Enclosed aze the completed contracts for the Jeffersonville River Stage Friday
Night Concert Series. Also, included in the packet aze the invoices for the same event. I
have invoiced the acts individually, and placed them in order by the up-coming show
date.
I will be in attendance for the first event on May 29, as I will be in town for my
daughter's graduation. If there are any issues, feel free to call me or come and see me at
the May 29 event if needed.
I look forward to the city having a great concert series, and I thank you very much
for your help in this endeavor.

Contract for Entertainment
Jeffersonville Parks Authority and
Pevton and Day Entertainment On Behalf of Jane Bondl Pink Martinis
THIS INDENTURE WITNESSETH THAT: the Jeffersonville Park
Authority (hereinafter "Authority") represents the City of Jeffersonville, Indiana
and the Jeffersonville Parks Department (hereinafter "Jeffersonville");
Peyton & Day Entertainment (PDE) is a Florida company acting as
agents for Jane Bond/ Pink Martinis;
PDE represents that it has authority to enter into this contract on behalf of
Jane Bond/ Pink Martinis and that PDE is the legal representative and agent of
Jane Bond/ Pink Martinis;
PDE represents that it has been given authority by Jane Bond/ Pink
Martinis to enter into the following contract for services with the Authority and
Jeffersonville:
1. Jane Bond! Pink Martinis agrees that on May 30, 2008 it shall provide
musical entertainment on the Jeffersonville Riverstage located at the foot of
Spring Street in Jeffersonville, Indiana.
2. Jane Bond! Pink Martinis agrees that said entertainment shall consist of
two (2) sixty (60) minute musical sets between the hours of 9:00 p.m. and
11:30 p.m. EST.
3. Jane Bond/ Pink Martinis and PDE agree that the Authority and
Jeffersonville shall be obligated to pay Jane Bond/ Pink Martinis and PDE
the sum of Three Thousand Dollars ($3,000) to be paid at the conclusion of
the entertainment.
4. The Authority and City agree that PDE has fully performed its duties and
obligations upon the execution of this agreement. However, by executing
this agreement the Authority and City do not release Jane Bond/ Pink
Martinis from its liability for failure to fulfill those duties and obligations that
Jane Bond/ Pink Martinis owes to the Authority and Jeffersonville pursuant
to this contract.
5. Jane Bondl Pink Martinis agrees that it shall indemnify and hold the
Authority and Jeffersonville harmless for any negligent, intentional or
reckless or conduct that Jane Bond/ Pink Martinis may engage in at, prior
to, or during said performance that may result in Jane Bond/ Pink Martinis
being sued, being subject to a claim for injuries or damages and/or any
other claims that may be made against the Jane Bond/ Pink Martinis by

any and all persons, corporations andlor entities.
6. Jane Bond/ Pink Martinis agree to indemnify and hold The Authority and
Jeffersonville its assignees, staff, employees and any and all other parties
affiliated therewith harmless and to defend and protect them from any
liability, toss, damages, whether actual, incidental or punitive, cost or
expenses including attorney fees with regard to any action cause of action
or claim of any nature whatsoever, whether or not included within or
covered by insurance held by the Band or the Authority or Jeffersonville
that may arise as a result of or in any way related to the Authority or
Jeffersonville's holding or presenting the event that is the subject matter of
this agreement. This shall further include any and all other activities of the
Authority or Jeffersonville in or near the event venue, including without
limitation, any actions, causes of action or claims of any nature of any
persons who attend, or participate in the scheduled event or who perform
any services in conjunction with this event.
7. The parties agree that neither the Authority or Jeffersonville are
responsible for payment of monies to PDE pursuant to any agreement that
Jane Bond/ Pink Martinis may or may not have with PDE as payment for
any services that PDE may or may not have provided on behalf of Jane
Bond! Pink Martinis.
8. The Authority and Jeffersonville agree that if, for any reason, the Authority
and/or Jeffersonville cancel said event the Authority andlor Jeffersonville
shall remain liable for the full contract price owing to Jane Bond/ Pink
Martinis as a result of this agreement.
9. The Authority and Jeffersonville agree that they shall make the
Jeffersonville River Stage available to Jane Bond/ Pink Martinis at least two
(2) hours prior to the engagement for equipment set up and for one (1)
hour following the engagement for the purpose of equipment removal.
10. The parties agree that in the event of bad weather the Authority or
Jeffersonville shall notify Jane Bond/ Pink Martinis withintwenty-four (24)
hours of the Authority or Jeffersonville's decision to relocate said
engagement.
11. The Authority and Jeffersonville agree that it shall provide Jane Bond/ Pink
Martinis with sound and light equipment. The Authority and
Jeffersonville agree to provide Jane Bond/Pink Martinis with six (6)
double rooms at a local hotel/motel.
12. Jane Bond/ Pink Martinis covenants and agrees that it shall hold the
Authority and Jeffersonville harmless upon any claims that Jane Bondl Pink
Martinis may assert against PDE for any negligence, breach of contract

and/or any other claim that Jane Bond/ Pink Martinis may make against
PDE.
13. The parties agree that any dispute that may arise as a result of this
contract shall be submitted to binding arbitration pursuant to the Indiana
Rules of Alternative Dispute Resolution. Moreover, the parties agree that
Clark County, Indiana shall be venue for any and all claims that may arise
out of this agreement. Furthermore, the parties agree that this arbitration
agreement shall apply to any contract claims and/or negligence claims that
may be asserted by any party as against any party hereto.
14. The parties acknowledge that they have read and understand this
agreement and have affixed their signature hereto on the date set forth
below:

PDE represents that it has authority to enter into this contract on behalf of
V Groove and that PDE is the legal representative and agent of V Groove;

Jeffersonville harmless for any negligent, intentional or reckless or

Peyton & Day Entertainment (PDE) is a Florida company acting as
agents for Wax Factory;
PDE represents that it has authority to enter into this contract on behalf of
Wax Factory and that PDE is the legal representative and agent of Wax Factory;
PDE represents that it has been given authority by Wax Factory to enter
into the following contract for services with the Authority and Jeffersonville:
1. Wax Factory agrees that on June 20, 2008 it shall provide musical
entertainment on the Jeffersonville Riverstage located at the foot of Spring
Street in Jeffersonville, Indiana.
2. Wax Factory agrees that said entertainment shall consist of two (2) sixty
(60) minute musical sets between the hours of 9:00 p.m. and 11:30 p.m.
EST.
3. Wax Factory and PDE agree that the Authority and Jeffersonville shall be
obligated to pay Wax Factory and PDE the sum of One Thousand Dollars
($1,000) to be paid at the conclusion of the entertainment.
4. The Authority and City agree that PDE has fully performed its duties and
obligations upon the execution of this agreement. However, by executing
this agreement the Authority and City do not release Wax Factory from its
liability for failure to fulfill those duties and obligations that Wax Factory
owes to the Authority and Jeffersonville pursuant to this contract.
5. Wax Factory agrees that it shall indemnify and hold the Authority and
Jeffersonville harmless for any negligent, intentional or reckless or
conduct that Wax Factory may engage in at, prior to, or during said
performance that may result in Wax Factory being sued, being subject to a
claim for injuries or damages and/or any other claims that may be made

against the Wax Factory by any and all persons, corporations and/or
entities.
6. The Wax Factory agrees to indemnify and hold The Authority and
Jeffersonville its assignees, staff, employees and any and all other parties
affiliated therewith harmless and to defend and protect them from any
liability, loss, damages, whether actual, incidental or punitive, cost or
expenses including attorney fees with regard to any action cause of action
or claim of any nature whatsoever, whether or not included within or
covered by insurance held by the Band or the Authority or Jeffersonville
that may arise as a result of or in any way related to the Authority or
Jeffersonville's holding or presenting the event that is the subject matter of
this agreement. This shall further include any and all other activities of the
Authority or Jeffersonville in or near the event venue, including without
limitation, any actions, causes of action or claims of any nature of any
persons who attend, or participate in the scheduled event or who perform
any services in conjunction with this event.
7. The parties agree that neither the Authority or Jeffersonville are
responsible for payment of monies to PDE pursuant to any agreement that
Wax Factory may or may not have with PDE as payment for any services
that PDE may or may not have provided on behalf of Wax Factory.
8. The Authority and Jeffersonville agree that if, for any reason, the Authority
and/or Jeffersonville cancel said event the Authority and/or Jeffersonville
shall remain liable for the full contract price owing to Wax Factory as a
result of this agreement.
9. The Authority and Jeffersonville agree that they shall make the
Jeffersonville River Stage available to Wax Factory at least two (2) hours
prior to the engagement for equipment set up and for one (1) hour following
the engagement for the purpose of equipment removal.
10. The parties agree that in the event of bad weather the Authority or
Jeffersonville shall notify Wax Factory within twenty-four (24) hours of the
Authority or Jeffersonville's decision to relocate said engagement.
11. The Authority and Jeffersonville agree that it shall provide Wax Factory
with sound and light equipment
12. Wax Factory covenants and agrees that it shall hold the Authority and

Jeffersonville harmless upon any claims that Wax Factory may assert
against PDE for any negligence, breach of contract and/or any other claim
that Wax Factory may make against PDE.
13. The parties agree that any dispute that may arise as a result of this
contract shall be submitted to binding arbitration pursuant to the Indiana
Rules of Alternative Dispute Resolution. Moreover, the parties agree that
Clark County, Indiana shall be venue for any and all claims that may arise
out of this agreement. Furthermore, the parties agree that this arbitration
agreement shall apply to any contract claims and/or negligence claims that
may be asserted by any party as against any party hereto.

made against the The Accountants by any and all persons, corporations

6. The Accountants agree to indemnify and hold The Authority and
Jeffersonville its assignees, staff, employees and any and all other parties
affiliated therewith harmless and to defend and protect them from any
liability, loss, damages, whether actual, incidental or punitive, cost or
expenses including attorney fees with regard to any action cause of action
or claim of any nature whatsoever, whether or not included within or
covered by insurance held by the Band or the Authority or Jeffersonville
that may arise as a result of or in any way related to the Authority or
Jeffersonville's holding or presenting the event that is the subject matter of
this agreement. This shall further include any and all other activities of the
Authority or Jeffersonville in or near the event venue, including without
limitation, any actions, causes of action or claims of any nature of any
persons who attend, or participate in the scheduled event or who pertorm
any services in conjunction with this event.
7. The parties agree that neither the Authority or Jeffersonville are
responsible for payment of monies to PDE pursuant to any agreement that
The Accountants may or may not have with PDE as payment for any
services that PDE may or may not have provided on behalf of The
Accountants.
8. The Authority and Jeffersonville agree that if, for any reason, the Authority
and/or Jeffersonville cancel said event the Authority and/or Jeffersonville
shall remain liable for the full contract price owing to The Accountants as a
result of this agreement.
9. The Authority and Jeffersonville agree that they shall make the
Jeffersonville River Stage available to The Accountants at least lwo (2)
hours prior to the engagement for equipment set up and for one (1) hour
following the engagement for the purpose of equipment removal.
10. The parties agree that in the event of bad weather the Authority or
Jeffersonville shall notify The Accountants within twenty-four (24) hours of
the Authority or Jeffersonville's decision to relocate said engagement.
11. The Authority and Jeffersonville agree that it shall provide The Accountants

12. The Accountants covenants and agrees that it shall hold the Authority and
Jeffersonville harmless upon any claims that The Accountants may assert
against PDE for any negligence, breach of contract and/or any other claim

contract shall be submitted to binding arbitration pursuant to the Indiana
Rules of Alternative Dispute Resolution. Moreover, the parties agree that
Clark County, Indiana shall be venue for any and all claims that may arise
out of this agreement. Furthermore, the parties agree that this arbitration
agreement shall apply to any contract claims and/or negligence claims that
may be asserted by any party as against any party hereto.

agents for Carribou;
PDE represents that it has authority to enter into this contract on behalf of
Carribou and that PDE is the legal representative and agent of Carribou;
PDE represents that it has been given authority by Carribou to enter into
the following contract for services with the Authority and Jeffersonville:
1. Carribou agrees that on August 1, 2008 it shall provide musical
entertainment on the Jeffersonville Riverstage located at the foot of Spring
Street in Jeffersonville, Indiana.
2. Carribou agrees that said entertainment shall consist of two (2) sixty (60)
minute musical sets between the hours of 9:00 p.m. and 11:30 p.m. EST.
3. Carribou and PDE agree that the Authority and Jeffersonville shall be
obligated to pay Carribou and PDE the sum of'One Thousand Two
Hundred Dollars ($1,200) to be paid at the conclusion of the
entertainment.
4. The Authority and City agree that PDE has fully performed its duties and
obligations upon the execution of this agreement. However, by executing
this agreement the Authority and City do not release Carribou from its
liability for failure to fulf II those duties and obligations that Carribou owes to
the Authority and Jeffersonville pursuant to this contract.
5. Carribou agrees that it shall indemnify and hold the Authority and
Jeffersonville harmless for any negligent, intentional or reckless or
conduct that Carribou may engage in at, prior to, or during said
performance that may result in Carribou being sued, being subject to a
claim for injuries or damages and/or any other claims that may be made

($900) to be paid at the conclusion of the entertainment.

liability for failure to fulfill those duties and obligations that Old School owes
to the Authority and Jeffersonville pursuant to this contract.

2. One Bullet Band agrees that said entertainment shall consist of two (2)
sixty (60) minute musical sets between the hours of 9:00 p.m. and 11:30
p.m. EST.
3. One Bullet Band and PDE agree that the Authority and Jeffersonville shall
be obligated to pay One Bullet Band and PDE the sum of Nine Hunded
Dollars ($900) to be paid at the conclusion of the entertainment.
