to all easements and restrictions of record affecting the property, and is subject to the real estate taxes for the year 2008 payable in 2009, which Grantee hereby assume and agree to pay. This conveyance is a disposal of real property without consideration to a governmental agency and is exempt from IND. CODE 36-1-11 (Disposal of Real and Personal Property) pursuant to IND. CODE 36-1-11-1(b)(22). Pursuant to IND. CODE 36-4-5-3, the city executive has the power to execute this instrument.
