HomeMy WebLinkAbout2009-R-02BY THE JEFFERSONVILLE REDEVELOPMENT AUTHORITY RESOLUTION NO. ~OD9 ~/~ 'D~ WHEREAS, the Jeffersonville Redevelopment Authority ("Authority") was created by the City of Jeffersonville ("City") as a separate body corporate and politic and as an instrumentality of the City to exercise the powers conferred upon it under Ind. Code § 36-7-14.5, et seq.; and WHEREAS, such powers include the power to finance, improve, construct, reconstruct, renovate, purchase, lease, acquire, or equip local public improvements; and WHEREAS, the Authority believes it is in its best interests and the best interests of the City to purchase a vacant, unused and blighted parcel of property consisting of 2.944 acres, more or less, located at 521 West Ninth Street, Jeffersonville, Indiana, from Paul Michael Campbell ("Seller") for the purpose of constructing, reconstructing, renovating, and/or making public improvements; and WHEREAS, the Authority has been made aware that such parcel to be purchased is burdened with certain defects of title, which are believed to be curable; and WHEREAS, the Authority believes it to be in its best interests and the best interests of the City to proceed with the purchase of the property despite the potential risks incurred from the defects of title; NOW, THEREFORE, BE IT RESOLVED by the Authority that the City shall be and is hereby authorized to purchase 2.944 acres, more or less, situated at 521 West Ninth Street, Jeffersonville, from the Seller pursuant to the merged terms and agreements of the Offer to Purchase made by the City on December 12, 2008, and the Counter Offer made by the Seller on December 15, 2008, and further subject to any amendments or revisions thereafter agreed upon between the Seller and the City. The Executive Director of the Authority is authorized to take any and all action and to sign any and all documentation as become necessary to carry out the purchase of this property. SO RESOLVED this 13~' day of April, 2009.
