HomeMy WebLinkAbout2008-R-14RESOLUTION NO. a-~/ ~ ~' ~- i ~ COMMON COUNCIL CITY OF JEFFERSONVILLE, INDIANA REGARDING THE ENLARGEMENT OF THE INNER CITY ROAD ECONOMIC DEVELOPMENT AREA WHEREAS, Che Jeffersonville ("City") Redevelopment Commission ("Commission") did on December 22, 1995, adopt a Declaratory Resolution, as amended on December 1, 1999 and June 15, 2005 (collectively, as amended, "Declaratory Resolution") establishing the Inner City Road Economic Development Area ("Original Area") and the Declaratory Resolution was confirmed by a confirmatory resolution adopted on February 28, 1996; WHEREAS, the Commission, on May 27, 2008, after a public hearing, did adopt a resolution amending the Original Declazatory Resolution ("Amendatory Resolution") [o enlazge the Original Area and the Original Allocation Area and to add certain local public improvements to the Plan; WHEREAS, IC 36-7-14-41(c) requires that any enlazgement of the boundaries of an economic development area be approved by the Common Council; and WHEREAS, the Common Council has reviewed the Amendatory Resolution; NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CTTY OF JEFFERSONVILLE, INDIANA THAT; 1. The Common Council hereby finds and detemunes that it will be in the best interests of the City to enlazge the boundaries of the Original Area and the Original Allocation Area less than 20% as described in the Amendatory Resolution and [o add certain local public improvements to the Plan. 2. The enlazgement of the boundaries of the Original Area and the Original Allocation Area as described in the Amendatory Resolution and the addition of certain local public improvements to the Plan are hereby approved. 3. This resolution shall be effective from and after passage. Galligan, M or NOTICE TO TAXPAYERS AND ALL OTHER PERSONS AFFECTED OF PROPOSED AMENDMENT TO THE DECLARATORY RESOLUTION AND THE REDEVELOPMENT PLAN FOR THE FALLS LANDING RIVERSIDE REDEVELOPMENT AREA AND NOTICE OF PUBLIC HEARING ON PROPOSED AMENDMENT Taxpayers of the Jeffersonville ("City") Redevelopment District ("District") and all other persons affected hereby are notitied that the Jeffersonville Redevelopment Commission ("Commission"), at a meeting held on April 27, 1982 (expansion resolutions adopted on December I9, 2002, May 28, 2003 and July 1, 2003; expansion and consolidation resolutions adopted on May 10, 2004 and May 28, 2004; and as further amended on June 29, 2005), adopted a Declaratory Resolution (collectively, as amended, "Declaratory Resolution"), establishing the Falls Landing Riverside Redevelopment Area ("Area") and approving the Redevelopment Plan, as amended ("Plan") for the Area. The Declaratory Resolution also established an allocation area ("Allocation Area") within the Area. The Commission will use incremental property taxes levied and collected in the Allocation Area in accordance with IC 36-7-14 and IC 36-7-25 for redevelopment projects in, serving or benefiting the Area. The Commission, following a public hearing on May 26, 1982, adopted a Confirmatory Resolution confirming the Declaratory Resolution. The Declaratory Resolution, the Confirmatory Resolution, the Plan, and supporting data, including maps and plats describing the Area can be inspected at the Department of Redevelopment, located in Jeffersonville, Indiana. Notice is further given that the Commission on June I I, 2008, at the hour of _ _.m., local time, at the City Hall, 500 Quartermaster Court, Jeffersonville, Indiana, will consider an amendment to the Declaratory Resolution to enlarge the Area and the Allocation Area less than 20%. At that time, the Commission will receive and hear remonstrances from persons interested in or affected by the proceedings pertaining to the proposed amendment, determine the appropriateness and reasonableness of the amendment when considered in relation to the Declaratory Resolution, as amended by the proposed resolution, and whether the plan for the Area conforrts to the comprehensive plan for the City. At the time fixed for hearing or at any time prior thereto any person interested in the proceedings may file a written remonstrance with the Secretary of the Commission. At such hearing, which may be adjourned from time to time, the Commission will hear all persons interested in the proceedings and all remonstrances that have been filed. After considering this evidence, the Commission will take final action on the proposed amendment to the Declaratory Resolution and the Plan. Dated this 30°i day of May, 2008.
