HomeMy WebLinkAbout1995-R-21RESOLUTION NO. 95-R- ~'/ A RESOLUTION ADOPTING A WRITTEN FISCAL PLAN ESTABLISHING A POLICY FOR THE PROVISION OF SERVICES TO AN ANNEXED AREA (Annexation Area 5) WHEREAS, the City of Jeffersonville desires to annex an area contiguous and adjacent to the corporate limits of the City of Jeffersonville, more particularly described in Ordinance 95-OR-,~__~; and WHEREAS, state law requires adoption of a fiscal plan and a definite policy for the provision of service is to annexed areas; and WHEREAS, such plan has been developed and presented to the Common Council, entitled "Fiscal Plan for Annexation Area 5"; NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, CLARK COUNTY, INDIANA, THAT: 1. The Common Council of the City of Jeffersonville, Clark County, Indiana, hereby approves and adopts the "Fiscal Plan for Annexation Area 5", which Plan is attached hereto and made a part hereof, and hereby approves and adopts the specific policies for implementation of the Plan as set out therein; 2. Any monies necessary for the provision of services as described and itemized in the attached Plan shall be budgeted and appropriated from the applicable fund, pursuant to state law and the City's budget procedure; 3. It is anticipated that this annexation will not result in the elimination of jobs for employees of other governmental entities, but in the event it does, the City of Jeffersonville shall assist such employees in obtaining new employment. However, nothing herein shall require the City to hire any such employees. It does not recommend for or against annexation, but provides an objective analysis of the financial and other impacts of annexing Area 5. The incorporation of Annexation Area 5 into the City of Jeffersonvil~e will require the provision of services in a manner equivalent in standard and scope to services now provided in comparable parts of the City. This report analyzes the impact that Area 5's annexation will have on various city services and outlines a plan for providing pertinent services. To this end, the study serves as the City's written fiscal plan and annexation policy requirements to be inctuded in any resolution of the Common Council related to the annexation of Area 5. Such a plan and policy are necessary to meet State statutory requirements. LOCATION Annexation Area 5 is located adjacent to the City of Jeffersonvilte on the north, west and south, it extends between the CSX Railroad and Highway 62 from the Northaven Subdivision to Holmans Lane and along the Holmans Lane corridor from Highway 62 to New Albany-Charleston Pike. Map 1 which follows this page, shows the boundaries of this 305+ acre area. Area 5 is within portions of Grants 11, 12. 21 and 22 of Jeffersonville Township. It should be noted that the City's ordinance pertaining to the annexation of Area 5 should contain a legal description of the area. METHOD OF ANNEXATION The City of Jeffersonville may, by ordinance, annex territory that is contiguous to its corporate imits, provided the annexation meets one of the following conditions: At least 1/8 of the aggregate external boundaries of the territory sought to be annexed must coincide with the existing boundaries of the City of Jeffersonvitle; and that either: A. Sixty percent (60%) of the territory s subdivided: Map ! LOCATION MAP ANNEXATION AREA 5 COMPARABLE AREA CITY of J.EFFERSONVILLE INDIANA DEPARTMENT OF REDEVELOPMEN The resident population density of the territory sought to be annexed ~s eduat to at least three (3) persons per acre; or The territory ~s zoned for commercial business or industrial use. o._r At least 1/4 of the aggregate external boundaries of the territory sought to be annexed coincides with the boundaries of the City of Jeffersonville; and; The territory sought to be annexed is needed and can be used by the City of Jeffersonville for its development in the reasonable near future. The proposed annexation of Area 5 will meet condition 2 which relates to the statutory req uirements of 1 C36-4-3-13(b). Therefore, the City of jeffersonville retains the authority to annex the proposed area pursuant to the provisions that it has a 1/8 contiguity boundary and that it is needed and can be used in the future development of the City. Portion of Boundary Bordering City Limits Portion of Boundary Not Bordering City Limits 20,551' (80.5%) 4,988' (19.5%) TOTAL BOUNDARY - 25,539' Annexation Need The City of Jeffersonville needs to annex Area 5 to provide for a more manageable corporate limits and to assure the orderly growth of the Area in a manner that will meet the development needs of the City. Some 80 oercent of Annexation Area 5 is literally surrounded by the City of Jeffersonville (see Mao 1). The interior of Area 5 is accessible only via city streets. The part of Area~5 that ex~enas along Holmans Lane connects different parts of the City and is the ma~n route between the north part of the city and Jeffersonvitle High School. The City's fire aha police departments must now travel through this part of the proposed annexation area to serve major sections of the City. 2 0 % o 0 Land ownership in Area 5 is in 114 separate parcels. Eight parcels exceed ten acres in size with one parcel slightly u qder 42 acres. These e~ght pa rcels account for over 50 perce ~t of the total land area. Most of the large size parcels are either vacant or not fully develcped and offer the possibility for planned developments. POPULATION Area 5 has an estimated population of 283 persons based on the average household size found in the fringe area of Jeffersonville. 5 f ZONING The City of jeffersonville [~as, un der State enabling legislation, adopted extraterritorial zoning jurisdiction beyond its corporate limits: therefore, zoning within Annexation Area 5 is now being administered by the City. Exhibit B. Map 3 shows the existing zoning ~n Annexation Area 5. The following existing zoning districts are applied to the land in Area 5; Zoninq Plan, R1 R2 B1 B2 B3 11 Single-Family Residences Single, Two & Multi Residences Local Business Service District General Business Light Industrial Because of the City's extraterritorial zoning jurisdiction, the administration of zoning will only involve the transfer of zoning district classifications from the Fringe Area Zoning Map to the City of Jeffersonville Zoning Map. This will be done immediately following the effective date of annexation. STREETS Only four streets comprising 1.8 miles of roadway exist in Annexation Area 5. Three are classified as minor residential streets. They are Hoskins Drive, a short cul-de-sac which is in good condition: Thompson Lane, parts of which has very narrow pavement width and a short portion of which is unpaved; an(: Hammons Lane. a short cu -de-sac which is in good condition. The fourth street. Holmans Lane. provides access between the northeast and north central parts of Jeffersc r~ville. Although this one mile sec. merit is in unincorporated Clark County, its northern and southern terminu s is in the city limits and all of its route borders the City on at lea~t one side. Holmans Lane is in good condition. 6 The City of Jeffersonville's street maintenar~ce staff consists of a Street Commissioner an(~ fou 'teen full time employees. This staff is now responsible for maintaining some 145 miles of imoroved s[reets. The incorpcration of Annexation Area 5 will add about 1.8 miles to the City's ma~ qtenance responsibilities. ApproximatelY ha f of these miles would be minor streets and half are on Holmans Lane a major connector street. This would be a 1.2% increase in the City's street maintenance resoonsibilities. Following is a list of each street in Annexation Area 5 that the City would be resoonsible for maintaining. Miles Street ' Holmans Lane 1.008 .118 Hoskins Drive .549 Thompson Lane .142 Hammons Lane TOTAL: 1.817 Routine annuat maintenance operations are all that is needed for Holmans Lane, Hammons Lane and Hoskins Drive. The Annexation of Area 5 will eventually increase the City's annual cost of street maintenance by an estimated $3,250. This figure was derived by dividing the City's current street miles into the expense of street maintenance. This results in a maintenance cost of $t,789 per mile of street. The application of this figure to the 1.8 miles of streets in Area 5 results in an estimated annual maintenance cost of $3,250. Although the City will assume the responsibility for street maintenance in the first year after annexation, it is not anticipated that any increased maintenance funds will be needed until the second year. This is because of the good condition of existing streets in Area 5 other than those planned to receive capital improyements. ImprovementS will be needed to upgrade portions of Thomson Lane to meet standards in comparable parts of the city. The only other street improvement in Annexation Area 5 is the proposed tnner City Road Which will connect to the east and north parts of Jeffersonville. The proposed route is presently planned to use the Holmans Lane right-of- way in annexation Area 5. The current plan is to use Tax Increment Financing (TIF) to pay for this proposed improvement. The inner City Road Project is financially independent of the proposed annexation and will have no effect on the financial plan for Annexation Area 5. 7 Street Plan COST ESTIMATE: $15,250 .-AnnUal Budget for Street Maintenance ....................................... --ThOmpson Lane Improvements .................................................... $3,250 $12,000 METHOD OF FINANCING: Source of funds for the above costs will be the Local Roads and Street Fund, the Motor Vehicle Fund and the General Fund, City Budget. PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: Street maintenance will be assumed by the City of jeffersonville within twelve (12) months after the effective date of annexation. The City's street maintenance budget will be increased by $3,250 annually starting in the second year after annexation to meet anticipated needs. The only street ca pital improvement cost for Annexation Area 5 will be $12,000 for improvements to Thompson Lane. This will be accomplished within three years of the effective date of annexation. SIDEWALKS No sidewalks exist in Annexation Area 5. This is similar to conditions in the corn parable area. Sidewalk Plan COST ESTIMATE: $0 METHOD OF FINANCING: Inapplicable PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: Because sidewalks are provided for the Annexation Area in the same manner as ~n corn parable parts of Jeffersonville no new sidewalk construction is planned in .Area 5. 8 STREET LIGHTS There are no existing street lights in Annexation Area 5. Other than 'n front of JeffersonviIle High School or' ~y two street li~ ~ts are located along Woodland Road in the corn parable area of the City. These lights exist because of the City's policy of responding to a rec. uest which is submitted to the Board of Public Works for approval or denial. If approved street ligms are installed by Public Service ndiana at a charge to the City of $7.53 per month for 150w sodium vapor lights using standard wooden poles and $6.55 for 100w sodium vapor lights. Street Light Plan COST ESTIMATE: $157 annually METHOD OF FINANCING: General Fund PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: The street light policy now in effect throughout the City of Jeffersonville will be available to Annexation Area 5 immediately upon annexation. This policy will be comparable to the policy applicable to all parts of Jeffersonville. For financial planning purposes, it is assumed that the same number of street lights will be requested and approved for Area 5 as now exist in the comparable area. GARBAGE COLLECTION Garbage collection is now provided to the residents and other uses in Annexation Area 5 by two private companies. Once per week residential pick-up is offered by Rumke of Indiana, Inc. for $11.00 per month, and by BFI Waste Systems for $12.00 per month. Each offers varying rates based on container size for commercial customers. The City of Jeffersonville now provides one garbage pick-up per week for residences at no charge. Service is not provided for commercial or institutional uses. To avoid any additional personnel or equipment costs and landfill expenses, the City plans to contract sanitation services in Annexation Are~ 5 to a private company. An estimated cost, based on current City sanitation service contracts, to serve the Area's 116 existing residential pick-ups would be approximately $6,257 per year. 9 Garbaqe Collection Plan COST ESTIMATE: $6,257 annually METHOD OF FINANCING: Sanitation Fund and/or other funds of the City. PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: The City of Jeffersonville will let bids on a contract to provide garbage collection to Area 5 at the City's present level of service. Bidding documents will be prepared and a bid awarded to provide service no later than the third month of the first year after annexation. WATER Annexation will have no effect on water services as it is provided in Area 6 by two private companies, the r~diana-Amencan Water Company, Inc. and the Watson Rural Water Company and by the Sellersburg Water system. Water Service Plan COST ESTIMATE: $0 METHOD OF ~INANCING: Inapplicable PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: Continued provision of serwces by current suppliers. FIRE HYDRANTS Annexation Area 5 now has four fire hydrants which are on the Indiana-American Water Company, Inc. system and two that are on the Sellersburg system. An additional seven hydrants are needed to serve Area 5 with hydrant availability comparable to the mimmum standards of the Jeffersonville Fire Department. Map 4 which is incorporated herein and attached as Exhibit C. shows the location of existing fire hydrants. 10 Fire Hydrant Plan COST ESTIMATE: $2,800 annually --Annual Rental of Existing Fire Hydrants (6 @ $215.40 each) ........................... ~$1292 --Annual Rental of New Fire Hydrants (7 @ $215.40 each) .................................. $1,508 METHOD OF FINANCING: General Fund,City Budget PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: Rental on the existing fire hydrants wilt be assumed by the City the sixth month of the first year after annexation. The City will have seven new fire hydrants installed no later than the sixth month of the first year after annexation. This will provide every structure in the Area with adequate accessibility to a fire hydrant. SANITARY SEWER Except for the mobile home park located on Highway 62, the City of Jeffersonville's sanitary sewer service does not presently serve Annexation Area 5. Cost estimates prepared by professional engineers indicate a capital expenditure of $1,189,540 would be needed to design and construct sufficient sewer lines to serve the 75 residences, six businesses and two churches that are not on sewer. This Would Provide sewer service in a manner consistent with the provisions of such service in the comparable area of City of Jeffersonville. ThiS capital Cost will be reduCed by an estimated $45,975 in tap fees. However, it should be realized that these tap fees will not be collected until after the sewer is constructed and that a significant percentage of the fees may be paid on an installment basis. It should be emphasized that the $1,189,540 sewer cost is an engineers' estimate made without the benefit of detailed analysis. The estimate could very easily be increased or decreased by: 1) detailed engineering, 2) actual construction bid, and/or 3) fUtUre economic conditions. Also, it might be possible to realize a cost savings by using city forces for part of the construction, and anticipated development projects in Area 5 might provide lines that could serve some of the unsewered residences. Map 5, which is attached and incorporated herein as Exhibit D, shows existing sanitary sewer lines and identifies structures to be served by proposed sewer. 11 In addition to the specific sewer neeQs of Area 5. the proposed Inner City Road ~roject calls for a sewer extension which directly affects Annexation Area 5. It involves the construction of an interceptor from the Vtillcreek Pump Station to Allison Lane consisting of the installation of approximately 10.000 feet of sanitary sewer, about 29 manholes and upgrading the existing Millcreek Pump Station at an estimated cost of $1,652,425. This work is needed to permit the installation of sanitary sewer in Annexation Area 5. The cost will be included as part of the proposed Tax Increment Finance (TIF) Project for the Inner City Road Project. Sanitary Sewer Plan COST ESTIMATE: $1 189.540 capita expense METHOD OF FINANCING: General Fund and other City funds PLAN FOR ORGANIZATION AND EXTENSION OF SERVICE: As part of the Annexation Area 5 plan, the City will design and construct adequate sanitary sewer lines to serve the develope<~, but unsewered parts of the Area Engineering design will be completed in the first quarter of year tiqree and all construction will be completed prior to the end of year three. Sewer construction will involve an estimated 11 150 linear feet of gravity sewer. 33 new manholes, upgrading of the Wilson School Pump Station and the need to obtain about 1.5 acres of sewer easement. No new Iift station or force main construction will pe necessary. 12 STORM DRAINAGE Storm drainage facilities in the form of ditches and culverts is available throughout Area 5. No major drainage problems have been reported to the County within Area 5. Routine maintenance of drainage facilities will be provided by the City's street and sanitary sewer maintenance personnel at no additional budget expense. cost ESTIMATE: $0 METHOD OF FINANCING: Inapplicable PLAN FOR ORGANIZATION AND EXTENSION OF SERVICE: The City of Jeffersonville's personnel engaged in street and sanitary sewer maintenance Will proVide routine storm drainage maintenance. The expense for this service is included in the cost figure for street maintenance. FLOOD PLAIN Based on Federal Emergency Management Agency (FEMA) maps, no part of Annexation Area 5 is within a flood plain. Flood Plain Plan COST ESTIMATE: $0 METHOD OF FINANCING: inapplicable PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: Application of the City of Jeffersonville's flood plain regulations. FIRE PROTECTION Fire protection is presently provided to Annexation Area 5 by the McCulloh Volunteer Fire Department from its station on Allison Lane. In Area 5 the McCultoh system has a Class 7 rating. Jeffersonville Township now pays the Volunteer Fire Department for protection through a .1899 tax rate for propertie,s in the unincorporated parts of the Township. Property owners in Area 5 would cease to pay this tax one year after annexation. · 13 Annexation will transfer the responsibility for fire protection to the City of Jeffersonville Fire Department which has a Class 5 rating. A major advantage of the Jeffersonville Fire De2ar~ment is 24-hour response with sufficient people on duty at alt times. The JeffersonviIle Fire Department now mas 49 fire fighter personnel and six trucks which serve the City from three stations. The distribution of fire fighting personnel and equipment is as follows: Central (Wall Street) East (Crestview) North (Fabricon) 4 Trucks I Truck 1 Truck 21 Firefighters 12 Firefignters 12 Firefighters Fire Protection Plan COST ESTIMATE: $0 METHOD OF FINANCING: PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: The City of Jeffersonvilte will provide fire protection to Area 5 six months after the effective date of annexation. This will improve the Area's fire protection service from a Class 7 to Class 5 rating. Service to Area 5 will not require any additional personnel or equipment. The City is currently studying two potential annexation areas in addition to Area 5. These three areas, when combined will not ct~ange the financing, personnel or equipment needs outlined in this study. However, annexations beyond the three areas currently under study could require additional budget or the relocation of the Fire Department's East (Crestview) Station. 14 POLICE PROTECTION Police protection is now provided to Annexation Area 5 by the Clark County Shedff's Department. The Sheriff's Department has 31 officers to serve the entire County. The annexation of Area 5 will transfer the responsibility for police protection to the Jeffersonville Police Department. This Department will able to respond much quicker to the Area's police calls. In fact, the Jeffersonville Police Department makes about 33 runs per year to unincorporated areas because the Sheriffs Department personnel is stretched over too much land area. The annexation of Area 5 will help reduce the County's police work load. Existing personnel of the Jeffersonville Police Department consists of the Chief, Assistant Chief, 35 officers and 8 civilians. The City is now divided into three areas for patrol purposes and identification. Response time for the Police Department to all parts of the City averages 2.5 minutes. The patrol area delineations are as follows: East West North All streets east of Main Street All streets west of Main Street Everything north of E. 10th Street and Spring Street Police runs in the comparable area which is located south of Annexation Area 5 average approximately 44 runs annually. It is estimated that Area 5 will average approximately the same number of runs annually. The Police Department now actively patrols along parts of Holmans Lane and all of Highway 62; therefore, Area 5 will require very little increase in police patrol activity. These patrols could ddve the 1.8 miles of public street in Area 5 in approximately 6 to 7 minutes. This amount of time will not place any significant burden on existing police patrols. 15 Police Protection Plan COST ESTIMATE: $0 METHOD OF =INANCING: napplicable PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: Police patrols now traveling Holmans Lane and Highway 62 will be instructed to provide police protection to Annexation Area 5 starting the first day after the effective date of annexation. This plan to assume police protection responsibility can be im ~lemented at no additional expense to the City as it will not require the hiring of any new personnel. will not re(]uire the purchase of any new equipment and will increase current patrol time by no more [han 6 to 7 minutes The City is now studying two annexation areas in addition to Area 5. These three areas when combined will not change the financing, personnel or equipment needs plan outlined [n the study of each individual area It should be stressed, however, that annexations beyond the three areas currently under study could result in the neeC for additional budget. RECREATION No public recreational facilities are located in Annexation Area 5. However. Northhaven Park. a medium sized neighborhood facility is located immediately adjacent to the western boundary of Area 5. t contains a picnic shetter, three (3) picnic tables, two (2) benches, two (2) junior swing sets. two (2) slides, one (1) merry-go-rouna and softball field, with paved parking on an adjacent school lot for over fifty (50) cars. This facility along with some 154 acres of neighborhood, community and city parks are located throughout the City and will be available for the use of Area 5's 'esidents ',1o increase in recreation personnel or facilities wi! be needed because of the annexation of Area 5. Recreation Plan COST ESTIMATE: $0 METHOD OF FINANCING: Inapplicable PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: The present -ecreationa facilities of the City of Jeffersonville will be available to the residents of Area 5 immediately upon annexation. This will be comparable to the facilities available to the residents of comparable areas in the City. 16 CITY ENGINEERING, PLANNING & ZONING, INSPECTION & BUILDING CODE ENFORCEMENT All of the services of the City's engineering, planning and zoning, inspection and code er~forcement personnel that are currently provided to residents of the City and the comparable areas will be made available to Annexation Area 5. No additional personnel will ~e needed to provide these services. City En.qineerin.q, Planninq & Zonin.q, Inspection & Buildinq Code Enforcement Plan COST ESTIMATE: $0 METHOD OF FINANCING: Inapplicable PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: The City will provide the above listed services with existing oersonnel. ADMINISTRATIVE SERVICES City administration and operations include departments that are not directly involved r~ the provision of capital and noncapital services. Some examples of this are the mayor's office, clerk's office, personnel, legal, etc. The request for these services will be provided to the same standard and scope as they are now provided to the City and to the comparable area. These services can be provided within the bounds of existing resources. Administrative Services Plan COST ESTIMATE: $0 METHOD OF FINANCING: Inapplicable PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: Immediately upon annexation, all of the City's administrative services will be provided to Annexation Area 5's residents and businesses in the same manner and scope they are now provided to comparable areas of thee City. Rather. their absence indicates that provision of these services to the Annexation Area and/or its residents and businesses will be provided in the same manner that such services are provided to comparable areas without the expenditure of additional funds. The intent of this plan is that any serwces current y available to the comparable areas of the Annexation Area and/or their residents and property owners, that are not previously discussed in this plan, will be made ava lable in the same manner to the Annexation Area and/or its residents and property owners immediately uoon annexation. Other City Functions Plan COST ESTIMATE: $0 METHOD OF FINANCING: Inapplicable PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: Any municipal services not previously discussed in this plan will Be made available in the same manner to the Annexation Area and/or its residents and property owners as it is currently available to comparable areas of the City. HIRING PLAN It is anticipated that this annexation will '~ot result in the elimination of jobs for em ployees of other governmental entities, but in the event if does. then the City of Jeffersonville will assist these employees in the obtaining of new employment. However, the City will not be required to hire any of these employees. In the event of unforeseen elimination of jobs, the City will take the application of any such employee and maintain a special file of these applicati°ns. Each application will be forwarded to major employers in the area, and to any City department having a job opportunity for which the individual is qualified.
