(formerly FMSM Engineers) is pleased to present this additional scope of services for preparing a Mitigation Plan in support of an on-going permit application effort for proposed activities regulated under Sections 404 and 401 of the Clean Water Act, as administered by the Indiana Department of Environmental Management (IDEM) and the U.S. Army Corps of Engineers (USAGE), respectively. Agency Coordination is also proposed to support the ongoing negotiations between the USAGE, IDEM, and other agencies involved in the enforcement case initiated by the USAGE during the initial site clearing. Proposed Mitigation Plan Activities The following discussion outlines the proposed tasks involved in the development of a conceptual and final mitigation plan and post construction monitoring for the Quarry Road Project: Task 1 -Agency Coordination There are a number of outstanding regulatory issues related to the start of construction before a permit was secured. The level of effort to serve this task is not definitive because it is unclear how the agencies will finally handle the pre-permit construction issue. Stantec proposes that services performed under this task be billed on a time and materials basis with snot-to-exceed limit. Task 2 -Conceptual Mitigation Plan Stantec will develop a conceptual mitigation plan designed to satisfy the mitigation requirements of the USAGE and IDEM. The plan will be a schematic that will document the basic mitigation approach of the project, but without specific design details such as cut and fill volumes, elevations, and grades. Task 3 -Submit Permit Application (Previous Scope Item) Stantec will prepare permit application for the USAGE and IDEM. The application will include the Jurisdictional Determination information, conceptual mitigation plan and application forms. Staf1~C January 20, 2009 Mr. Jorge Lanz Page 2 of 5 Reference: Scope of Services for Mitigation Plan Development and Agency Coordination America Place/Quarry Road Project Jeffersonville, Clark County, Indiana Task 4 -Site Visit with USACE /IDEM After submittal of the Section 404/401 permit, Stantec will coordinate a meeting and site visit with the USACE and IDEM. After the meeting, Stantec will conduct the proper coordination to answer the requests of the USACE, IDEM, United States Fish and Wildlife Service (USFWS), and the State Historic Preservation Office (SHPO). Task 5 -Field Surveys Topographic Survey: Stantec will require a complete topographic survey of the Quarry Road corridor and greater Quarry Road property. The survey should be provided in NAD 83 and State Plane Coordinates. Soil Survey & Analysis: Stantec will contract a local excavator for a day and dig several test pits to examine the soil profiles and water tables throughout the selected mitigation sites. Topographic and soils data collected in the field will be analyzed to identify the best method for wetland construction and hydrologic control over the site. Task 6 -Final Mitigation Design; Construction Drawings /Specifications Stantec will prepare final mitigation plans and specifications to meet the requirements of the USACE and IDEM. These will include the results of the field work, the wetland mitigation approach, construction drawings, construction specifications, aconstruction schedule, opinion of construction costs, and a mitigation monitoring plan. Stantec will prepare design documents at the 50%, 90%, and final submittal stages. Task 7 -Optional Services -Endangered Species Assessments (Previous Scope Item) Based on U.S. Fish and Wildlife Service Endangered Species Database, the Indiana bat (Myotis sodalis) is federally listed species known to occur in Clark County, Indiana. If it is determined that appropriate habitat is present with the project area, the USFWS may require a survey to determine if the species is utilizing the identified habitat. Endangered species survey is not included, but can be provided as an optional service. Task 8 -Optional Services -Cultural, Historic and Archeological Assessments (Previous Scope Item) It has been our experience that projects of this nature are typically mandated to have cultural resource investigations to verify the absence of cultural resources and historic structures. Stantec can provide these services in accordance with current Specifications for Conducting Fieldwork and Preparing Cultural Resource Assessment Reports issued by the Indiana State Historic Preservation Office. For the purposes of this study, the area encompassing the maximum extent of the proposed project footprint will be examined. The amount of area requiring intensive field survey may be reduced with additional information on current and past use.
