HomeMy WebLinkAbout2008-OR-63 ORDINANCE NO.2008-OR-63 AN ORDINANCE VACATING A PORTION OF A DRAINAGE EASEMENT WHEREAS, BILDM, LLC, an Indiana limited liability company (hereinafter referred to as the "Owner"), having heretofore filed a Petition to Vacate Drainage Easement, and notice of said petition and the time and place of the hearing thereon having been given by the Owner, pursuant to the provisions of IC 5-3-1, and the Common Council of the City of Jeffersonville, Indiana (the "Common Council"), having examined and heard evidence on said petition and being duly advised in the premises now finds that said petition should be granted. NOW, THEREFORE, BE IT ORDAINED by this Common Council that the drainage easement located along the rear of Lot Numbers 146, 14.7, and 148 in Rolling Ridge Subdivision, Section 2, Clark County, Indiana, and more particularly described by metes and bounds in Exhibit A and shown in Exhibit B attached to and made a part of this Ordinance, shall be and is hereby vacated by this Common Council, and that the fee simple title to that portion of the real property subject to the drainage easement described in Exhibit A shall hereinafter vest in the Owner free and clear of said easement; provided, however, that this Ordinance shall become effective and be recorded in the Clark County Records only following delivery by Owner of fully executed drainage easements in recordable form from the owners of Lot Numbers fly through i a, inclusive, to the City of Jeffersonville in the manner required by the Jeffersonville Drainage Board. This Ordinance shall in no manner affect the detention basin serving the subdivision. EXHIBIT A LEGAL DESCRIPTION OF VACATED DRAINAGE EASEMENT DESCRIPTION OF VACATED DRAINAGE EASEMENT ON LOT #146, ROLLING RIDGE SUBDIVISION, SECTION 2 The following is a legal description prepared this 14th day of July, 2008, of real property being part of Survey #22 of the Illinois Grant, Jeffersonville Township, Clark County, Indiana, more particularly described as follows: Commencing at the Northwestern corner of the corrected plat of Rolling Ridge Subdivision, said point being a point in the rear line of Lot #94 of said tract, thence with the North line of said subdivision North 54° 45' O1" East 281.80 feet, thence perpendicular to the North line of said subdivision North 35° 14' S9" West 20.00 feet, thence along an existing easement line North 55° 57' 27" West 206.78 feet, thence North OS° 15' S 1" East 106.26 feet to the point of beginning, thence continuing North OS° 15' S 1 " East 112.90 feet, thence North 54° 45' 09" East 13.83 feet, thence South 39° 57' 48" East 20.48 feet, thence South O1° 02' 29" West 26.09 feet, thence South OS' S 1' S6" West 82.45 feet, thence North 82° 31' 48" West 26.13 feet to the point of beginning, containing 0.070 Acre, or 3,062 square feet, more or less. DESCRIPTION OF VACATED DRAINAGE EASEMENT ON LOT #147, ROLLING RIDGE SUBDIVISION, SECTION 2 The following is a legal description prepared this 14th day of July, 2008, of real properly being part of Survey #22 of the Illinois Grant, Jeffersonville Township, Clark County, Indiana, more particularly described as follows: Commencing at the Northwestern corner of the corrected plat of Rolling Ridge Subdivision, said point being a point in the rear line of Lot #94 of said tract, thence with the North line of said subdivision North 54° 45' O1" East 281.80 feet, thence perpendicular to the North line of said subdivision North 35° 14' S9" West 20.00 feet, thence along an existing easement line North 55° 57' 27" West 191.21 feet to the point of beginning, thence continuing North 55° 57' 27" West 15.57 feet, thence North 05° 15' S 1" East 106.26 feet, thence South 82° 31' 48" East 26.13 feet, thence South 00° 39' 41" East 94.04 feet, thence South 54° 21' 15" West 29.34 feet to the point of beginning, containing 0.077 Acre, or 3,334 square feet, more or less.
