HomeMy WebLinkAbout2009-R-04A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF J FERSONVILLE, INDIANA CONFIRMING RESOLUTION ~ ~~ THE BOARD OF PUBLIC WORKS APPROPRIATING AND CONDE ING AL AND PERSONAL PROPERTY FOR USE BY THE CITY OF JEFFERSONVILLE, INDIANA FOR THE ACQUISITION OF RIVER RIDGE DEVELOPMENT AUTHORITY RESOLUTION NUMBER: 7 ~ L~~ WHEREAS, the Sanitary Board (the "Sanitary Board") of the City of Jeff rs nville, Indiana (the "City") adopted Resolution Number _~- Z~~ ' on "~ ? ;and WHEREAS, the Board of Public Works ("Works Board") of the City has determined that the customers of the River Ridge Development Authority ("River Ridge") located in the City or in Utica Township of Clark County, Indiana ("Customers") would receive higher quality, lower cost sewer service and be more efficiently and effectively served if they were customers of the City; and WHEREAS, the Works Board has determined that, to best serve the Customers, it is necessary for the City to condemn and appropriate the sewer utility property of River Ridge identified in Exhibit A (the "Sewer Utility Property") attached hereto, along with any additions or improvements to the Sewer Utility Property completed since ~ 'j,,,, ~~ and located in the City or Utica Township of Clark Co ytun~, Indi a; and WHEREAS, the City and the Sanitary Board have determined that it is necessary and beneficial and of public utility benefit to proceed with such condemnation and appropriation; and WHEREAS, IC 32-24-2 provides a mechanism pursuant to which the Works Board may proceed with such condemnation and appropriation; and WHEREAS, the Works Board has determined that it is of public utility and benefit and in the best interests of the City to proceed to condemn and appropriate the sewer utility property of River Ridge under the mechanism set forth in IC 32-24-2; and WHEREAS, 32-24-2 requires the adoption by the Works Board of a resolution expressing the desire of the Works Board to condemn and appropriate such interests, and identifying such real and personal property as may be injuriously or beneficially affected; and WHEREAS, pursuant to IC 32-24-2-6, the Works Board on ~ ._. ~~ , adopted such resolution entitled Appropriating and Condemning Rea and ersonal Property for Use by the City of Jeffersonville, Indiana for the Acquisition of u+"-r ~~ ~ P v ~. ~ ~ ~ .. Resolution No. ("Original Resolu on"); and Z" Z WHEREAS, IC 32-24-2-6 requires the Works Board to publish notice of the adoption of said resolution and of the date and time and place at which the Works Board shall receive or hear remonstrance from persons interested in or affected by the Board's proceedings under IC 32-24-2; and WHEREAS, IC 32-24-2 requires the Works Board to consider any such remonstrance and then take final action confirming, modifying, or rescinding its original resolution; and WHEREAS, pursuant to IC 32-24-2-6, the Works Board on April 22, 2009, after proper publication of notice, held a public hearing and received or heard remonstrance from persons interested in or affected by the Works Board's proceedings under IC 32-24- 2; and WHEREAS, the Works Board, after considering the remonstrances, in this resolution confirms the Original Resolution; and WHEREAS, IC 32-24-2-7 requires the Works Board to prepare a list or roll of all owners or holders of property, and their respective interests therein, sought to be acquired or to be injuriously affected; and WHEREAS, the Works Board has prepared a list of all property owners and their respective interests in the property sought to be acquired hereby, which list is attached hereto as Exhibit B; and WHEREAS, IC 32-24-2-8 requires the Works Board to award damages sustained and assess the benefits accruing to each piece of property on such list and to serve written notice of the same upon the owner of each such piece of property, and, in such notices, to name the date on which the Works Board shall receive or hear written remonstrance from persons with regard to their respective awards or assessments, after such time the Works Board shall, pursuant to IC 32-24-2-10, sustain or modify such awards or assessments; and WHEREAS, the Works Board to ensure that the award of damages and assessment of benefits is fair and accurate, intends to perform due diligence or use other alternate means to evaluate the Sewer Utility Property; and WHEREAS, the due diligence process or other alternate means to evaluate the system may take up to 60 days to complete; and WHEREAS, upon completion of the due diligence or alternate evaluation process, the Works Board intends to review the results and determine the damages sustained and benefits accrued from the condemnation of the Sewer Utility Property and at that time 1390286 2 serve written notice upon the owners of the affected properties, and in such notice, name the date on which the Works Board shall receive or hear written remonstrances from persons with regard to their respective awards or assessments. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF JEFFERSONVILLE, INDIANA, AS FOLLOWS: 1. That the Works Board hereby confirms and reaffirms its desire to condemn the Sewer Utility Property as set forth in the Original Resolution. 2. That the Works Board hereby confirms and reaffirms that the condemnation of the Sewer Utility Property, as described on Exhibit A attached hereto, is necessary, beneficial and of public utility benefit as set forth in the Original Resolution. 3. That the Works Board hereby confirms and reaffirms the Original Resolution in its entirety. 4. That pursuant to IC 32-24-2-7, the Works Board has prepared a list of the affected property owners, as shown on Exhibit B attached hereto and made a part hereof. 5. That the Works Board hereby authorizes the City's officers to take such action, enter into such agreements and engage such professionals as are necessary, desirable or appropriate to accomplish the purposes of this resolution, including without limitation, due diligence and other alternate evaluation process referred to herein and obtain financing necessary for the condemnation of the Sewer Utility Property. 6. That the due diligence or other alternate evaluation report on the Sewer Utility Property will be presented to the Board no later than 7. That, upon receipt of the due diligence or other alternate evaluation report, the Works Board will award the damages and assess the benefits to the affected property owners. 8. That the Clerk of the Works Board shall and hereby is, upon receipt of the award of damages and assessment of benefits, directed and authorized to send notice containing the amount of the award or assessment and the date of the hearing on remonstrance to those persons listed on Exhibit B attached hereto. Plant), on approximately 4 acres of land, and perpetual access to Patrol Road. B. Approximately 16,500 feet of 8-inch cast iron (CI) pipe effluent force main on a 20-foot wide easement (Total area = 7.6 ac. ~), and perpetual access to this facility. C. A small pump station on approximately 0.06 acres of land (50' x 50' area), and perpetual access to this facility. D. The following sanitary sewers and manholes: Tributary directly to the Wastewater Treatment Plant: a. Approx.. 3,150' of 10" VCP on a 20-foot easement (approx. 1.5 ac.) b. Approx 31,400' of 8" VCP on a 20-foot easement (approx 14.4 ac.) c. Approx. 3,000' of 8" VCP on a 20-foot easement (approx. 1.4 ac.) d. Approx. 165 manholes e. Perpetual access to these facilities. 2. Tributary to small pump station: a. Approx. 4,000' of 8" CI force main on a 20-foot easement (approx. 1.8 ac.) b. Approx. 5,800' of`8" VCP on a 20-foot easement (approx. 2.7 ac.) c. Approx 1,200' of 8"PVC on a 20-foot easement (approx. 0.55 ac.) d.
