COMMON COUNCIL OF THE CITY
OF JEFFERSONVILLE, INDIANA
September 8, 2008
The Common Council of [he City of Jeffersonville, Indiana met in regular session
in Room 101, City Hall, 500 Quartermaster Court, Jeffersonville, Indiana, at 7:30 P.M.
on Monday September 8, 2008.
Mayor Tom Galligan, with Deputy Clerk Treasurer Bazbara Hollis at the desk,
called the meeting to order. Also present were City Attorney Darren Wilder, Council
Attorney Lazry Wilder, and Clerk Treasurer Administrative Assistant Tiffany
Timberlake. Mayor Galligan welcomed all in attendance, asking all those present to
stand as Councilperson Samuel gave the invocation. Mayor Galligan then asked all those
present to join him in the pledge of allegiance to the flag.
The roll was called and those present were; Councilpersons Mike Smith, Ed
Zastawng Keith Fetz, Connie Sellers, Barbara Wilson, Nathan Samuel, and Ron Grooms.
Absent: None.
Councilperson Grooms made the motion to approve the agenda, second
Councilperson Wilson, passing on a vote of 7-0.
Deputy Clerk Treasurer Hollis presented the claim list for consideration by the
Council. At [he conclusion of al] discussion, Councilperson Smith made the motion to
remove [he Frame It Fast Claim under Council and approve the remaining claims as
presented, second by Councilperson Wilson, passing on a vote of 7-0.
PUBLIC COMMENT:
Mr. Jim Rogers said he had been promised a price of $40 each, rather than $60
each, for an order of more than 100 [rash cans for Whispering Oaks residents. Mayor
Galligan said he is not able to do [hat as the cost is near $60 each. Trash pick up will
begin three months early so the savings should offset the cost of the can. Councilperson
Grooms read an email from the Sanitation Department regarding the cos[ of the cans [o
the City. He would love to be able to give a lower price, but cannot. Council President
Zastawny feels there is equivalent savings by picking up early. Councilperson Sellers
said it would not be fair to those that have paid $60. Mr. Rogers said thank you for the

stop signs, however feels there is need for a flashing light warning. Flashing lights aze
used in high traffic areas but not all azeas. Mr. Rogers would like to see [he bond
revoked for Whispering Oaks builder 2151 Century Builders. Planning and Zoning
Director Urban noted the curbs have been repaired and paved. It is the builder's intention
to pave this year. Director Urban has called several times to explain and they do
understand what needs to be done. He is pushing. Mr. Rogers replied thank you.
COUNCIL COMMENT:
It is understood that the public comments are limited to three minutes. As there
were conversations back and forth, i[ was OK. Councilperson Grooms suggests more
residents sign in.
DEPARTMENT HEAD REPORTS:
There were no Departmeut Head reports.
AGENDA ITEMS:
Councilperson Grooms made [he motion to pass Ordinance No. 2008-OR-50, An
Ordinance Transferring Funds Within Same Department - Rivers[age, be passed on the
second and third readings, second by Councilperson Fetz, passing on a vote of 7-0.
Council President Zastawny made the motion to table, until the next meeting,
Ordinance No. 2008-OR-47, An Ordinance Regulating The Use Of City-Owned Motor
Vehicles, second by Councilperson Sellers, passing on a vote of 7-0.
Councilperson Grooms referred to an email regarding trashcans, noting Stephanie
Miller is doing a great job. Councilperson Grooms stated he was hesitant of Ordinance
No. 2008-OR-51, Trash Collection Ordinance, at first. Councilperson Grooms then
reviewed several amendments to Ordinance No. 2008-OR-51. Mayor Galligan feels all
commercial properties should be the same. Following discussion, Councilperson Grooms
made the motion to pass Ordinance No. 2008-OR-51 on the first reading asking
Annexation Coordinator Lovan to change 30 to 48, and leave in may offer commercial,
second by Council President Zastawny. Councilperson Grooms biggest concern is the
cost, he is receptive to payments. Some doubt the cans will work in the downtown azea
due to the use of alleys. Mayor Galligan said conventional packers would be used in
downtown. The benefits of using the cans is to eliminate bags and keep water out with
the real goals being safety, cost savings to workman's comp, and that [he azeas aze kept

cleaner. There are things that need [o be worked through. Mayor Galligan said the
Ordinance needs to be enforced starting January 1, 2009. This needs to apply to the
owners of property. Councilperson Fetz warned [o be prepazed for the calm before the
storm. Mayor Galligan said a notice should to be put in the paper that the cans will be
required by January 1. Councilperson Sellers asks City Attorney Wilder to look at the
$50 fine. Councilperson Grooms voiced concern for the delivery date of the packer that
has been ordered. The motion to pass Ordinance No. 2008-OR-51 on [he first reading
passed on a vote of 7-0.
Director Bill Mattingly explained the requested changes of titles in the Sewer
Department and the Animal Shelter represented in Ordinance No. 2008-OR-55, An
Ordinance Amending Basic Salazies Of Appointed Officers And Employees Of The City
Of Jeffersonville, noting no additional money is necessary. Councilperson Fetz made the
motion to pass Ordinance No. 2008-OR-55 on the first reading, second by Councilperson
Sellers, passing on a vote of 7-0.
Redevelopment Director Gayle Robinson explained the need for passage of
Resolution No. 2008-R-23, A Resolution Approving Statement Of Benefits For Purposes
Of Personal Tax Abatement (Key Electronics). Councilperson Fetz made [he motion to
pass Resolution No. 2008-R-23, second by Councilperson Sellers. Councilperson
Samuel asked if the Redevelopment Commission has approved this. Director Robinson
stated i[ will be presented at the Wednesday meeting and the Commission will be notified
of the contract stipulation. The motion to pass Resolution No. 2008-R-23 passed on a
vote of 7-0.
CLERK TREASURER COMMENTS:
There were no Clerk Treasurer Comments.
COMMITTEE REPORTS, COUNCIL AND MAYOR COMMENTS:
Councilperson Samuel asked if [he New World order has been placed. Mayor
Galligan answered yes. Councilperson Samuel noted complaints from Jefferson Trailer
Court regarding the smell of the asphalt plant. Councilperson Samuel commended the
Police Deparnnent on the savings of 1,95] gallons of gasoline following the
implementation of the take-home car policy. The Fire Department will be asked for the
same data as supplied by the Police Deparhnent. Councilperson Samuel said he would

like to see aface-sheet with a brief description for Ordinance such as the Salary
Ordinance amendment.
Councilperson Grooms announced the Finance Budget meeting would take place
in [he Mayor's Conference Room at 5:30 P.M. on September 9, 2008. He requests all to
bring their binders for updates. Councilperson Grooms thanked Jeff High Student Mat
Owen and Officer Grimes.
Councilperson Wilson reminded all of Riverbreeze that will be held Thursday.
This is a Beautification Committee fundraiser.
Councilperson Sellers thanked Derek Spence, Superintendent Hosea, and [he
downtown organization for the tire disposal day.
Councilperson Smith said the totes aze controversial. His concern is for needle
sticks. Bio med bags may be required in the future. He is also concerned about rodents.
He does feel it is a good plan.
Mayor Galligan reviewed the recent Lincoln/Douglas debate program. He
dressed up in top hat and tails. This needs to be done again, i[ was absolutely amazing
and all had a good time. He thanks [he Tourism Bureau for another good event.
As there was no further business to c ne before the Council, the meeting was
adjourned 8:40 P.M.
