An Ordinance Creating a Special
River Front Business Overlay District
And creating specific
Requirements for parking within the
River Front Business Overlay District
WHEREAS, the Jeffersonville City Council has the statutory authority to enact
ordinances to promote general health, safety and welfare of the citizens of
Jeffersonville; and
WHEREAS, the Jeffersonville City Council continually supports economic
development efforts throughout the City and further enhance revenues in various Tax
Increment Financing (TIF) Districts; and
WHEREAS, the Jeffersonville City Council continually supports efforts to
revitalize and further encourage economic development in the downtown and riverfront
areas; and
WHEREAS, the City of Jeffersonville currently supports the business investment
and reinvestment in the river front restaurant area bounded by and between the Clark
Memorial (Second St) Bridge, The Kennedy (I-65) Bridge, the Ohio River and Court
Ave; and
WHEREAS, the City of Jeffersonville has adopted Zoning Ordinances which
describe standards within certain Zoning Classifications and Overlay Districts; and
WHEREAS, the Jeffersonville City Council does not have an ordinance that
effectively regulates parking requirements pertaining solely in the area of the
Jeffersonville river front now occupied by a myriad of business including, but not limited
to, hotels, restaurants, commercial businesses and residential structures; and
WHEREAS, in an effort to ascertain the needs of the River Front Business
District and to determine the most prudent requirements for parking that would best
serve the River Front Business District, the City secured a parking study, and
WHEREFORE, the Jeffersonville City Council, based upon empirical evidence
provided, believes it is in the best interest of the citizens, businesses and residences to
create a River Front Business Overlay District and thus creating specific Requirements
for parking within the River Front Business Overlay District as follows:

1. The Jeffersonville City Council adopts the findings of the Walker
Parking Study,
2. The Jeffersonville City Council, based upon the Walker Parking
Study, determines that there is no need for an additional supply of
parking in the River Front Business District;
3. The Jeffersonville City Council, therefore, based upon the Walker
Parking Study, finds that there is an adequate parking supply in
the District to accommodate all existing occupied or unoccupied
commercial or residential buildings located therein.
4. Upon the recommendation of the Jeffersonville Redevelopment
Commission, and in reliance upon the Walker Parking Study, the
Jeffersonville City Council directs the Jeffersonville Planning
Commission to Exempt the River Front Business Overlay District
from the pending revisions to the Jeffersonville Zoning Ordinances
as it relates to parking requirements.
Severability Clause:
Should any section, paragraph, sentence, clause or phrase of this ordinance, or its application to
any person or circumstance, be declared unconstitutional or otherwise invalid for any reason, or
should any portion of this ordinance be preempted by state or federal law or regulation, such
decision or preemption shall not affect the validity of the remaining portions of this ordinance or
its application to other persons or circumstances.
This Ordinance shall be in full force and effect from and after its passage and
approval.
